RELEASE, WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

This Release, Waiver of Liability and Hold Harmless Agreement (“Agreement”), is made as of this day of June 1, 2025 between SKYROCK FARMS, LLC and its members, officers, directors, agents, employees, volunteers, and any other person or entity acting on its behalf (hereinafter referred to collectively as “Skyrock”) and the person(s) executing this document, including any minor Participants’ parents or legal guardians, (hereinafter referred to as “Participant”).

Skyrock is a Minnesota limited liability company that provides horse riding lessons, day camps, recreational horse riding, clinics, shows, competitions, (“Equine Services”).  As part of its services, Skyrock may provide horses, tack, and access to its facilities and premises or the facilities and premises of others.

In consideration for participating or being a volunteer or spectator of Skyrock’s Equine Services and/ or being in the proximity of its livestock, or on its premises, Participant hereby releases, waives, and forever discharges Skyrock of all actions, claims or demands of whatever kind arising from negligence of Skyrock, Participant, or others, resulting in bodily injury, death, or property damage which relate in any way to Skyrock’s Equine Services, facilities or activities.

In accordance with Minnesota law, nothing in this Agreement should be constructed as releasing, discharging, or waiving claims Participant may have for intentional, willful or wanton acts resulting in injury, property damage, or death.

Participant further agrees if any claim for Participant’s personal injury or wrongful death is commenced against Skyrock, he/she shall defend, indemnify and save harmless Skyrock from any and all claims, demands, or causes of action by whomever or wherever made or presented for Participant’s personal injuries, property damage, or wrongful death, including attorneys’ fees, and costs arising from any such action.

BY SIGNING THIS DOCUMENT, PARTCIPANT ACKNOWLEDGES THAT THERE ARE INHERENT RISKS IN USING AND BEING AROUND HORSES. THOSE RISKS INCLUDE SERIOUS BODILY INJURY AND DEATH. PARTICPANT UNDERSTANDS THAT HORSES ARE UNPREDICTABLE AND CAPABLE OF SUDDEN, UNEXPECTED, AND POTENTIALLY DANGEROUS MOVEMENTS DESPITE THEIR PRIOR HISTORY. PARTICPANT FURTHER UNDERSTANDS THAT HORSES ARE EASILY FRIGHTENED BY SOUND, SUDDEN MOVEMENT, AND UNFAMILIAR OBJECTS, SMELLS, PERSONS, OR OTHER ANIMALS. THEY MAY RUN, BITE, BUCK, OR KICK OR RESPOND TO SOUND. HORSES MAY ALSO ENCOUNTER NATURAL HAZARDS, SUCH AS SURFACE OR SUBSURFACE CONDITIONS AND MAY REACT UNPREDICTABLY. THEY MAY EVEN COLLIDE WITH OTHER OBJECTS, PERSONS, OR ANIMALS. PARTICIPANT ACKNOWLEDGES AND VOLUNTARILY ASSUMES THESE RISKS AND ANY OTHER RISKS ASSOCIATED WITH SKYROCK’S EQUINE SERVICES, FACILITIES AND PREMISES.

Knowing these risks, I request permission to participate in Skyrock’s Equine Services. I wish to participate in these activities knowing they are dangerous. I accept and assume all the risks of injury (including death) to me or my property. I further agree that I have a choice to avoid the risks identified in this Agreement and any other risk associated with Skyrock’s Equine Services and that I could choose another provider of similar activities.

This release is given on behalf of Participant and Participant’s spouse, legal representatives, administrators, executors, heirs, and assigns, and in the case of any child or children of Participant’s, on behalf of them and their legal representatives, administrators, executors, heirs, and assigns. This release is an ongoing release that does not expire and remains in effect until Participant has revoked it in a writing provided to Organization.

I further agree that Skyrock may use and publish photographs, videos, or other images of my likeness, or my minor children and horses, taken at Skyrock’s property in any media for advertisement purposes.  If I have any concerns about images of me, my children or my horses used by Skyrock, I agree to contact Stacy Nunn at Skyrock Farms to discuss my concerns over the use of any images prior to initiating any litigation.  I agree that I may not commence litigation if Skyrock voluntarily removes from publication any images of me, my children or my horses within 20 days of a request in writing sent by certified mail, return receipt requested.

PARTICIPANT ACKNOWLEDGES THAT HE/SHE HAS CAREFULLY READ THIS RELEASE AND HAD AN OPPORTUNITY TO CONSULT LEGAL COUNSEL PRIOR TO VOLUNTARILY ASSUMING ALL RISKS ASSOCIATED WITH SKYROCK’S EQUINE SERVICES.
