KiDWONDER RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT FOR MINORS I, the undersigned parent/person having legal custody/guardianship of the above said minor, give permission for the minor to participate in all KidWonder programs. The minor is physically able and mentally prepared to participate in all activities as described in the announcement for the program.
In consideration of said minor being permitted to enter any location of KidWonder in San Diego County for observation, use of facilities and/or equipment, or participation of the above in any program, I, on behalf of myself (as parent, guardian, coach, aide, spectator or participant) hereby: Acknowledge that (i) I have read this document, (ii) I have inspected KidWonder facilities and equipment, (iii) I accept them as being safe and reasonably suited for the purposes intended and (iv) I voluntarily sign this document.
Except for KidWonder’ gross negligence or willful misconduct I release Kidwonder, its directors, officer, employees, and volunteers (collectively “Releasees”) from all liability to me or the above said minor, for any loss or damage to property or injury or death to person, whether said damage or injury results from conditions arising up KidWonder facilities or arising out of or in connection with KidWonder programs or activities. KidWonder shall not be liable for any damages arising from any act or neglect of any other member, occupant or user of KidWonder premises or participant in KidWonder programs or activities. I agree that the above said minor assumes full responsibility for, and risk of, bodily injury, death, or property damage except caused or due to the gross negligence or willful misconduct of KidWonder.
I agree not to sue Releasees for any loss, damage, injury or death described above and except for KidWonder’ gross negligence or willful misconduct, I will indemnify, protect, defend and hold harmless KidWonder and its Releasees from and against any and all claims and/or damages, liens, judgments, penalties, attorneys’ and consultants’ fees, expenses and/or liabilities arising out of, involving, or in connection with, KidWonder membership, use of KidWonder facilities and/or participation in KidWonder programs by me, the above said minor or any other person. If any action or proceeding is brought against KidWonder by reason of any of the foregoing matters, I shall upon notice defend the same at my expense by counsel reasonably satisfactory to KidWonder and KidWonder shall cooperate with me in such defense. KidWonder need not have first paid any such claim in order to be defended or indemnified.
I do hereby authorize KidWonder as agent for the undersigned, to consent with respect to said minor, to any x- ray examination, anesthetic, medical, dental, or surgical diagnosis or treatment, and hospital care which is deemed advisable by, and is to be rendered under general or special supervision of, any physician and surgeon licensed under the provisions of the California Medical Practice Act on the medical staff of any hospital, whether such diagnosis or treatment is rendered at the office of the physician or at the hospital. I understand that KidWonder is not responsible for costs incurred for medical care. I intend this document to be as a broad and inclusive as is permitted by the laws of the State of California; if any portion hereof is held invalid, I agree the balance shall continue in full force and effect. PAYMENT POLICY We are a year-round program with a monthly tuition based on an average of four classes per month. If there are five classes in a month, we do not increase tuition. If there are three, we do not give credit. No annual contract is required. 2 months are due up front for all classes and programs. DROP PROCEDURE KidWonder has a 30 DAY (maximum) CANCELLATION POLICY. Parents must submit all drop requests online through the parent portal prior to the 1st of the month for the following month. (For example...a drop request for March must be received prior to February 1st.) Verbal, emailed, or written drop requests will not be honored. NO refunds will be granted. No exceptions. You are responsible for payment for your student's classes whether or not your student attends class and until the time you submit a drop request online through the parent portal. If a student stops coming to class without notification then that student's account will continue to be charged. KidWonder has a strict no refund policy due to our required staff to student ratio policies we cannot provide a refund or make up. November 21, 2024 TRANSPORTATION RELEASE (FOR CAMPERS & WONDERTIME) My child may be transported by this program, KidWonder and staff, to and from activities by walking or vehicle, such as (but not limited to) the playground, the beach, the library, off-site field trips, the doctor in case of emergencies, etc. I will be notified prior to each trip, by phone, letter, or email. I release KidWonder’s liability during such transportation activities. Please notify KidWonder at hello@kidwondersd.com if you do not agree to release KidWonder’s liability during such transportation activities. PHOTO RELEASE I understand that I, my children and guests may be photographed, videotaped, and otherwise recorded while at KidWonder. I agree on behalf of myself, children, and guests that KidWonder may use my, my children’s and guests’ name and likeness (in any form and without regard to likeness being altered or “photoshopped”) in photographs, videotapes, audiotapes, and other media, without any additional consideration to me, my children or guests my children or to any third party. I grant KidWonder and its agents permission to utilize name, image or likeness in any live or recorded audio, video or photographic display or other transmission or reproduction, in whole or in part. Please notify KidWonder at hello@kidwondersd.com if you do not agree for your child to be photographed, videotaped, and otherwise recorded while at KidWonder. COVID Screening Form COVID-19 SCREENING FORM (required of all families enrolling a child at KidWonder) Please carefully review the below. All Items must be agreed inclusively for us to provide service at this time, due to State and Local guidelines and KidWonder' commitment to the health and wellbeing of your child and our staff: I certify that my CHILD has NOT: Had any symptoms consistent with COVID-19, not limited to but including cough, fever, muscle pain, chills or shaking, sore throat, headache, and/or loss of taste or smell Had any contact with anyone who has exhibited such symptoms, or who you know to have been confirmed positive for COVID-19 within the last 14 days Been diagnosed with COVID-19 Gathered in a group larger than 10 people who were not social distancing consistently, and/or not wearing masks Traveled out of the country within the last 14 days I certify that to my knowledge, NO ONE in my HOUSEHOLD, or with whom my immediate family has had contact within the last 14 days: Had any symptoms consistent with COVID-19, not limited to but including cough, fever, muscle pain, chills or shaking, sore throat, headache, and/or loss of taste or smell Had any contact with anyone who has exhibited such symptoms, or who you know to have been confirmed positive for COVID-19 within the last 14 days Been diagnosed with COVID-19 Gathered in a group larger than 10 people who were not social distancing consistently, and/or not wearing masks Traveled out of the country within the last 14 days I certify that I have reviewed the KidWonder "New Protocols" documents and understand the following: KidWonder will be taking my child's temperature upon arrival at the facility and prior to entry. Should my child have a fever - i.e. a temperature of 100 degrees - I understand that my child will not be admitted to school If I suspect that my child has an elevated temperature - even if it does not hit 100 degrees - or is otherwise exhibiting one or more of the symptoms consistent with COVID-19, I will not bring them to school until those symptoms have disappeared for a full 24 hours Should my child develop symptoms or fall ill while at KidWonder, I will be phoned and expected to IMMEDIATELY pick up my child. I am expected to give KidWonder (Director) an update on my child's condition within 24 hours if they are sick and miss a day or are picked up early due to illness If my child misses a day at KidWonder due to illness, I will be required to complete this form (or an updated version) before my child is admitted back Parents will temporarily NOT be allowed in the building to mitigate the number of people both the children and KV staff are exposed to All child drop-offs and pick-ups must be within the time window designated for my child's group, unless I have made prior arrangements with the Director at the KidWonder facility my child attends. Any such arrangements must be made at least 24 hours in advance I must pack a complete, no-heat, ready-to-eat lunch (icepacks and re-usable lunch boxes are fine), including disposable cutlery, each day my child attends KidWonder. By signing and agreeing below, I hereby agreed to abide by these standards and release and agree to hold KidWonder, LLC harmless from and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses, and compensation for damages or loss to myself and/or property that may be caused by any act, or failure to act, or that may otherwise arise in any way in connection with any services received from KidWonder, LLC.
