WAIVER/ INDEMNITY -VALID TO 31 DEC 2024 To: Indigo Adventures Pty Ltd as trustee for the Indigo Adventures Trust Trading as Vertigo MTB/ (“Vertigo MTB”) Vertigo Tasmania


I understand and accept that the tour I have booked with Vertigo MTB/Vertigo Tasmania will include dangerous activities and that there is a risk that I may suffer an injury, loss or damage as a result of participating in the tour/shuttle/bike hire. I hereby acknowledge and confirm that I freely assume all such risks even if arising from the negligence of Vertigo MTB/Vertigo Tasmania, its employees or agents or others and I agree that I voluntarily participate at my own risk and assume sole responsibility for injury, death or property damage I may suffer that arises from my participation in my tour/shuttle/bike hire with Vertigo MTB/Vertigo Tasmania. I agree to follow the directions of any representative, employee or agent of Vertigo MTB/Vertigo Tasmania and acknowledge that any inappropriate behaviour on my part including any refusal by me to follow any such direction can result in cancellation of my participation in the tour/shuttle/ bike hire. I agree that I am responsible for the bike I use in my tour with VertigoMTB/Vertigo Tasmania, whether it is my bike or a bike I hire. I confirm that my bike, helmet and equipment is of an acceptably safe standard for mountain bike riding. I agree that I am solely responsible for my own actions while on this tour/ shuttle/ hire bike. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin hereby release and hold harmless and agree not to sue Vertigo MTB/Vertigo Tasmania, their employees or agents and other participants on the tour/ shuttle/ hire bike with respect to any injury, disability, death, loss or damage to person or property, whether caused by the negligence of Vertigo MTB/Vertigo Tasmania or otherwise. Further I agree to indemnify and keep indemnified Vertigo MTB /Vertigo Tasmania and each of its employees and agents against any losses, costs, claims, damages, expenses, liabilities, proceedings or demands which any of them may directly or indirectly incur or suffer as a consequence of any breach by me of my obligations as a participant of the tour/shuttle/ bike hire. I understand the nature of the tour and hereby represent to Vertigo MTB/Vertigo Tasmania that I am qualified to participate in such activity, am in good health and a good state of fitness.

I confirm:
(a) I have had sufficient opportunity to read this form, fully understand its terms and acknowledge that I have given up substantial rights by signing it and confirm I have signed it freely and voluntarily without inducement of any kind; and
b) I am not relying on an oral or written representation or statement made by Vertigo MTB/Vertigo Tasmania, their employees or 
agents about the tour.


Hire Bike Terms and Conditions applicable to Customers hiring VertigoMTB Bikes and Equipment

Shuttle vehicles, bike racks and other forms of transporting our rental bikes other than VERTIGOMTB shuttle vehicles must be approved by our staff to avoid damage to our bikes. We reserve the right to refuse hire or the use of shuttle vehicles/bike racks with our rental bikes. 

I agree to the following Terms and Conditions: 

1. Bicycles returned with damage are subject to a repair fee based on the amount charged by a third party repairer. VertigoMTB reserves the right to debit the Credit Card listed with the repair fee. 

2. Bicycles not returned will be replaced at current value. VertigoMTB reserves the right to debit the Credit Card listed with replacement fee. 

3. Equipment returned broken, damaged or not returned will be charged a fee of $40 per item for replacement. VertigoMTB reserves the right to debit the Credit Card listed with replacement fee. 

4. It is the responsibility of the hirer to return all bicycles & all equipment to the designated/agreed location and time. 

5. Bicycles must be locked securely if unattended at any time. 

6. Approved AUS standard helmets must be worn at all times while riding. 

7. Spare tube and tool kits are provided with bike hire. There is no charge for use of one tube. 

8. The person hiring agrees and accepts that riding a bicycle is a hazardous activity and can result in death or serious injury. 

9. The person hiring agrees that VertigoMTB and its employees are released from and indemnified against any claim for injury, loss or damage to the hirer, or any person or property which is in any way connected to the participation in the use of the bicycle however caused. The hirer agrees to waive their right to present legal claim or lawsuit against VertigoMTB, regardless of negligence or any other manner considered through legal claim. 

10. A person under 18 years of age may hire a bicycle only with the written consent of a parent or guardian. Signing this form indicates consent. 

11. VertigoMTB reserves the right to refuse bicycle hire to any person.
