Release of Liability

The following Release is a release of liability waiver. Please read through each section carefully and ensure that you have fully read and understood each section before initialing. If you have questions pertaining to any section of this waiver please visit the front desk and ask a staff member for assistance. 

I, the undersigned individual, hereby acknowledge and agree, that I desire to participate in the activities and services provided by and use the facilities of all Hangar 18 Indoor Climbing Gyms (specifically HANGAR 18 UPLAND, INC; HANGAR 18 RIVERSIDE, INC; HANGAR 18 SOUTH BAY, INC; HANGAR 18 LONG BEACH, INC; HANGAR 18 MISSION VIEJO, INC; HANGAR 18 RANCHO CUCAMONGA, INC; HANGAR 18 SAN CLEMENTE, INC; HANGAR 18 EAST RIVERSIDE, INC; HANGAR 18 HIGH DESERT, INC; HANGAR 18 ARCADIA, INC; and any other Hangar 18 locations that may be added in the future) a California Corporation (hereafter referred to as "Hangar 18"), its climbing walls, fitness facilities, and any other training facilities or apparatus, all of which carry with them significant inherent risks. I hereby agree to release and discharge Hangar 18 on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows:

I. ASSUMPTION OF RISK

I hereby acknowledge that I have been given full information of the nature and extent of all the risks associated participation in and the use of Hangar 18 facilities, and the services they provide, and have had the opportunity to ask any questions I wished, and have had any questions  answered by the employees of Hangar 18, including but not limited to:                                                                                                                                                                                               

1. Injury resulting from falling from the climbing wall and hitting all or some structures, including but not limited to, the climbing wall, projections whether permanently or temporarily in place, or the floor.

2. Rope abrasion, entanglement and other injuries resulting from activities on or near the climbing walls such as, but not limited to, climbing, belaying, lowering on rope, and any other rope techniques.

3. Injuries resulting from falling climbers or dropped items, such as, but not limited to, ropes, climbing hardware and dropped or broken holds.

4. Cuts, abrasions, contagions, viral, or bacterial infections, burns, or any other injury or malady resulting from skin contact with the climbing wall, pads, rental equipment, or any other surface or object in the gym.

5. Failure or misuse of ropes, slings, bolts, chains, climbing hardware, anchor points, or any part of the climbing wall structure.

6. Injury resulting from failure to follow Hangar 18 employee instruction or failure to ask Hangar 18 employees for further information or assistance.

I acknowledge that this list is not inclusive of all possible risk associated with the use of Hangar 18 and that both climbing and non-climbing activities at this location and all other Hangar 18 locations, entails significant risk, both known and unknown, which could result in physical injury, emotional injury, paralysis, death, damage to myself, my property, and damage to third parties and third party property. I understand that no amount of caution, expertise, training, and instruction can fully eliminate the inherent risk associated with participating in the activities and services provided by Hangar 18.

I confirm that I am physically and mentally capable of participating in the use of Hangar 18 facilities and all activities associated with the use of Hangar 18 facilities. I understand that if my physical or mental condition changes after the execution of this Release in such a manner that I am no longer capable of participating in the activities or use of equipment, that I am obligated to immediately cease in my participation of these activities. In order to avoid any illness, serious injury, or death, I acknowledge that Hangar 18 has advised that I consult a physician prior to beginning an exercise program or engaging in any strenuous physical activity including but not limited to indoor climbing, yoga, or any other activities offered by Hangar 18. 

I acknowledge that there are certain risks associated with the use of Hangar 18 facilities other than those directly related to climbing and its activities, including, but not limited to, the use of exercise equipment, participation in yoga classes, and participation in other individual or group classes provided by Hangar 18. 

I understand that climbing at Hangar 18 facilities on artificial climbing surfaces is not the same as outdoor rock climbing or as climbing on artificial climbing surfaces provided by other companies or corporations. I acknowledge that the instruction I receive from Hangar 18 employees may not be applicable to outdoor climbing or to climbing in other other facilities not owned or operated by Hangar 18. I acknowledge that the instruction I receive at Hangar 18 does not prepare me to climb without supervision either at another Hangar 18 facility, at a facility not owned or operated by Hangar 18, or outdoors.

I acknowledge that the holds used on artificial climbing surfaces are NOT A SAFETY FEATURE, they are a convenience and that they can and do spin while attached to the wall, break, come off the climbing surface, and fall to the ground, or onto projections from time to time.  

I acknowledge that climbing gear can and does become damaged or defective over time. I am aware that while Hangar 18 does complete periodic safety checks of the climbing equipment they provide as rental gear, this does not guarantee that the equipment has not become damaged or defective since the time of the last safety check. I acknowledge that I AM  CAPABLE OF EXAMINING THE EQUIPMENT PROVIDED BY HANGAR 18 FOR MY USE. I acknowledge that if I see anything about the equipment that causes concern I will immediately take the equipment to a Hangar 18 employee for further inspection and evaluation. If any equipment belonging to Hangar 18 is damaged while I am using it I will immediately request replacement equipment and will bring the damage to the attention of Hangar 18 employees so it can be properly dealt with. I acknowledge that while Hangar 18 does clean the equipment provided as rental equipment on a regular basis according to manufacturer instructions, this does not mean that there is not risk of illness or infection with the use of this equipment. I agree to assume all risk of illness, injury, and/or death that may occur as a result of my use of Hangar 18 rental equipment. 

