In consideration of being allowed to participate in any way in paddle sports, related events and activities, I the undersigned, acknowledge, appreciate, and agree that:

1. The risk of injury from the activities involved in this watersport program is significant, including but not limited to (1) changing water flow, tides, currents and wave action, (2) collision with other participants or watercraft and manmade or natural objects, including capsizing, (3) varying wind and temperatures, including inclement weather and lighting, (4) any limitations in my ability to swim, follow directions, maintain my balance, and operate the equipment, (5) exposure to the elements, which may result in hypothermia, sunburn, sunstroke, dehydration, fatigue, chill and/or dizziness, (6) equipment failure, (7) the presence of insects and marine life and (8) the potential for permanent paralysis and death.

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation.

3. I willingly agree to comply with terms and conditions for participation, and hereby confirm I have a current and valid American Canoe Association membership that has not expired. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Gig Harbor Canoe/Kayak Racing Team, Team Highlander Athletics, LLC, the American Canoe Association, Inc., and their officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any injury, disability or death I may suffer, or loss or damage to person or property, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

 

AMERICAN CANOE ASSOCIATION WAIVER & RELEASE OF LIABILITY

READ BEFORE SIGNING

IN CONSIDERATION of being permitted to participate in any way in the American Canoe Association, Inc. sports and recreation program and related activities (“Activities”) I, for myself, my personal representatives, assigns, heirs, and next of kin:

1. ACKNOWLEDGE, agree, and represent that I understand the nature of Paddlesports and related Activities and that I am qualified, in good health, in proper physical condition to participate in such Activity and willingly agree to comply with the stated and customary terms and conditions of participation. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity. If I decide to leave early and not complete the trip as planned, I assume all risks inherent in my decision to leave.

2. FULLY UNDERSTAND that: (a) Paddlesports and related ACTIVITIES INVOLVE RISKS AND DANGERS OF DAMAGE TO PERSONAL PROPERTY AND SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE American Canoe Association, Inc., its Paddle America Clubs, affiliated clubs and organizational affiliates, their respective ACA certified instructors, certified instructor trainers, and certified instructor trainer educators, administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, INJURIES, DAMAGE TO PROPERTY, OR OTHER DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

MINOR PARTICIPANT (if applicable): I, THE MINOR PARTICIPANT, HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

GHCKRT Waiver of Liability Relating to Coronavirus/COVID-19

READ BEFORE SIGNING

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

GIG HARBOR CANOE AND KAYAK RACING TEAM cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading COVID-19 while utilizing GIG HARBOR CANOE AND KAYAK RACING TEAM’s services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize GIG HARBOR CANOE AND KAYAK RACING TEAM’s services and/or enter onto GIG HARBOR CANOE AND KAYAK RACING TEAM’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize GIG HARBOR CANOE AND KAYAK RACING TEAM's services and enter GIG HARBOR CANOE AND KAYAK RACING TEAM’s premises. These services are of such value to me and/or to my children, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize GIG HARBOR CANOE AND KAYAK RACING TEAM's services and premises in person.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against GIG HARBOR CANOE AND KAYAK RACING TEAM and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing GIG HARBOR CANOE AND KAYAK RACING TEAM’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

CHOICE OF LAW: I understand and agree that the law of the State of Washington will apply to this contract.

Subj: GHCKRT COVID 19 POLICY (REV 2)

Background:

Whereas the goal of GHCKRT as a community nonprofit is to educate and provide opportunities for athletes to participate in paddling activities, this document outlines risk mitigation strategies for the operation of GHCKRT during times of varying restriction on activities.  These strategies follow both Centers for Disease Control and Prevention (CDC) and Washington State Department of Health regulations.

As the COVID-19 pandemic continues, as a team and nation we may be following CDC guidance for prevention of transmission through 2020 and possibly longer.  Washington State has delineated a plan for resumption of activities that is broken into a four-phase approach.  The following policy provides the steps that the team intends to take during each of these phases to support our athlete’s health and wellbeing while also offering them the opportunity to resume practicing the sport of sprint kayak and canoe.  This document will be revised based on any changes to CDC or State policy. 

