  • Participation in shooting activities carries the risk of serious injury, disability, or death.

Archery-Related Risks

  • Risks may include injury from handling bows, arrows, or other archery equipment, as well as accidental releases or improper use of equipment.
  • Participation in archery activities involves potential harm from equipment malfunction or actions of other participants.

I understand that Howell's Gun Shop has taken reasonable measures to provide a safe environment but cannot eliminate all risks associated with firearms and archery activities. I voluntarily assume full responsibility for these risks, whether caused by negligence or otherwise.

I hereby release, discharge, and agree to hold harmless Howell's Gun Shop, its officers, employees, agents, contractors, affiliates, and representatives from any and all claims, liabilities, demands, or causes of action arising from:

  • Personal injury, including death, or property damage sustained by me or caused by me while on the premises or participating in firearms or archery activities.
  • Negligence, whether active or passive, by Howell's Gun Shop or its representatives.

I agree to indemnify, defend, and hold Howell's Gun Shop harmless from any claims, lawsuits, or damages brought by third parties resulting from my actions, negligence, or failure to comply with range and archery rules and regulations.

  • I am 21 years old or older in order to use a handgun or NFA rental.
  • I acknowledge that I am responsible for the proper use and care of any rental equipment provided by Howell's Gun Shop, including firearms, ammunition, bows, arrows, and other accessories.
  • I agree to pay for any damages resulting from my misuse or negligence while using rental equipment.
  • I understand that I am solely responsible for ensuring that I am qualified and capable of safely handling firearms or archery equipment provided for my use.

  • I understand that participation in firearms or archery classes, workshops, or events hosted by Howell's Gun Shop may involve additional physical or educational challenges.
  • I certify that I am physically and mentally fit to participate in such activities and will notify Howell's Gun Shop staff of any relevant limitations or concerns.

6. Security Recording Acknowledgment

  • I acknowledge and agree that Howell's Gun Shop premises are under 24-hour video and audio surveillance for the safety and security of all participants, staff, and property.
  • I understand that this footage is collected solely for security and operational purposes and will not be used for public release, publishing, or promotional activities without my explicit written consent, except as required by law enforcement or legal proceedings.
  • I further acknowledge that Howell's Gun Shop takes reasonable measures to ensure the secure handling and storage of all recorded footage.

7. Acknowledgment of Range and Archery Rules

I certify that:

  • I have read and understand all range and archery rules and will comply with the instructions provided by range officers, archery staff, and other Howell's Gun Shop personnel.
  • I will follow all safety protocols, including the use of personal protective equipment where required.
  • I am not under the influence of alcohol, drugs, or any other substance that could impair my ability to safely participate in firearms or archery activities.
  • I am legally permitted to own, handle, or use firearms and archery equipment under federal and state law.


SAFETY RULES

  2. NEVER PUT YOUR FINGER ON THE TRIGGER UNLESS YOUR SIGHTS ARE ON A DESIGNATED TARGET

RANGE RULES

  1. All participants must check in at the front desk before proceeding into the range. 
  2. All firearms must be holstered or cased while going to or from the range. NEVER handle un-cased or un-holstered firearms unless you are standing on the green paint in your designated shooting stall.
  3. Always keep firearms pointed down range towards the bullet trap. NEVER turn around in the shooting stall while holding a firearm. Never point the firearm toward yourself, another person, the ceiling, or shooting stall walls. 
  4. Never for any reason leave your shooting stall with an un-cased or un-holstered firearm. 
  5. All minors must be accompanied by a parent or legal guardian at all times while on the Howell’s Gun Shop property. 
  6. Keep your finger off the trigger and outside the trigger guard until ready to shoot.
  7. Be sure of your target. Do not shoot at targets out of your designated shooting lane.
  8. Never cross the RED firing line for any reason. Do not attempt to retrieve anything that falls in front of the firing line. If you lose a piece of equipment, ask the Range Safety Officer (RSO) for assistance.
  9.  If you observe any unsafe behavior or condition by anyone, report it to the RSO immediately.
  10. Always keep the action open and firearm unloaded until ready to fire. Consider every firearm as “loaded” and treat it as such.
  11. Eye and ear protection must be put on before entering the range and worn at all times while inside the range.
  12. Upon the command “CEASE FIRE”, stop all shooting immediately, put down your firearm and back away from the shooting stall until you are standing behind the green line. Do NOT re-approach the firing line or pick up your firearm until the “all clear” signal is given.
  13. If you experience a firearm or ammunition problem, keep the gun pointed down range, do not set the gun down, remain in your shooting stall and signal a RSO for assistance by raising your non-shooting hand.
  14. Use only the correct ammunition for your firearm. All ammunition must be new or factory re-manufactured and in its original packaging. Howell’s Gun Shop DOES NOT permit steel core, steel shot, tracer or armor piercing ammunition. Howell’s Gun Shop does not permit muzzle-loaders or black powder.
  15. If you bring more than one firearm, we recommend that you un-case only one at a time. This will reduce the chance of loading the wrong ammunition and keep the bench clear of obstruction.
  16. Know and understand the operating mechanism and safety features of your firearm. If you do not, please ask for additional assistance when you check in to the range.
  17. Never use alcohol or drugs before or while shooting.
  18. No food, drink, gum or tobacco is permitted inside the range. 
  19. Wash your hands each time you leave the range and before smoking, eating or drinking.
  20. Shooters who desire to draw and shoot from the holster must be approved to do so in advance by an authorized member of Howell’s Gun Shops’ staff. Such activities may only be permitted at certain times and on designated lanes. Please ask for details at the front desk.
  21. Please notify the RSO if you would like to shoot your carry firearm on the range before you un-holster and the RSO will provide additional instruction. Do not draw and shoot from the holster unless approved to do so.
  22. Rapid fire in bursts is permitted if muzzle discipline is maintained and all shots are on target. You may be asked to terminate rapid fire at the discretion of the RSO. 
  23. Shooters may collect their brass behind the firing line once they have unloaded and cased their firearm and are ready to leave the range. Inform the RSO at the beginning of your session that you would like to keep your brass.
  24. Please act responsibly at all times. Foul language, horseplay, or any other unsafe activity will not be tolerated. If we observe an unsafe act we will help you understand what you did and work with you to learn the correct safety procedures. If you repeat or commit another unsafe act, you will be asked to leave the range. If you appear to be impaired (such as under the influence of alcohol or drugs, including prescription medication), a manager will be contacted and you will be asked to leave the range. The safety of our members and guests is our first priority. Please respect your fellow shooters, our staff and the facility so that we can continue to provide you with the best shooting experience possible.

8. Governing Law and Jurisdiction

This agreement shall be governed by and construed under the laws of the State of Maine. Any disputes shall be resolved in the courts of Maine.

9. Severability

If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

10. Acknowledgment and Understanding

I acknowledge that I have read this Waiver of Liability, Assumption of Risk, Indemnity Agreement, and Additional Terms. I fully understand its terms and agree to be bound by them. I understand that by signing this document, I am waiving significant legal rights, including the right to sue Howell's Gun Shop for any injuries or damages.
