RELEASE FROM LIABILITY

This release executed on March 26, 2023 by (participant name) hereinafter referred to as “Releasor”, being of lawful age, in consideration of being permitted to use the facilities, and/or participate in the Matches, Competitions, Events and informal target shooting at the On Guard Defense Training Center at New Plymouth, Ohio, or at any other place where such matches, competitions, or events may be conducted, do for myself, my spouse, legal representatives, heirs and assigns, hereby release, waive, and forever discharge the On Guard Defense Training Center, its officers, agents, service members and employees in their official and personal capacities, their heirs, administrators and executors, from any and all liability for any and every claim, demand, action or right of action of whatever kind or nature, either in law or equity, arising from or by reason of death, or any bodily or personal injuries known or unknown, or property damage resulting to or resulting from any incident which may occur during my participation in informal target shootings, matches, competitions, events, or any activities in connection with On Guard Defense Training Center or on the premises thereof whether caused in whole or in part by the Releases or otherwise.

I hereby assume full responsibility for the risk of bodily injury, death or property damage arising out of any recreational activity in which I may engage at the On Guard Defense Training Center Range or Grounds at New Plymouth, Ohio, or at any other place where such matches, competitions, events or activities may be conducted by On Guard Defense Training Center. Likewise, I assume full responsibility for the risk of bodily injury, death or property damage arising out of my participation in On Guard Defense Training Center events, either at the Range and Grounds in New Plymouth, Ohio or elsewhere, and whether I shall be participating as a competitor, official, worker, spectator or in any other manner.   

Releasor assumes full responsibility for and risk of bodily injury, death or property damage due to negligence of releases or otherwise while in or on the premises of the On Guard Defense Training Center, New Plymouth, Ohio, and or while competing, officiating, and working or for any purpose participating in any activities whatsoever on the On Guard Defense Training Center premises.

I agree that this release constitutes the entire agreement between myself and the On Guard Defense Training Center and the terms of this release are contractual and not mere recital, and the same shall continue in force and be applicable to all activities, Matches, Competitions, or Events I attend which are conducted by the On Guard Defense Training Center unless revoked by me in writing served upon the On Guard Defense Training Center by certified mail at least ten (10) days prior to the date upon which such revocation shall become effective.

I agree that the Release Agreement is intended to be as broad and inclusive as permitted by law and that if any portion hereof is held invalid, the balance hereof will, not withstanding, continue in full legal force and effectiveness. Releasor further releases all On Guard Defense Training Center officials from any claim whatsoever on account of first aid treatment or service rendered during a participation in activities on the premises.

Any person filing suit against the On Guard Defense Training Center, regardless of the reason or outcome of said suit, will immediately and forever be expelled from club grounds and events. This person will also immediately forfeit their membership and the right to any future membership of this organization.

I hereby grant to On Guard Defense Training Center the right and permission to copyright and/or use, reuse, publish and/or republish photographic images or pictures of me taken during any and all times that I am on the club’s grounds and to be used exclusively for advertising and/or promotional purposes for the On Guard Defense Training Center. I hereby release the On Guard Defense Training Center any liability resulting from use of the above-mentioned photography or use of my name. I understand that I will have no control over the manner of use of materials produced and hereby waive any right to pre- approve or inspect materials prior to distribution.

I have carefully read this release and understand all of its terms. I execute the same voluntarily and with full knowledge of its significance.
