This agreement is between the above Parent/Guardian of Child, and Paige Clough (the “Event Operator”). In consideration of the Event Operator granting the child the license described below to participate in the Event, the Event Operator and the Parent/Guardian of the child agree:

  1. The Event Operator hereby grant the Child a license to enter the Premises at the Child’s and the Child’s Parent/Guardian’s own risk and use various areas of the Premises, miniature horses, other horses, and equipment for the purpose of participation in the Event.
  2. The Child’s Parent/Guardian hereby agrees to defend , protect, indemnify, and save the Event Operator, as well as their respective agents and family members (the, “Indemnified Parties”), harmless from and against all liability, claims, costs, expenses including attorney fees, demands fines, suits, and causes of action of every kind and character ( the ”Claims”),including but not limited to Claims on account of personal injuries or death or damage to property, arising in favor of any person, or corporation or other entity, including the parties hereto, in anywise Incident to or in connection with or arising out of the Child’s participation in the Event and the presence of the Child on the Premises. This indemnity shall apply not with standing the fact that any Claim arises in part from the concurrent or contributory negligence of any of the Indemnified Parties. Child’s Parent/Guardian undertakes the defense with counsel acceptable to the Indemnified Parties any and all Claims.
  3. Parent/Guardian acknowledges that UNDER TEXAS LAW (Chapter 87, Civil Practice and Remedies Code), AN EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISK OF EQUINE ACTIVITIES.
  4. I hereby give permission to allow my son / daughter photo to be taken and used for Paloma Trails Facebook page or flyers.