General Policies:

1.     Education - All athletes, staff and volunteers are required to have reviewed the current CDC and state guidelines applicable to the sport of paddling and the Gig Harbor Canoe and Kayak Race Team.  Current documents will be maintained in the COVID-19 section of the TeamUnify website and verification of review will be documented utilizing Smartwaiver. 

a.     Athletes and parents

         i.     shall acknowledge they have reviewed the education documents about COVID-19, infection prevention, and this policy.

         ii.     will agree to the terms prior to returning for any in-person participation.

b.     Staff members and volunteers

         i.     will be trained about COVID-19, infection prevention, proper hand washing techniques and hygiene, the GHCKRT self-screening checklist, WA State current guidance, and this policy on a quarterly basis until COVID-19 restrictions are no longer required.

         ii.     will agree to the terms prior to returning for any in-person participation.

2.     Screening - Athletes, volunteers and staff shall be allowed participation if they:

a.     Currently have no symptoms including: fever, cough, sore throat, shortness of breath, fatigue, muscle aches, or new loss of taste or smell

b.     Have not had any of the above symptoms for 14 days. Have had at least 14 days since a positive COVID-19 test or any symptoms as above, whichever is longer.

c.     Have completed the self-screening checks per the GHCKRT Self Screening Checklist (Encl (a)

d.    Parents are responsible for performing athlete health screening prior to every in-person activity.

e.     The Head Coach will act as or appoint a COVID-19 Safety Supervisor who will monitor the health screens of the volunteers and staff.

3.     Sanitization - The COVID-19 Safety Supervisor will oversee the implementation of the following housekeeping schedule:

a.     All shared use team equipment is required to be sanitized prior to use by another individual. 

b.     General methods of sanitization include washing or wiping down with disinfectant. 

c.     Shared equipment includes but is not limited to team owned boats, paddles, chase boats, etc. 

d.     Athletes are not permitted to share personal items such as life jackets or articles of clothing. 

e.     Team life jackets will not be available.

f.      Sanitization and cleaning supplies will be provided by the team and available at the team trailer at Skansie park and at the marina lock box for the chase boats.

g.     In addition to the sanitation schedule, all equipment currently in use during in-person activities whether club or privately owned will be washed with soap and water weekly by the athlete, staff member, or volunteer that is currently using the items. 

h.     As often as possible, chase boat drivers will be assigned to the same vessel for the duration of the COVID-19 restrictions to reduce potential for cross-contamination.

4.     Communication - Even with the policies and procedures implemented in this policy the risk of COVID-19 infection cannot be eliminated. Upon notification of a positive COVID-19 test in an actively participating athlete, volunteer, or staff member, GHCKRT will

a.     Immediately cancel all in-person activities until appropriate cleaning is performed. 

b.     Notify the DOH for current guidance and procedures.

c.     Perform CDC recommended deep-cleaning for all surfaces the infected individual may have contacted including all high touch surfaces.

d.     Follow direct contact notification as directed by the DOH.

Phased Instructional Plan - The following Phased approach identifies the GHCKRT mitigations per State, local and CDC guidance.  The COVID-19 Safety Supervisor will maintain the COVID-19 practice plan during in-person activities.

The following Phase based instructional plans will be updated in alignment with current DOH and CDC policy. Updates will be communicated via team email and posted to the COVID Section of the TeamUnify website.

During all Phases - Water rescue of capsized paddlers will occur while maintaining 6’ distance. 

a.     Safety boat operators will don their mask.

b.     Paddlers will self-rescue onto the safety boat using the safety boat rescue ladder if needed.

c.     Paddlers will re-board their boats unassisted – or with safety boat operators assisting from >6’ away.

