Governing Law and Jurisdiction

No waiver by Howell’s of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Howell’s to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

The Terms of Use, as well as all other incorporated documents, constitute the sole and entire agreement between you and Howell’s with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary. 

In consideration of the privilege of being present at and shooting firearms on the Howell’s Gun Shop designated shooting ranges, I hereby release and discharge Howell’s Gun Shop, its affiliated companies, and its directors, shareholders, officers, employees, agents and other representatives (collectively, the “Released Parties”) from all liability and any other obligation that may result from any property damage or bodily injury, including death, that I may suffer as a result of my presence at, or activities on, the Howell’s Firing Range. I intend the foregoing release to be complete and comprehensive waiver of liability for any damage or injury that I may suffer while present in the Howells facility, whether caused any of the Released Parties or by bystanders or other participants in activities at the Howell’s Firing Range. The foregoing release (a) applies to any property loss or damage or bodily injury that results from my presence in Howell’s facility, the use of a rental firearm or safety equipment that I rent or borrow from Howell’s; and (b) does not apply to property damage or injuries sustained by me as a result of the gross negligence or intentional misconduct of any of the Released Parties. 

I Agree

Participant is at least 18 years of age, mentally competent and medically able that I am legally permitted to possess and use firearms. To the extent Participant is a minor, the parent or guardian listed below gives Participant permission to participate in a Howell's event under the conditions stated within and signs on behalf of Participant. The individual signing below gives this General Release freely and knowingly with full understanding of its content and effect.  

I Agree

Participant is legally permitted to possess and use firearms and other related equipment (“Firearms”), whether as part of a Howell's event or otherwise, and is capable of using Firearms safely. I acknowledge that I have been trained in the safe use of each firearm that I will use in the Howell’s Firing Range. Participant is responsible for determining the requirements of all applicable laws as they may relate to ownership, possession and use of firearms, and remaining in compliance with such requirements. Participant will follow the policies, procedures and rules of Howell's , including the policies, procedures and rules of the venue where Howell's event takes place. Howell's reserves the right to revoke Participant’s right to participate in a Howell's event at any time for any reason.  

I Agree

Participant has made a fully informed decision to participate at Howell's, understanding that inherent in the nature of such events and the use of Firearms is the potential of serious property damage and physical injury, up to and including death. Participant understands that the use of Firearms may involve risks (unforeseen or otherwise) and that Participant is responsible for her or his own safety and behavior, including but not limited to the use of appropriate personal protective equipment and refraining from the use of substances that may alter Participant’s mental state. Participant is under no obligation to attend or participate in any Howell's event, and is permitted to decline participation or attendance or continued participation or attendance in a Howell's event at any time for any reason.  Participant accepts and acknowledge that Howell’s employees have the final say in all safety matters and that based on my personal conduct, demeanor or violation of range safety rules that I may be subjected to suspension of shooting privileges or expulsion from the facility.  Participant acknowledges that any firearm and all ammunition that I have in my possession or under my control while present in any Howell’s facility, including the Firing Range and the retail area, are subject to inspection at any time. 

I Agree

Participant understands the hazards of infectious diseases, and accepts full responsibility for self-compliance with the most recent CDC guidelines. Notwithstanding the risks associated with infectious disease, which are readily acknowledged, Participant hereby willingly chooses to participate in Howell’s activities, acknowledging and fully assuming the risk of illness or death arising from participating in the activities, arising from or out of, or relating to, directly or indirectly, the infection of any other illness or injury.  

I Agree

Participant waives, releases, and forever discharges any rights, claims, demands, or objections which Participant has or which afterwards may accrue to Participant against Howell's Gun Shop; its affiliates, sponsors, partners, or licensees; or any of its officers, directors, employees, facilitators, volunteers, agents, representatives, assigns or successors (past or present) (the “Howell’s Parties”), including for any physical injury, death or property damage, in connection with Participant’s participation in a Howell's event, regardless of the cause of such rights, claims, demands, or objections. Participant understands that this General Release is intended to discharge, release and waive any and all claims, damages, and liabilities arising from her or his participation in a Howell's event, even if such claims arise by the negligence of Howell's Parties. Participant agrees to indemnify and hold harmless Howell's Parties from and against any claims, damages, and liabilities that Participant had or may have for personal injury, death, or property damage arising in any way from participation in a Howell’s event.  

I Agree

Howell's may designate personnel to capture photographs and recordings of Participant during a Howell's event (the “Media”). Participant consents to Howell's ’s unlimited use of the Media for unlimited time in all print mediums, or other media of tangible expression (including the Internet and/or forms of social media), as Howell's may elect and without payment of royalties or other compensation to Participant. Participant waives the right to inspect or approve the finished materials in which the Media may be exhibited, published or distributed. All Media is owned by Howell's, and Howell's may register any copyrights or other intellectual property rights in the Media. To the extent Participant has any copyrights or other rights in the Media, such as a right of publicity, they are assigned to Howell's. Participant waives all rights or claims in any media or material using Participant’s name, photograph, voice persona or likeness contained in the Media. Howell's is only responsible for Media captured by its designated personnel; other participants in Howell’s events are responsible for obtaining their own permissions and Participant understand that Howell's has no control over these other participants.  

