Cherry Valley Investments, Inc. DBA Gigueres Waiver


Cherry Valley Investments, Inc. / encompasses Gigueres, Discovery School House, Dragon Gate Kung Fu and Gigueres Dance. For this waiver, the use of the word Gigueres will represent all businesses under Cherry Valley Investments, Inc.

ANNUAL REGISTRATION FEE: All participants are required to pay an annual registration fee at the time of sign up. This fee is good for one year from first day of enrollment and is never refundable. The annual registration fee is $40 for the first participant in an immediate family, $30 for the 2nd participant in an immediate family, and no registration for any further immediate family members participating in programs at Gigueres.

ENROLLMENT/UNENROLLMENT: Enrollment in a Gigueres program is continuous. This means that each child is enrolled from their start date through the end of our school year session in June unless a written unenrollment form is completed by the 15th of the month to unenroll for the following month. Failure to unenroll by the 15th will result in being responsible for next month's tuition cost. Gymnastics programs are continuous throughout an entire calendar year. Written notice must be given to both the office and the team coaches by the end of the current month in order to not be responsible for payment for the following month's tuition.

MONTHLY TUITION: Gigueres classes and team programs run on a monthly tuition schedule. Your tuition for classes is not based on the number of classes per month, but over a period of time. The payments were figured out based on a 40 week program (September through mid June) for gymnastics classes, kung fu classes, dance classes, dance team, and trampoline classes. Gymnastics prices were figured out based on a 40 week program. In any given month there may be 3, 4, or 5 classes depending on where the days of the week land that month, holidays, and scheduled gym closings. All families are required to keep a working credit card on file. The credit card on file will be charged automatically for all current and past due charges on the 1st of every month. If you would like to use a different type of payment you may do so prior to the 1st of the month.

REFUNDS: If during the first two classes a 1st time participant in our programs chooses to unenroll, a full refund of the tuition will be issued. The registration fee will not be refunded.

CREDIT CARDS: If Gigueres is not able to successfully charge the credit card on file by the 5th of the month, a $40 late fee will be assessed to the account. Further failed attempts to charge a credit card on file that month will result in removal from the program for the following month. If an account is not paid in a timely manner we do send unpaid accounts to our Collection agency, American Profit Recovery. This policy does apply to all team and recreational students.

MAKE UP POLICY:

-Make up classes must be scheduled through the office. Failure to show up for a make up class or notify the office of missing the make up without a 24 hour notice will result in losing the make up class with no rescheduling options.


-A maximum of 1 make up class may be done per month and must by made up within 2 weeks of the missed class.


-You must be currently enrolled to make up any missed class.


-Make up classes can not be transferred to another child in the family currently enrolled in class.


-There are no refunds or credits for missed classes.


-There are NO make up times for any missed workouts for our team programs.

WHAT TO WEAR


Students may wear tucked in t-shirts and shorts, OR leotards. NO chewing gym or dangling jewelry. Hair should be safely and securely away from the face so that it stays up for the entire class/workout. Avoid hair bows or other large ornaments that may cause discomfort during activity. All students should have activity-appropriate footwear during class. Personal items should be left in their backpack during class. Jewelry should not be worn during classes, and should be left at home. The staff are not responsible for ANY items that may be lost or stolen. Be sure your student's personal items are marked with their name.

ARRIVAL AND PICKUP


Be sure your student arrives 5 minutes before (no earlier please) his/her scheduled class/workout time. Please pick up your student on time, right after class. We ask that you inform us by calling the office if you know you will be late picking up your child. Instruct your child to wait inside the building and a staff member will escort them from the building to your car. During peak times the parking lot is crowded. Please take into consideration that our students may include young children. We ask that you drive slowly and carefully through our parking lot and pulling up to our driveway. Do not take a chance on having your child run to and from your car.

Cherry Valley Investments, Inc. dba Gigueres Acknowledgment and Assumption of Risk:

I request for any of my children to participate in gymnastics, day care or nursery school, dance, trampolining, kung fu or any other activity at Gigueres and to receive instruction in such subjects from Gigueres' staff and associates. I understand that such participation and instruction require the performance of physical exercises by my child which necessarily involves the risk of personal injury, including severe paralysis or even death to my child. Neither my child nor myself are under compulsion by Gigueres, its officers, teachers, employees and associates to participate in this program nor am I being paid to do so. My child's interest is solely in the activities at Gigueres and his/her self-improvement and I willingly accept the risk inherent in this pursuit. In consideration for allowing my child to use these facilities, I hereby forever release Gigueres, its officers, employees, teachers and associates from all liability for any and all damages and injuries suffered by my child in connection with said use of these facilities. This acknowledgment of risk and waiver, having been read thoroughly and understood completely is signed voluntarily as to its content and intent.

 

I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.

I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I understand that a 15 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
