2021 BEECH MOUNTAIN RESORT GENERAL ACTIVITY 

NOTICE OF INHERENT RISKS, ASSUMPTION OF RISK and RELEASE OF CLAIMS

As a condition of being permitted to use the facilities of Beech Mountain Resort, the PURCHASER/USER of this ticket understands that skiing, snowboarding, tubing, mountain biking, yoga, and hiking can be hazardous and accepts and assumes the inherent risks of skiing, snowboarding, tubing, mountain biking, yoga, and hiking, including but not limited to: variations in snow, ice, terrain, along with bare spots, bumps, moguls, stumps, forest growth, rocks and debris, lift towers, snowmaking and snowgrooming equipment, snowmobiles, 4-wheelers and other hazards or obstacles in existence through the area, including USER'S own conduct and the conduct of other skiers, snowboarders, tubers, mountain bikers and hikers.  Be aware that all trail and tubing run conditions change constantly due to weather changes and skier, snowboarder, tuber, mountain biker, and hiker use.  Be aware that during winter operations snowmaking and snowgrooming may be in progress at any time.  Always ski, snowboard, tube, mountain bike, and hike in control and stay clear of all equipment. In using this ticket while skiing, snowboarding, tubing, mountain biking or hiking at the area, USER recognizes that certain dangers may exist whether they are marked or unmarked. The USER realizes that falls and collisions with other users and fixed objects occur and injuries may result, and therefore assumes all the risk of injuries, and loss of or damage to property, and the burden of skiing, snowboarding, tubing, mountain biking, yoga, and hiking under control at all times.  In light of the rapid development and spread of the novel virus COVID-19 and the resulting pandemic, USER realizes that naturally occurring disease processes (including, but not limited to, COVID-19) can exist throughout the resort property.  USER has the sole responsibility to safeguard him/herself and/or his/her child and assumes the inherent risk of exposure to the COVID-19 virus.

Management is not responsible for ticket if lost and reserves the right to revoke this ticket without refund. If USER commits any act on the premises that endangers the safety of themselves or other persons, then this ticket may be revoked without refund.  This ticket is void if seal or wicket is broken and must be visible and attached to the pants, or for mountain biking, on the bike itself.  CAUTION You are in a high mountain environment and may encounter snow and ice on stairs, walkways or on roofs, trees, light poles, and lift structures. Be aware and watch your step, and look above for possible falling snow, ice or tree limbs. 

I hereby agree to RELEASE BEECH MOUNTAIN RESORT, INC., its shareholders, directors, employees, agents and assigns from all liability for injury, death or other damage which results from my participation (or the participation of my minor child) in skiing, snowboarding, tubing, mountain biking, yoga, or hiking, including all liability which results from any negligence on the part of Beech Mountain Resort, Inc. or its agents or subcontractors and including claims related to COVID-19 illness.

I agree that the exclusive jurisdiction of any claims I may bring against Beech Mountain Resort, Inc. related to this activity is in the Superior Court of Avery County, North Carolina.

ALL TICKET AND RENTAL PURCHASES ARE FINAL. THERE ARE NO REFUNDS.
