January 19, 2021 In lawful consideration of being permitted to voluntarily enter Heartland Gun Club & Range and all associated property of Heartland Gun Club & Range and use its facilities and/or equipment located at 5105 Commercial Drive Southwest, Rochester, MN 55902, for the purposes of shooting, target practice, training, observation, work, or recreation in any way or for any purpose; myself, and my guests, relatives or personal representatives hereby abide by, and agree to the following: I UNDERSTAND AND ACKNOWLEDGE THAT SHOOTING RELATED ACTIVITIES ARE INHERENTLY HAZARDOUS AND POTENTIALLY LIFE-THREATENING. These activities involve known, unknown, and unanticipated risks that could result in damage or destruction of my property, physical or emotional injury, but are not limited to: being shot or shooting myself or others; total or partial loss of hearing and eyesight; burns; inhalation or other harmful contact with lead or other contaminants; and being struck by flying or falling objects. I am fully aware of the risks and hazards inherent in participating in any activities or events held at the RANGE.
I HEREBY ELECT TO VOLUNTARILY ENTER THE RANGE and engage in any/all activities therein, acknowledging the nature and present conditions and dangers of the RANGE facilities, equipment, and premises and further, I acknowledge that conditions and dangers may become more hazardous during the times in which I am on/in the RANGE or walking to and from thereof. I HEREBY ASSUME ALL RISKS OF LOSS, DAMAGE, INJURY OR DEATH that may be sustained while in or on the RANGE, including walking to or from vehicles, or on the premises in general, and I understand that such hazards and risks cannot be eliminated without compromising the essential qualities of the RANGE, it’s facilities, equipment, premises, or environment.
I ACKNOWLEDGE THAT HEARTLAND GUN CLUB & RANGE MAKES NO WARRANTY as to the design, manufacture, maintenance, condition, or fitness for any particular use or purpose of ANY RANGE facilities or equipment, including but not limited to: range equipment, firearms, ammunition, vision and hearing protection, or first-aid supplies.
I AGREE TO ABIDE BY ALL THE RULES AND REGULATIONS, fire and safety requirement, and the directions of all employees, agents, officers of Heartland Gun Club & Range and any/all emergency personnel. I acknowledge that I may be removed from the RANGE for failure to follow these Rules, Regulations, requirements or directives.
I EXPRESSLY AGREE TO HOLD HARMLESS HEARTLAND GUN CLUB & RANGE, its owners, officers, management, employees, and representatives and to undertake to defend and to INDEMNITY Heartland Gun Club & Range from ANY and ALL LIABILITIES, LOSS or DAMAGE OF PROPERTY, CLAIM OF INJURY, demands, expenses, counsel fees and costs of whatsoever nature or kind BY ME OR MY RELATIVES, HEIRS, GUESTS, OR AGENTS, arising from the USE OF, EVENTS, or ACTIVITIES on/in the RANGE; however caused, but not limited to the negligence of the staff, failure to act, negligent rescue or first aid operations, or otherwise. This Agreement shall extend to, and bind my next of kin, heirs, guardians, relatives, representatives, and assigns.
THIS AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY LAW. Both parties agree that if any paragraph or provision violates the law, is held to be invalid, void or unenforceable, the rest of this Agreement, Range Rules and Regulations and Consent Form (when applicable) will remain valid and interpreted and applied to give maximum effect to the intent reflected herein.
I understand and agree that Heartland Gun Club & Range shall not be liable for any negligence whatsoever, including the negligence of its employees, and I hereby, on behalf of myself, my family, invitees, licensees, employees, and permittees; release, discharge and acquit Heartland Gun Club & Range for any and all claims for loss, damage or injury of any nature whatsoever to person or property resulting in any way from, or in any fashion arising from, connected with or resulting from occupancy of or use of the RANGE and property, whether caused by the negligent acts of Heartland Gun Club & Range, its agents or servants or otherwise, and I hereby further assume full responsibility for, and risk of bodily injury or death, while in or upon the RANGE. I further waive for myself and my insurers, any and all rights of subrogation that I may have against Heartland Gun Club & Range. I have read this Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement and I FULLY UNDERSTAND AND ACKNOWLEDGE the terms contained within. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS AGREEMENT, and I have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me in consideration of my signing this Agreement which I sign of my own free will. I further intend my to be a complete and unconditional release of all liability for Heartland Gun Club & Range and it’s owners, officers, management, employees and representatives, to the greatest extent allowed by law.

There are no pregnant women allowed in the range due to lead exposure No children until 10 will be permitted in the range. All minors under the age of 17 and all handgun shooters under 20 MUST be accompanied by a parent or guardian AT ALL TIMES. No more than 3 persons to one lane No smoking, vaping, or tobacco use in the range No food or drinks in the range due to lead exposure Consumption of alcohol or drugs prior to, or while at the range is STRICTLY PROHIBITED Appropriate clothing and closed-toed shoes must be worn at all times to minimize hot brass against the skin FIREARMS & AMMUNITION You must listen to any direction the Range Safety Officers give you or Range Staff. Uncase your firearms inside the lane, do not walk your firearms around the bay. Guns will be kept unloaded with the action open pointing down range while not in use. No drawing from a holster; no holster drills. No kneeling or prone shooting allowed. Unload your firearm before handing it to someone. Do not change firing lanes. Do not shoot at other lanes targets. Paper and cardboard targets are allowed. They must be placed on the Meggitt carriers. Ensure targets are full-sized so you are not hitting the carrier or the track. If your firearm malfunctions and you cannot clear it, place the firearm pointed downrange and ask a Range Staff or Range Safety Officer for assistance Anything under 3,300 FPS is permitted No steel or aluminum No buckshot only Slugs No tracers or incendiary rounds No black powder or BBs January 19, 2021 |
