WAIVER AND RELEASE OF LIABILITY EXPRESS ASSUMPTION OF RISK

In consideration of my participation in the event sponsored by Loud Performance (the “Event”) and or Bicycle Rental, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, do hereby acknowledge, accept, and consent to the following Waiver and Release of Liability Express Assumption of Risk.

  1. BICYCLING ACTIVITIES INVOLVE RISKS AND DANGER OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH. These risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Event, the condition of which the Event takes place, or the negligence of others, including the “Releases” named below.
  2. I WILL AT ALL TIMES DURING MY PARTICIPATION IN THE EVENT TAKE RESPONSIBILITY FOR MY PERSONAL SAFETY, including but not limited to wearing an ANSI or SNELL approved helmet. I acknowledge and represent that I am qualified, in good health, and in proper physical condition to participate in the Event. I further agree and warrant that if, at any time, I believe conditions to be unsafe, I will immediately discontinue further participation in the Event.
  3. I UNDERSTAND THAT PERSONAL SAFETY MEASURES, INCLUDING WEARING PROPER SAFETY GEAR, DOES NOT ELIMINATE THE RISKS AND DANGER OF BICYCLING ACTIVITIES, and that there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time.
  4. I FULLY AND EXPRESSLY ACCEPT AND ASSUME ALL RISKS AND ALL RESPONSIBILITY FOR INJURIES, LOSSES, COSTS AND DAMAGES I may incur as a result of my participation in the Event, including but not limited to severe, permanent injury and/or death.
  5. I HEREBY WAIVE, RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Loud Performance Products, LLC, or its subsidiaries, administrators, directors, agents, officers, members, volunteers and employees, and/or other participants, sponsors, advertisers, and/or where applicable, owners and lessors of premises on which the Event takes place (individually and collectively, the “Releasees”) from all liability, claims, demands, losses, or damage to person or property, caused or alleged in whole or in part by any act or omission of the Releasees in connection with the Event or otherwise, including rescue operations. I further agree that if, despite this release, I or anyone on my behalf makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSE, ATTORNEY’S FEES, LOSS LIABILITY, DAMAGE OR COSTS ANY MAY INCUR OF THE RESULT OF SUCH CLAIM.

I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY EXPRESS ASSUMPTION OF RISK AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT BY SIGNING THIS RELEASE I HAVE GIVEN UP SUBSTANTIAL RIGHTS. BY MY SIGNATURE, I FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE, GRANT COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW, AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

If participant is under 18 years of age, a parent or guardian must execute, in addition to the foregoing Waiver and Release Express Assumption of Risk, the following on behalf of the minor. The undersigned parent and natural/legal guardian of the Minor, executes the foregoing Waiver and Release Express Assumption of Risk for and on behalf of the minor named herein. I represent that I have legal capacity and authority to act for and on behalf of the minor named herein, and I agree to indemnify and hold harmless the persons or entities named in the Waiver and Release Express Assumption of Risk for any claims or liabilities assessed against them a s a result of any insufficiency of my legal capacity or authority to act for and on behalf of the minor in the execution of the Wavier and Release Express Assumption of Risk. I have read the foregoing and fully understand its terms. I fully consent to my child’s participation in said Event. I hereby bind myself, the minor and all other assigns to the terms of the Waiver and Release Express Assumption of Risk.
