Release of Liability, Assumption of Risk Agreement, and Waiver

Release of Liability and Assumption of Risk Agreement: I acknowledge that it is my duty to exercise ordinary care for the protection of others and myself while attending classes at Hot Asana Yoga Studio LLC. I assume the risk of physical activity with my own physical condition. I have received advice from my doctor that I am capable of physical exercise such as provided by Hot Asana Yoga Studio LLC, or I will seek such advice prior to participating, or I will assume the risk of exercising without a doctors examination.

I take complete responsibility for my presence at Hot Asana Yoga Studio LLC and I will not hold Hot Asana Yoga Studio LLC, its owners or instructors responsible for any injuries or loss I may incur as a result of my participation in any yoga classes or other activities associated with Hot Asana Yoga Studio LLC. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured. I am in proper physical condition to participate in heated yoga classes, and am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death and I am knowingly assuming that risk.

I hereby confirm that I have read and fully understand this Release of Liability and Assumption of Risk agreement, fully understand its terms, and sign it freely and voluntarily without inducement. This form continues to be effective as long as I attend classes at Hot Asana Yoga Studio LLC.

Photo/Video Permission of Use Waiver: In consideration of the opportunity to provide certain statements and participate in photography or audio/video recording relating to certain products or services of Hot Asana Yoga Studio, I agree as follows:

1. I hereby consent to the recording of statements, photographs, and/or audio or video recordings taken of me by Hot Asana Yoga Studio, its contractors or agents.
2. All statements, photographs, and/or audio or video recordings taken of me, by Hot Asana Yoga Studio, its contractors or agents, may be used by Hot Asana Yoga Studio for promotional, commercial or other purposes in its sole discretion anywhere in the world at any time and on any form of delivery. I shall not have any right to control the use or publication by  Hot Asana Yoga Studio of the statements, photographs, and/or audio or video recordings.
3. All statements, photographs, and/or audio or video recordings taken of me by Hot Asana Yoga Studio, its contractors or agents, shall be the sole property of Hot Asana Yoga Studio. I shall not receive any compensation in connection with use of these statements, photographs, and/or audio or video recordings for promotional, commercial or other purposes.
4. I hereby release, waive and discharge any claims of any kind or nature arising out of or relating to the use of the statements, photographs, and/or audio or video recordings against Hot Asana Yoga Studio or any person or firm authorized by Hot Asana Yoga Studio to publish said materials. Such release, waiver and discharge shall also extend to all affiliated companies, shareholders, directors, officers, employees, agents and assigns of Hot Asana Yoga Studio.
5. This Release shall be binding upon me and my successors, heirs, assigns, executors, administrators, spouse and next of kin.
6. I HAVE READ THIS DOCUMENT AND I UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS (INCLUDING RIGHTS RELATING TO PUBLICITY AND PRIVACY WITH RESPECT TO THE COMMERCIAL USE OF ANY STATEMENTS, PHOTOGRAPHS, AND/OR AUDIO OR VIDEO RECORDINGS) I SIGN THIS RELEASE FREELY AND VOLUNTARILY.