I Agree

If any provision of this General Release is deemed invalid or unenforceable, it will not invalidate the remaining provisions of this General Release. Howell's ’s failure to exercise any of its rights under this General Release does not prevent it from exercising such rights at a later date. This General Release contains the full and complete understanding of Howell's and Participant with regard to its subject matter and supersedes all prior agreements and understandings, cannot be modified except in writing signed by both Participant and an authorized representative of Howell's , and is governed in accordance with the laws of Maine, without regard to its conflict or choice of law provisions.  

I Agree

This General Release will continue in effect even after termination of Participant’s participation in a Howell’s event. An electronic or facsimile signature will have the same force and effect as an original, non-facsimile signature.

This agreement shall be interpreted and enforced under the laws of the State of Maine, and that the venue for any action or proceeding shall be the State of Maine, without regard for the conflict of law rules of the State of Maine In any action requiring Howell’s Gun Shop to enforce or interpret the terms of this agreement, Howell’s Gun Shop will be entitled to reasonable attorney’s fees, cost, and to any other relieve to which Howell’s Gun Shop may be entitled. If any provision or portion of this agreement is held to be Invalid, void or otherwise unenforceable, the remaining provisions or portion shall continue to remain in full legal force and effect. This Agreement, and any signed written amendments or modifications to It, shall remain in full force and effect from the date of execution and ever after and shall be applicable to each and every occasion that I or my Guests transit to or from the Range enter on to the Range, use Range facilities or equipment or engage in or observe shooting and other activities at the Range.

SAFETY RULES

  • TREAT ALL FIREARMS AS IF THEY ARE LOADED
  • NEVER PUT YOUR FINGER ON THE TRIGGER UNLESS YOUR SIGHTS ARE ON A DESIGNATED TARGET
  • NEVER POINT A FIREARM AT ANYTHING OTHER THAN A VALID TARGET DOWN RANGE
  • ALL FIREARMS MUST BE POINTED DOWN RANGE AT ALL TIMES
  • ALWAYS KNOW YOUR TARGET AND WHAT IS BEYOND IT

RANGE RULES

  • All firearms must be holstered or cased while going to or from the range. NEVER handle un-cased or un-holstered firearms behind the firing line.
  • Always keep firearms pointed down range and in a safe direction. NEVER turn around in the booth while holding a firearm. Never point (muzzle) the firearm toward yourself, another person, the ceiling, range or shooting booth walls. Never for ANY REASON leave your booth with an un-cased or un-holstered firearm!
  • Keep your finger off the trigger until ready to shoot.
  • Never cross the RED firing line for any reason. Do not attempt to retrieve anything that falls in front of the firing line. If you lose a piece of equipment, ask the RSO for assistance.
  • If you observe any unsafe behavior or condition by anyone, report it to a Range Safety Officer immediately.
  • Always keep the action open and firearm unloaded until ready to fire. Consider every firearm as “loaded” and treat it as such.
  • Eye and ear protection MUST be put on before entering the range and worn at all times while inside.
  • Upon the command “CEASE FIRE”, stop all shooting immediately, unload firearm, lock slide to the rear, put down your firearm on the bench and back away from the firing line. Do NOT re-approach the firing line or pick up your firearm until the “All Clear” signal is given.
  • For any firearm or ammunition problem, (such as a squib or hang fire) keep the gun pointed down range, do not set the gun down, remain in your booth, signal a Range Safety Officer for assistance by raising your non-shooting hand.
  • Use only the correct ammunition for your firearm. Howell’s does not permit STEEL CORE, STEEL SHOT, TRACER or ARMOR PIERCING ammunition. Howell’s does not permit MUZZLE-LOADERS or BLACK POWDER.
  • If you brought more than one firearm, we recommend that you use only one at a time. This will reduce the chance of loading the wrong ammunition.
  • Know and understand the operating mechanism and safety features of your firearm.
  • Never use alcohol or drugs before or while shooting.
  • No food, drink, gum or tobacco is permitted inside the range. Wash your hands each time you leave the range and before smoking, eating or drinking.
  • Shooters who desire to shoot handguns from the holster must be “HOLSTER QUALIFIED”. Shooters who desire to shoot long guns from positions other than off-hand or bench-rest must be qualified through a Howell’s Instructor.
  • Shooters may collect their brass behind the firing line once they have unloaded and cased their firearm and are ready to leave the range. Inform the RSO at the beginning of your session that you would like to keep your brass.
  • Act responsibly at all times. Foul language, horseplay or any other unsafe activity will not be tolerated. If we observe an unsafe act we will help you understand what you did and work with you to learn the correct safety procedures. If you repeat or commit another unsafe act, you may be asked to leave the range and meet with the Chief RSO. If you appear to be impaired (such as under the influence of alcohol or drugs, including prescription medication), you will be evaluated by the RSO; you may be asked to leave the range. The safety of everyone is a primary goal of Howell’s. We want you to enjoy shooting and will work with anyone who wants the same.

  By signing below and in exchange for the opportunity to participate at Howell’s Gun Shop, the undersigned (“Participant”) indicates that she or he has carefully read and understand Howell’s Range Rules and acknowledges and agrees to all items, on behalf of Participant and her or his heirs, guardians, representatives, successors and assigns. 

I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTAND IT, AND I AGREE TO BE BOUND BY ITS TERMS.