I am aware of the safety policy recommending that all participants in activities provided by Hangar 18 wear a safety helmet and I acknowledge that a helmet will be provided to me free of charge should I make the request. I acknowledge that while wearing a helmet can reduce the risks associated with climbing it does not eliminate the risk of serious injury or death. I acknowledge that Hangar 18 recommends that I wear a helmet while participating in climbing activities, and while walking in close proximity to climbing surfaces, and that if I choose not to wear a helmet I am doing so against their advice. I AGREE TO ASSUME ALL RISK OF PHYSICAL INJURY AND/OR DEATH THAT MAY OCCUR AS A RESULT OF MY NOT WEARING A HELMET.

II. RELEASE OF LIABILITY 

I acknowledge that the above paragraphs in no way limits the extent of each waiver and covenant not to sue, and despite these inherent risks I willingly and voluntarily choose to use Hangar 18’s climbing facilities and equipment, and agree as follows:

I acknowledge and voluntarily assume the risks of illness, physical and/or emotional injury, and death associated with these activities, inherent or otherwise, and whether or not they are described above. I hereby voluntarily waive and release, forever discharge, and agree to indemnify and hold harmless Hangar 18 from any and all claims, causes of action, or demands, which are in any way connected with my participation in these activities or my use of Hangar 18's equipment or facilities, including any such claims which I, my children, parent, heirs, assigns, personal representative and estate have or may have in the future, that allege ordinary negligent acts or omissions against Hangar 18, including their owners, operators, employees, agents, representatives, successors and assigns, as well as the designers, manufacturers or installers of any climbing surfaces or equipment. Should Hangar 18 or anyone acting on its behalf be required to incur any attorney fees or costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.  I UNDERSTAND THAT THIS RELEASE INCLUDES ALL CLAIMS AGAINST HANGAR 18 ARISING FROM ANY ORDINARY NEGLIGENCE, BUT DOES NOT INCLUDE ANY CLAIMS ARISING FROM ALLEGED GROSS NEGLIGENCE ON THE PART OF HANGAR 18.

III. AGREEMENT TO HANGAR 18 POLICIES

I acknowledge and agree that Hangar 18 management, employees, owners, or operators, reserve the right to deny access to its facilities to any individual either permanently or for a set period of time resulting from any breach of Hangar 18 policies, rules, regulations, or for any conduct that is deemed unsafe or inappropriate by any Hangar 18 employee, manager, owner, or operator. I acknowledge that a full list of Hangar 18 rules and regulations is available both on the Hangar 18 website and is visible in all Hangar 18 facilities. I acknowledge that if I have any questions regarding any Hangar 18 rule or policy I can have that question immediately answered by Hangar 18 employees. 

I acknowledge and agree that I am solely responsible for my personal property while it is on any property owned or maintained by Hangar 18. Hangar 18 and its employees, management, owners and operators assume no responsibility for any lost or stolen property while on any property owned or maintained by Hangar 18. I acknowledge and agree that it is my responsibility to ensure the safety and security of my property while at any Hangar 18 facility, and that while Hangar 18 may provide lockers, cubbies, or other places to store my property this in no way is an assumption of liability on the part of Hangar 18 for my property. I acknowledge and agree that if I feel I have been the victim of a theft while at a Hangar 18 facility I will immediately report the alleged theft to Hangar 18 employees. 

I acknowledge that Hangar 18 facilities contain both photograph and video equipment and I consent to the use of such equipment. Hangar 18 reserves the right to use any participants likeness or image as well as any video or photographs recorded by Hangar 18. I hereby grant Hangar 18 and any affiliated entities the right to use my likeness or image and any and all video recorded by the equipment within the facility for any purpose Hangar 18 may deem necessary.  

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in any activity provided by Hangar 18. If I do not have adequate insurance to bear the costs of such injury or damage I agree to cover the costs myself. I further certify that I have no known preexisting medical or physical condition which could interfere with my safety, or the safety of other participants, while participating in these activities and I am willing to assume responsibility for and bear the costs of any additional risks that may be created, directly or indirectly, by any such condition.

IV. PARTICIPANT OR PARENT/GAURDIAN SIGNATURE

I certify that I am at least 18 years of age and am otherwise legally competent to sign this agreement. This Release and all sections contained within shall be legally binding upon myself, my children, my parents, my heirs, assigns, personal representative and estate. I certify that I have been provided sufficient time to read this document in its entirety, and I have had the opportunity to ask any questions pertaining to this document to Hangar 18 employees. By signing this agreement I acknowledge that I may be found by a court of law to have waived my rights to recover compensation or obtain any other remedy for any injury to my property or myself, or for my death, now or at any time in the future, whether caused by negligence on the part of Hangar 18 or of it's owners, operators, employees, agents, representatives, successors and assigns. I acknowledge and agree that if any portion of this Release is to be held invalid, void, or unenforceable, the remaining portions shall nonetheless remain in full force and effect.

I HAVE CAREFULLY READ AND UNDERSTOOD THIS DOCUMENT, AND I AGREE TO BE BOUND BY ITS TERMS.