Phase 1 – Individual or Household Instruction (No Group Practice)

During Phase 1, individual or family (members of the same family may attend at the same time) will be offered private instruction with the following precautions:

a.     A schedule will be maintained to stagger the departure and arrival of athletes.

b.    Lessons will be 45 minutes long and practices will be staggered so that departing athletes do not go to dock until arriving athletes are already on water.

c.    A maximum of 6 private lessons with 6 coaches from separate chase boats can occur simultaneously.

d.     Parents will drop their athlete off at Skansie park at the time indicated on the schedule.

e.    Athletes will arrive ready to paddle and not need to change or pause. They will get their boat and go to the water. f. This will be maintained so that there are no more than 6 athletes in the rack area or wash station at a time.

f.     Athletes shall wear a mask while on land at Skansie park and within 5m of dock while on water.

g.    Departing athletes will wash boats (wearing masks), rack their boat and be gone within 10 minutes to avoid coming into contact with arriving athletes.

h.    Athletes will not change or stay at the park after practice.

Phase 2 – Small Group Instruction, Water training only

During phase 2, guidelines allow for group instruction of 5 individuals or less while maintaining social distancing practices.

a.    Athletes will wear masks while on land at Skansie park and within 5m of the dock.

b.    Athletes will maintain at least 6 feet apart for social distancing while on land.

c.    No training shall be conducted indoors.

d.    A schedule will be maintained to stagger the departure and arrival of athletes.

e.    Lessons will be 45 minutes long and practices will be staggered so that departing athletes do not go to dock until arriving athletes are already on water.

f.     No more than 6 group practices at any given time.

g.    Parents will drop their athlete off at Skansie park at the time indicated on the schedule.

h.    Athletes will arrive ready to paddle and not need to change or pause. They will get their boat and go to the water.

i.     Departing athletes will wash boats (wearing masks), rack their boat and be gone within 10 minutes to avoid coming into contact with arriving athletes.

Phase 3 – Large Group Water Practice, Small Group Gym

During Phase 3, guidelines allow for groups of 50 or less individuals with social distancing practices in place.  Gyms are allowed to open at 50% capacity.  Practice will recommence for Groups 1, 2, and 3.  Gym will recommence for Group 1 with staggered times.

a.    Athletes will wear masks while on land at Skansie park and within 5m of the dock.

b.    Athletes will maintain at least 6 feet apart for social distancing while on land and water.

c.    Parents will drop their athlete off at Skansie park at the time indicated on the schedule.

d.    Athletes will be ready to paddle and not need to change or pause. They will get their boat and go to the water.

e.     Athletes will not change or stay at the park after practice.

Phase 4 – Return to Normal Practice

During Phase 4, all groups will return to normal practice times and schedules while maintaining appropriate social distancing guidelines

a.     Athletes will wear masks while on land at Skansie park and within 5m of the dock. 

b.     Athletes will maintain at least 6 feet apart for social distancing while on land.

c.     Parents will drop their athlete off at Skansie park at the time indicated on the schedule. 

d.     Athletes will arrive ready to paddle and not need to change or pause.  They will get their boat and go directly to the water.

e.     Athletes will not change or stay at the park after practice. 

 GHCKRT Self Screening Checklist:

This form is to be completed by all GHCKRT athletes and staff daily and prior to instruction/work.

1. Do you currently have any of the following symptoms? (YES NO)

a.     Fever

b.     Cough

c.     Sore Throat

d.     Shortness of breath

e.     Fatigue

f.      Muscle Aches

g.     New loss of taste or smell

2.  Have you had any of the symptoms listed above in the past 14 days?  (YES NO)

3.  Have you travelled outside the State of Washington in the last 14 days?  (YES NO)

4. Have you had CLOSE PERSONAL CONTACT with anyone who has been diagnosed with COVID 19 in the past 14 days? (Per criteria below) (YES NO)

1.     Within 6’ for greater than approximately 10 minutes

2.     Had direct contact (coughed on, sneezed on)

5. Is your temperature (taken today) more than 100 Deg F. (YES NO)

6. If you answered YES to any of the above questions, contact your coach or supervisor before continuing with GHCKRT in-person lessons or practices.
