1. PARTIESThis Part-Time Horse Lease Agreement (“Agreement”) is made and entered into between Southern Belle Riding (“Lessor”) and (“Lessee”). 2. HORSELessor leases to Lessee, and Lessee leases from Lessor, for the term, rental amount, and upon all conditions set forth herein, the part-time use of Lessor’s horse described in this agreement. 3. TERM3.1 TermThe “Term” of this Lease shall commence on the first (1st) day of the following calendar month and shall continue on a month-to-month basis thereafter. Either Lessor or Lessee may terminate the Lease at any time by providing a minimum of five (5) days’ written notice. 3.2 Obligations and Rights Upon TerminationUpon termination or cancellation of this Lease, Lessee shall have no further rights in or to the Horse. 4. RENT4.1 RentLessee shall pay to Lessor the total sum of $300 per month in advance, on or before the first day of each month.
The first lesson of each month is included in this rental amount. Rent may be adjusted at Lessor’s discretion with fifteen (15) days' written notice to Lessee. Rent shall be payable without notice or demand and without deduction, offset, or abatement. 4.2 Late FeesIf rent is not paid by the seventh (7th) day after its due date, a late fee of $5 shall apply. An additional $5 per day will accrue thereafter until paid in full. 5. USE5.1 Days of UseLessee may use the Horse three (3) days per week on the assigned days and times during the Term. If the Horse is scheduled for a show, event, or appointment on a lease day, that day will be forfeited. A replacement day may be offered at Lessor’s discretion, if possible. 5.2 Type of UseLessee agrees that the Horse shall be used only for purposes approved by Lessor. 5.3 Duration of UseHorse shall be ridden or exercised for no more than one (1) hour per lease day unless prior approval is received from Lessor. 5.4 Authorized UsersOnly the Lessee is authorized to ride or work with the Horse unless otherwise agreed in writing. 5.5 EquipmentLessee may use Lessor’s tack and equipment if available at the time of riding. Lessee must yield equipment if needed for another horse.
Lessee may use their own tack and equipment with prior approval from Lessor, subject to safety and suitability. Lessee agrees to maintain all tack and equipment in good condition and replace any damaged due to negligence. 5.6 TrainersDuring the Term, Lessee may only ride under instruction from Ammie Lords or any employee of Southern Belle Riding. 5.7 Compliance with LawLessee shall comply with all applicable statutes, ordinances, rules, and regulations regarding the care, use, and boarding of the Horse. 6. CARE AND MAINTENANCE6.1 Lessee's ObligationsIf Lessee has exclusive possession of the Horse, they shall provide proper care, including feed, water, veterinary care, hoof care, grooming, exercise, and insurance. 6.2 Lessor’s ObligationsIf the Horse remains in the Lessor’s possession, the Lessor will continue to provide all care. 6.3 Lessor's RightsIf Lessee fails to meet care obligations, Lessor may reclaim possession of the Horse immediately or cover costs as additional rent. 7. LESSEE’S REPRESENTATIONS AND WARRANTIESLessee represents that: - They are not a minor or incompetent.
- They will not encumber or lien the Horse.
- They have sufficient ability and skill to care for and ride the Horse safely.
- Facilities where Horse is kept will be safe, clean, and appropriate.
- They will not sell, transfer, or relocate the Horse without Lessor’s written consent.
8. LESSOR’S REPRESENTATIONS AND WARRANTIESLessor represents that: - Lessor owns the Horse.
- Lessor is authorized to lease the Horse.
- The Horse is fit for the intended use.
9. ASSIGNMENT AND SUBLETTINGLessee may not assign, sublet, or transfer this Lease or their interest without prior written consent of Lessor. 10. INSURANCE10.1. Property and Liability Insurance
In the event that Lessee is in the exclusive possession of the Horse during the Term of this Lease, then Lessee shall maintain, at its sole cost and expense, insurance against loss or injury to the Horse with a stated worth of $5,000. Lessee shall also maintain comprehensive general liability insurance, providing a combined single limit of liability of not less than $100,000 per occurrence. Lessee shall furnish Certificates of Insurance evidencing the coverage specified above. The Certificates shall list Lessor as an additional insured and shall provide at least ten (10) days’ written notice to Lessor of any cancellation or material change. Failure to maintain required insurance shall constitute a material breach of this Lease. 11. INDEMNITY; ASSUMPTION OF RISK11.1 IndemnityLessee shall indemnify and hold Lessor harmless against all claims arising from Lessee’s use of the Horse. 11.2 Assumption of RiskLessee understands that horseback riding is inherently dangerous and assumes all risk of injury, death, or property damage, releasing Lessor from any liability even if due to negligence. 12. DEFAULTS; REMEDIESDefault occurs if Lessee fails to pay rent or breaches any term. Lessor may terminate this Lease, repossess the Horse, and pursue legal damages, including attorney’s fees. 13. SURRENDER OF POSSESSIONUpon termination, Lessee shall return the Horse in good condition. Abandoned equipment becomes the property of Southern Belle Riding. 14. BINDING EFFECTThis Lease binds the parties, their heirs, successors, and assigns. 15. LESSOR’S ACCESSLessor may inspect the Horse at reasonable times. 16. TIME OF ESSENCETime is of the essence in this Lease. 17. NOTICESAll notices must be in writing and delivered by personal service, certified mail, or reputable courier. 18. GENERAL PROVISIONS- Severability: Invalid provisions do not affect the rest of the Lease.
- Choice of Law: Utah law governs.
- Waivers: No waiver is implied by acceptance of partial performance.
- Covenants and Conditions: All terms are binding conditions.
- Headings: Headings are for convenience only.
- Attorney’s Fees: Prevailing party entitled to fees.
- Execution: Lease is not binding until fully signed.
- Relationship of Parties: Lessor and Lessee are independent parties.
19. ENTIRE AGREEMENTThis Lease constitutes the entire agreement between the parties and may only be amended in writing. 20. COUNTERPARTSThis Lease may be executed in multiple counterparts. May 15, 2025 |
