FIREARMS SAFETY AGREEMENT

WHILE ATTENDING TRAINING INSTRUCTED BY GREYBEARD ACTUAL LLC, I UNDERSTAND AND WILL ABIDE BY THE FOLLOWING RULES OF FIREARMS SAFETY.

I will know the condition of my weapon at all times, and always handle all weapons as if they are loaded.

I will only point a firearm at something I am willing to destroy.

I will keep my trigger finger straight and alongside the frame of the weapon unless the weapon is aligned with a target and I have made the conscious decision to fire.

I will be aware of my target, its backstop, its foreground, and its surroundings.

At all times pistols will remains holstered and rifles will remain slung facing vertically  down and under positive control unless given direction from an instructor.

I am in good health and have a fitness level sufficient for strenuous physical activity. I understand that tactics courses will be very physically taxing, and shooting courses will incorporate vigorous athletic movement as well.

I understand that all courses require safe weapons handling at an unconsciously competent level of skill. This includes drawing from a holster, reholstering, reloads, and weapons safety during dynamic movement and under physical and mental stress.

Flagrant or negligent unsafe actions will result in removal from a class without refund.

HOLD HARMLESS AGREEMENT

THIS HOLD HARMLESS AGREEMENT (the "Agreement") is made as of by and between,  GreyBeard Actual, LLC and any an all agents or employees of same providing training, and by the undersigned individual receiving said training from GreyBeard Actual, LLC. (hereinafter referred to as “Student”)

WHEREAS, the student desires and wishes to hold harmless and indemnify GreyBeard Actual, LLC, and any an all agents or employees of same providing training and assigns from any and all liabilities, losses, claims, judgments, suits, fines, penalties, demands or expenses, including, but not limited to, all reasonable costs for defense and investigation thereof (including but not limited to attorney's fees, court costs and expert fees) claimed by anyone by reason of injury or damage to persons or property sustained in or around as a proximate result of the acts or omissions of GreyBeard Actual, LLC, and any an all agents or employees of same providing training.

REPRESENTATION ON AUTHORITY OF PARTIES/SIGNATORIES

Each party signing this Agreement represents and warrants that s/he is duly authorized and has legal capacity to execute and deliver this Agreement. Each party represents and warrants to the other that the execution and delivery of the Agreement and the performance of such party's obligations hereunder have been duly authorized and that the Agreement is a valid and legal agreement binding on such party and enforceable in accordance with its terms.

MODIFICATION OF AGREEMENT

This Agreement may be supplemented, amended, and/or modified only by and through the mutual agreement of all parties. No supplement or modification of this Agreement shall be binding unless done so in writing and signed by all parties to this Agreement.

GENERAL WAIVER

The failure of any party at any time to require performance of any provision or to resort to any remedy provided under this Agreement shall in no way affect the right of that party to require performance or to resort to a remedy at any time thereafter, nor shall the waiver by any party of a breach be deemed to be a waiver of any subsequent breach. A waiver shall not be effective unless it is in writing and signed by the party against whom the waiver is being enforced.

SPECIFIC WAIVER

The student understands that the training provided by GreyBeard Actual is inherently dangerous, and presents the risk of accidental property damage, injury, or death. The student agrees to hold harmless from liability GreyBeard Actual, LLC, and any an all agents or employees of same providing said training.

ENTIRE AGREEMENT

This is the entire agreement between the aforementioned parties. It replaces and supersedes any and all oral agreements between the parties, as well as any prior writings.

THE UNDERSIGNED HAVE READ, UNDERSTAND and ACCEPT THIS AGREEMENT, and by signing this Agreement, all parties agree to all of the aforementioned terms, conditions and policies.
