WAIVER AND RELEASE AGREEMENT FOR PARTICIPATION IN RANCH ACTIVITIES

Please read carefully before signing.

This is a release of liability and waiver of certain legal rights.


In consideration for my being permitted to enter the property owned and/or leased by Ranger Creek Ranch, Inc. (“Ranger Creek Ranch”) for the purposes of hunting, target shooting, fishing, hiking, or any other outdoor recreational activity (collectively “Ranch Activities”), I agree to the following Waiver and Release:


I acknowledge that Ranch Activities have inherent risks, hazards, and dangers for anyone that cannot be entirely eliminated, particularly in a wilderness environment.  I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION:

  1. The risk of handling firearms and being near others that have firearms in their possession;
  2. The risk of injury from ammunition and shot from other guns;
  3. The risk of poisonous snakes, insects, and other wildlife and domestic animals on the property;
  4. Dangerous land conditions caused by erosion, rugged country, bodies of water, or other natural features of the land;
  5. Inclement weather conditions;
  6. The risk of injury from vehicles such as cars, trucks, all-terrain vehicles, and boats being used on property owned by Ranger Creek Ranch;
  7. The risk of injury from the use of hunting blinds and tree stands; whether or not erected by Ranger Creek Ranch;
  8. The risk of exposure to infectious diseases or illnesses including but not limited to COVID-19;

I understand the risks, hazards, and dangers as described above and elect to participate in Ranch Activities with full knowledge and awareness of these risks.  I understand that these activities may require good physical conditioning and a degree of skill and knowledge.  I believe I have that good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely.  I understand that I am responsible for my actions as well as the actions of my dependents (including but not limited to my dog/s) while I am on property owned by Ranger Creek Ranch.  My participation in Ranch Activities is purely voluntary.  No one is forcing me to participate, and I knowingly elect to participate in spite of the risks. 

Further, in consideration of my being permitted to enter property owned by Ranger Creek Ranch for the purposes of participating in Ranch Activities, I, for myself, my heirs, successors, executors, and subrogees, hereby release, waive, discharge Ranger Creek Ranch, Ranger Creek Ranch, Inc. d/b/a The Reserve at Ranger Creek Ranch, Ranell Scott, The Gaylon Scott Family Trust, Joyce Scott, and any and all their directors, officers, agents, employees, and volunteers  (collectively the “Ranch”) from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys' fees) which are related to, arise out of, or are in any way connected with my participation in Ranch Activities including, but not limited to, NEGLIGENCE of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in Ranch Activities, or the use of these services, animals or equipment, whether such damage, loss, injury, paralysis, or death results from negligence of the Ranch or from some other cause.

I, for myself, my heirs, my successors, executors, and subrogees, further agree to release, waive, and discharge the Ranch from any and all liability, claims, demands, actions, and causes of action of any kind or nature arising out of or related to any loss, damage, or injury, including death, that I or any of my property may sustain resulting from my participation in Ranch Activities, regardless of whether such loss is caused by the negligence of the Ranch and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, and covenant not to sue the Ranch based on the same.

To the extent that my participation in Ranch Activities involves the use of firearms, I agree that I will neither carry nor discharge firearms while under the influence of alcohol or drugs.  I understand that a violation of this rule could result in ejection from the property.

I hereby grant Ranger Creek Ranch  the right to use my name, likeness (including but not limited to photo and video images), any and all photos of persons, wildlife, or facilities located in or on the Ranch property taken by me, and any comments made by me related to the Ranch or my employment with Ranger Creek for use of any advertising or promotional material that the Ranch may wish to publicly distribute from time to time.


If under eighteen years of age, parent, guardian, or custodian must sign the following indemnification

INDEMNIFICATION

In consideration for the minor named below, being permitted by Ranger Creek Ranch to enter its property to participate in Ranch Activities, I agree to the following waiver, release, and indemnification:

The undersigned parent, guardian, or custodian of the above minor, for himself/herself and on behalf of said minor, hereby joins in the foregoing Waiver and Release and hereby stipulates and agrees to save and hold harmless, indemnify, and forever defend the Ranch (as defined above) from and against any claims, actions, demands, expenses, liabilities (including reasonable attorneys' fees), and NEGLIGENCE made or brought by said minor or by anyone on behalf of said minor, as a result of said minor's participation in Ranch Activities and his or her use of the property, animals, if any, and facilities of Ranger Creek Ranch.

I, for myself and on behalf of said minor, further agree not to sue the Ranch (as defined above) as a result of any injury, paralysis or death that said minor suffers in connection with his/her participation in Ranch Activities.



BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND IT AND ALL OF THE PROVISIONS, AND I AM SIGNING VOLUNTARILY.
