The Tamarack Global Agreement (“Agreement”) is entered into by and between Tamarack Resort Two, LLC, a Florida limited liability company, and its parents, subsidiaries, affiliates, vendors, lessees, contractors and agents, including, but not limited to, Tamarack Resort Holdings, LLC, Tamarack Mountain Operations, LLC, Tamarack Real Estate Holdings, LLC, Tamarack Food and Beverage, LLC, TRH-Village, LLC, Tamarack Property Management, LLC, Tamarack Sales, LLC, Tamarack Real Estate, LLC. Tamarack Trademarks, LLC, Tamarack Development, LLC. Tamarack Realty, LLC. MMG Tamarack LLC. IAI Golf, LLC. Tamarack Operations Corp. MMG Tamarack II LLC. MMG Tamarack III LLC. Imperium Blue Tamarack Partners LLC, Imperium MMG Tamarack LLC, The Club at Tamarack LLC. And Tamarack Municipal Association, CTH Idaho LLC. as well as their respective officers, shareholders, members, managers, directors and employees (collectively referred to herein as “Tamarack”) and any person located on any Tamarack property or using any Tamarack facility including but not limited to the ski area, chairlift, restaurant, marina, golf course, retail or lodging facility. 


The person participating in any winter and/or summer activity provided by Tamarack, the person using any Tamarack chairlift and/or facilities, and/or the person who is a licensee/invitee on land owned by Tamarack and/or land leased to Tamarack by the State of Idaho (“Tamarack area”) for a summer and/or winter activity, shall be referred to hereinafter as “Participant.” Participating in skiing, snowboarding, cross-country skiing, snow-shoeing, ice skating, zipline, jogging, hiking, walking, skateboarding, inline skating, mountain climbing, mountain biking, riding a chairlift, kayaking, fishing, swimming, archery, axe throwing, pickleball, rafting, water sports/activities, the climbing wall, birdwatching, canoeing, stand up paddle-boarding, zorb ball, kayaking, any and all waterfront activities, yoga, horseback riding, sleigh rides, parades or any other recreational, competitive or outdoors activity shall be referred to as the “Activity.” The “Undersigned” means only the Participant when the Participant is age 18 or older OR it means both the Participant and the Participant’s parent or legal guardian when the Participant is under the age of 18. Undersigned hereby acknowledges that he/she has received valid consideration in exchange for agreeing to the terms set forth in this Agreement. 


The Undersigned agrees and understands that the Activity can be hazardous and involve the RISK OF PHYSICAL INJURY OR DEATH, and such risk is inherent and cannot be reasonably avoided without changing the nature of the Activity. The Undersigned further acknowledges that he/she has read this Agreement, and EXPRESSLY ASSUMES ALL RISKS of the Activity, inherent or otherwise. 


In consideration of allowing the Participant to use the Tamarack area, the Undersigned agrees to RELEASE Tamarack from any and all liability and/or claims for injury or death to persons or damage to property arising from the Participant’s participation in the Activity, including those claims based on Tamarack’s alleged or actual NEGLIGENCE. Further, the Undersigned agrees to WAIVE his/her and Participant’s right to file a lawsuit against Tamarack for any existing or future claims. 


 


The Undersigned agrees to DEFEND and INDEMNIFY Tamarack from all claims for property damage, injury or death arising out of Participant’s use of the Tamarack area and/or participating in the Activity, which (1) he/she may suffer or for which (2) he/she may be liable to others or for (3) Participant’s conduct that may contribute to a claim being asserted against Tamarack. 


Furthermore, It is recognized that skiing as a recreational sport is hazardous to skiers, regardless of all feasible safety measures that can be taken. 

 Each skier expressly assumes the risk of and legal responsibility for any injury to person or property that results from participation in the sport of skiing including any injury caused by the following, all whether above or below snow surface: variations in terrain; any movement of snow including, but not limited to, slides, sloughs or avalanches; any depths of snow, including tree wells, or any accumulations of snow, whether natural or man made, including snowmaking mounds; freestyle terrain; surface or subsurface snow or ice conditions; bare spots, rocks, trees, other forms of forest growth or debris, lift towers and components thereof; utility poles, and snowmaking and snowgrooming equipment which is plainly visible or plainly marked in accordance with the provisions of section 6-1103, Idaho Code.

Therefore, each skier shall have the sole individual responsibility for knowing the range of his own ability to negotiate any slope or trail, and it shall be the duty of each skier to ski within the limits of the skier’s own ability, to maintain reasonable control of speed and course at all times while skiing, to heed all posted warnings, to ski only on a skiing area designated by the ski area operator and to refrain from acting in a manner which may cause or contribute to the injury of anyone. The responsibility for collisions by any skier while actually skiing, with any person, shall be solely that of the individual or individuals involved in such collision and not that of the ski area operator. 

 No person shall place any object in the skiing area or on the uphill track of any aerial passenger tramway that may cause a passenger or skier to fall; cross the track of any T-bar lift, J-bar lift, platter lift or similar device, a fiber rope or wire rope tow and a conveyor, except at a designated location; or depart when involved in a skiing accident, from the scene of the accident without leaving personal identification, including name and address, before notifying the proper authorities or obtaining assistance when that person knows that any other person involved in the accident is in need of medical or other assistance. 

No skier shall fail to wear retention straps or other devices to help prevent runaway equipment. 

I Agree

The Undersigned agrees to grant to the Resort and their advertising and promotion agencies, acting on their behalf, the right to use and publish worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including without limitation online and in social media, without approval or compensation, my and the Releasors’ images and/or performances captured at any Resort location. 

The Undersigned understands that Tamarack may furnish first aid care, including but not limited to: transportation for Participant to a facility where defined medical care can be provided at no expense to Tamarack. The Undersigned understands that the furnishing of medical care is in no way an admission or an assumption of liability on the part of Tamarack, its officers, agents or employees. 

In consideration for allowing Participant to participate in the Activity, the Undersigned agrees that any and all claims for injury and/or death arising from the Participant’s participation in the Activity shall be GOVERNED BY IDAHO LAW and EXCLUSIVE JURISDICTION of any claim shall be in the STATE DISTRICT COURT residing in the county where the alleged incident occurred or in the FEDERAL COURT FOR THE STATE OF IDAHO. 

I AND/OR MY MINOR(S) ACKNOWLEDGE THAT WE HAVE READ, UNDERSTAND AND WILL ABIDE BY ALL TAMARACK’S POLICIES/RULES GOVERNING THE USE OF THE TAMARACK SKI AREA AND/OR PARTICIPATING IN THE ACTIVITY. A PARENT OR GUARDIAN OF A MINOR CHILD MUST SIGN. IF A PARENT OR GUARDIAN IS SIGNING ON BEHALF OF A MINOR, THE PARENT OR GUARDIAN AGREES TO DEFEND/INDEMNIFY TAMARACK IN THE EVENT THE AUTHORITY TO BIND THE MINOR IS CHALLENGED. 

I acknowledge that all tickets and passes are non-refundable and non-transferrable and that doing so is considered theft of services and may be punishable by law.
