ACKNOWLEDGEMENT OF RISKIn consideration of the services provided by TMR, LLC d/b/a Turpin Meadow Ranch ("Turpin Meadow Ranch"), including its owners, officers, directors, employees, agents, contractors, volunteers, guides, affiliates, successors, assigns, and all persons acting on its behalf, I acknowledge and agree as follows: Turpin Meadow Ranch provides professionally guided outdoor recreation, educational experiences, transportation services, and interpretive programs that allow guests to experience Wyoming's natural resources in a safe, enjoyable, and educational manner. Although Turpin Meadow Ranch utilizes trained guides, quality equipment, established operating procedures, and reasonable safety precautions, I understand that participation in outdoor recreation involves inherent risks that cannot be eliminated without fundamentally altering the nature of the activities. I understand these inherent risks may result in property damage, illness, emotional trauma, serious bodily injury, permanent disability, or death. I further understand that no amount of planning, instruction, supervision, or equipment can eliminate every hazard associated with outdoor recreation.
SCOPE OF THIS ACKNOWLEDGEMENTThis Acknowledgment of Risk applies to all guided recreational activities, transportation services, instructional programs, and outdoor experiences operated, guided, coordinated, facilitated, or sponsored by Turpin Meadow Ranch, regardless of whether those activities occur on: - National Park Service lands
- United States Forest Service lands
- Bureau of Land Management lands
- State lands
- County roads
- Private property
- Leased facilities
- Permitted operating areas
- Any other location where Turpin Meadow Ranch conducts business or provides services.
ACTIVITIES COVERED BY THIS AGREEMENTBy initialing below, I acknowledge and agree that this Acknowledgment of Risk applies to all current and future recreational, educational, guided, self-guided, transportation, and related activities offered, arranged, or facilitated by Turpin Meadow Ranch, whether conducted on National Park Service lands, U.S. Forest Service lands, state lands, county roads, private property, or any other authorized or permitted location. Covered activities include, but are not limited to, horseback riding, pack trips, guided hiking, walk-and-wade fly fishing, e-bike and fat bike tours, guided interpretive tours, wildlife viewing tours, road-based sightseeing tours, rodeo shuttle transportation, guest transportation, and any other activity, event, excursion, or service provided by or through Turpin Meadow Ranch. I understand and agree that this Acknowledgment of Risk applies to all activities in which I, and any minor child under my supervision, participate during this visit, unless Turpin Meadow Ranch requires a separate written acknowledgment or applicable law requires otherwise. GENERAL OUTDOOR RISKSI understand outdoor recreation may expose me to risks including, but not limited to: - Falls
- Collisions
- Delayed emergency medical response
- Limited or no cellular communication
- Changing weather
- Exposure to wildlife and insects
- Negligence or actions of other participants or members of the public.
This list is representative only and is not intended to include every possible hazard.
WILDLIFE RISKSActivities occur in areas inhabited by wildlife including but not limited to: - Bears
- Moose
- Bison
- Wolves
- Other wild animals.
Animals may react aggressively or defensively without warning. Wildlife encounters may result in serious injury or death.
HORSEBACK RIDING RISKSHorseback riding presents additional inherent risks including but not limited to: - Horses may buck, rear, bolt, stumble, slip, shy, bite, kick, strike, or otherwise react unpredictably.
- Horses may react to wildlife, weather, vehicles, bicycles, dogs, people, noises, or other horses.
- Falls while mounting or dismounting.
- Falls from horseback.
- Saddle or tack failure.
- Being stepped on.
GUIDED HIKING RISKSGuided hiking may include but is not limited to: - Uneven trails.
- Loose rock.
- Water crossings.
- Falling rocks.
- Steep grades.
- Physical exhaustion.
- Exposure to changing weather.
- Delayed emergency response.
FLY FISHING RISKSWalk-and-wade fishing may have inherent risks, including but not limited to: - Slippery rocks.
- River currents.
- Drowning.
- Remote river access.
- Delayed emergency response.
GUIDED VEHICLE TOUR & SHUTTLE RISKSVehicle-based activities may have inherent risks, including but not limited to: - Automobile accidents.
- Wildlife on roadways.
- Weather-related hazards.
While visiting National Parks and public lands, there may be inherent risks, including but not limited to: - Geothermal areas.
- Steam vents.
- Boardwalk hazards.
- Scenic overlooks.
E-BIKE TOUR RISKSE-bike riding may have inherent risks, including but not limited to: - Loss of control.
- High speeds.
- Shared trails with hikers, horses, wildlife, and vehicles.
- Changing trail conditions.
E-BIKING SAFETY: I acknowledge that I have been advised to wear an approved helmet while Biking. Wearing an approved helmet while Biking is required for individuals eighteen (18) years of age and under. Individuals under the age of sixteen (16) are prohibited from operating an electric bike. Therefore, I assume full responsibility for personal injury to myself and/or to members of my family, or for loss or damage to my personal property and expenses thereof as a result of my negligence or the negligence of my family participating in E-bike riding except to the extent such damage or injury may be due to the negligence of TMR, LLC. I further understand that TMR, LLC reserves the right to refuse any person it deems incapable of meeting the rigors and requirements of E-bike riding.
DAMAGE FEE: If I return Rental Equipment with damage, I authorize TMR LLC to charge my credit card a Damage Fee. I understand this fee will be calculated by the amount of damage to the Equipment. I authorize TMR LLC to charge my credit card a Damage Fee up to the full value of the E-Bike on my Rental Reservation if I return it damaged.
Statement Of Physical and Mental Fitness, and E-Bike Safety:
a. I understand that E-biking requires certain physical strength and entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, property, or third parties.
b. I am in sound physical and mental condition and am able to ride an Electric Bicycle. I can make informed, objective decisions. I currently have no known physical, medical, or mental condition that would impair my ability to ride an E-Bike, and I understand and assume all risks that may be created, directly or indirectly, by any such condition.
c. I acknowledge that I have been advised to wear an approved helmet. d. I am aware that E-biking is subject to all applicable US Forest Service regulations. e. I am familiar with the proper use of the E-Bike. f. I am aware that there are technicians available to answer any questions that I may have as to the proper use of the E-Bike.
PROHIBITED USE OF E-Bike: a. Renter will not use or permit the E-Bike to be used, operated, or ridden on any unapproved trails or roadways or through any standing or moving bodies of water, or in any location where operation would be illegal or a nuisance to others. E-Bikes are not allowed in or on any Wilderness Trails or Areas. b. Renter will not permit the E-Bike to be ridden by or used by any other person or persons while in his/hers possession.
PARTICIPANT RESPONSIBILITIESI acknowledge that I am responsible for: - Following all instructions provided by Turpin Meadow Ranch staff.
- Remaining with my assigned guide unless instructed otherwise.
- Wearing required safety equipment.
- Immediately reporting illness, injury, damaged equipment, or unsafe conditions.
- Informing Turpin Meadow Ranch of any medical condition, allergy, medication, or physical limitation that may affect my ability to safely participate.
- Acting responsibly toward guides, staff, other guests, wildlife, and natural resources.
- Exercising reasonable care for my own safety.
PHYSICAL CONDITIONI certify that I am physically capable of participating in the activities I have selected. I understand that Turpin Meadow Ranch may refuse participation to any individual who, in the judgment of its staff, cannot safely participate. I acknowledge that participation while impaired by alcohol, illegal drugs, or medications that affect judgment, balance, or reaction time may substantially increase the risk of injury. ACKNOWLEDGEMENTI acknowledge and agree that: - I have carefully read this Outdoor Recreation Acknowledgment of Risk in its entirety.
- I understand the inherent risks associated with participation in outdoor recreation and guided activities.
- The risks described in this document are representative only and are not intended to include every possible hazard.
- I understand that unknown or unforeseen hazards may exist.
- I have had the opportunity to ask questions regarding the activities and associated risks.
- My questions have been answered to my satisfaction.
- I voluntarily choose to participate despite these inherent risks.
- I understand that this Acknowledgment of Risk applies to every activity I participate in during my visit, unless Turpin Meadow Ranch requires an additional activity-specific acknowledgment.
- I certify that I am physically capable of participating in the activities I have selected.
- I understand that failure to follow instructions may increase the likelihood of injury to myself and others
WYOMING EQUINE ACTIVITY LIABILITY WARNINGNOTICE WARNING Under Wyoming law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Wyoming Statutes §§ 1-1-121 through 1-1-123. I acknowledge that I have read and understand the above statutory warning concerning equine activities.
PARTICIPANTI certify that I have carefully read this Outdoor Recreation Acknowledgment of Risk, understand its contents, and voluntarily choose to participate in the activities selected. I understand that this document applies to all applicable guided recreational activities provided, coordinated, facilitated, or sponsored by Turpin Meadow Ranch during my visit. |
