ASSUMPTION OF RISK, WAIVER, and AGREEMENT OF RELEASE AND INDEMNITY PLEASE READ CAREFULLY BEFORE SIGNING. In consideration of being permitted to use the facilities of Stone Flow Partners, LLC (“Stone Flow”), at this location (10901 Plantside Dr, Louisville, KY 40299), which is known as RockSport (“Stone Flow” or “RockSport” may be used interchangeably throughout this Agreement), or any other locations where Stone Flow activities are taking place (“Facilities”), this Agreement must be signed by all participants and/or spectators. “Participant” as used in this Agreement includes participants in Stone Flow Activities (defined below), spectators, and all other persons in the area where Stone Flow Activities are taking place. If the Participant is a minor, this Agreement must be signed by his or her parent or legal (court appointed) guardian. In consideration of the services of Stone Flow, I, the undersigned, an adult Participant or parent or legal guardian of a minor Participant, acknowledge and agree as follows: 1. ACTIVITIES: This Agreement applies to facilities owned and operated by Stone Flow, on premises leased from third parties by certain Stone Flow subsidiaries, and any and all other locations where Stone Flow activities are taking place. Activities of Stone Flow (“Stone Flow Activities”) include, but are not limited to, the following: the use of roped (top-rope, auto-belay and lead climbing) climbing walls, bouldering areas, weights and other training and fitness equipment, participation in activities or events including gear demonstrations, parties, clinics, training, yoga and other fitness classes, remote outdoor climbing, camps and classes, travel to other activity sites, use of parking areas, the rental or borrowing of equipment from Stone Flow, and other activities and use of facilities and equipment at a Stone Flow gym or elsewhere. I have read and understand the above Stone Flow Activities 2. RISKS: I recognize and understand that there are risks, hazards, and dangers in Stone Flow Activities, inherent and otherwise, and that participation could result in injuries of all kinds, including, but not limited to, bodily injury, disease (including COVID-19), sprains, strains, fractures, partial and/or total paralysis, head injury, concussion, traumatic brain injury, heat stroke, heart attack, death, or other ailments that could cause serious disability or death. The risks involved in Stone Flow Activities include, but are not limited to: hazards in traveling to the location of an activity; parking and moving about parking and other areas in the vicinity of the gym or other activity site; falling; collision with objects, people, or structures; falling onto uneven, worn, or hard landing surfaces; being struck by other participants or objects, including but not limited to loose handholds or loose rock; equipment failure even if equipment is properly used; the conduct, including negligent conduct, of other participants, visitors and staff; harm due to exposure to weather, plants, or wildlife; and the aggravation of pre-existing conditions. These risks and dangers may arise from foreseeable or unforeseeable causes. These and other risks are inherent in a visit to a Stone Flow facility or other activity site – that is, they cannot be eliminated without changing the nature of the visit and participation in Stone Flow Activities. Participation in Stone Flow Activities is voluntary, and participants may withdraw from participation at any time. I understand that Stone Flow Activities, include extreme physical activities that can and will push my physical limits. I acknowledge that I or the minor participant, can participate in Stone Flow Activities and have no mental or physical condition that would cause me or the minor participant to be a danger to ourselves or others. I understand that I am responsible for assessing the quality of my, and the minor participant’s, climbing or fitness gear brought to the gym or other activity site and declare that it is in good condition for use. I understand that Stone Flow is not liable for any lost or stolen equipment or personal items brought to the Facilities or other Stone Flow Activity site. I further understand that Stone Flow does not assume any responsibility for or make any guarantees regarding personal gear; and that I alone am responsible for my gear’s condition. I further understand that if I am using Stone Flow equipment, I am to immediately notify Stone Flow employees of any potential defects I observe. I have read and understand the above risks to participating in Stone Flow Activities 3. ASSUMPTION OF RISKS: I, the undersigned, acknowledge that I understand that as a Participant there are significant elements of risk inherent in Stone Flow Activities, including those activities that take place indoors, and that these risks cannot be completely eliminated. Accordingly, I recognize that Stone Flow Activities, including indoor rock climbing, is inherently dangerous and cannot be made safe. In addition, I realize these risks also pertain to related Stone Flow Activities, including but not limited to use of roped (top-rope, auto-belay and lead climbing) climbing walls, bouldering, incidental weight training, team building, fitness training regimens, and participation in activities or events including gear demonstrations, parties, clinics, training, yoga and other fitness classes, remote outdoor climbing, camps and classes, travel to other activity sites, use of parking areas, and the rental or borrowing of equipment from Stone Flow. I realize those risks may include, but are not limited to, injuries resulting from falls, equipment failure, entanglement, falling or dropped items, or the negligence of other climbers, participants, belayers, spotters, Stone Flow’s employees, or other users of the Facilities. I acknowledge that I understand that the above list is not inclusive of all possible risks associated with rock climbing or use of the Facilities and that other unknown and unanticipated risks may result in injury, illness, paralysis, or death. I, the undersigned, understand that even if I am Participant that is only spectating, I must follow all instructions, and that I am responsible for my own safety and the safety of others. Stone Flow Activities include inherently dangerous activities that require full awareness and attention of all Participants. I, THE UNDERSIGNED, ASSUME ALL RISKS AND LIABILITY FOR ANY OF MY ACTIONS IN PARTICIPATING AND SPECTATING. I, the undersigned, acknowledge that I have carefully read the agreement and fully understanding these risks and dangers, and understanding that other risks will be encountered, I EXPRESSLY ASSUME all risks associated with Stone Flow Activities, inherent and otherwise, and whether or not described above. I HEREBY ASSUME all risks and dangers and all responsibility for any losses, injuries, and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, employees of Stone Flow, or by any other person. I, the undersigned, have read and understand I am assuming all risks in participating in Stone Flow Activities 4. I understand that in order to participate in Stone Flow Activities I, for myself or for the minor participant of whom I am a parent or legal guardian, must sign this Agreement. 5. I understand that I, or the minor who I am responsible for, must complete whatever instructional program Stone Flow requires for any particular activity before participating in it. I agree that I will not participate in any activity without understanding and assuming the risks for any activity. I understand that I am responsible for conducting any activity in the Facilities or related Stone Flow site safely. I understand that I am responsible for my own actions for my safety and the safety of others. 6. I, and/or the minor, must read and abide by the RockSport Rules and Regulations. I agree that I have been provided a copy of the Rules and Regulations of Stone Flow; I further agree that I have read and understand the Rules and Regulations of Stone Flow.
7. If I am in a party with minor children, I understand that I am responsible for their behavior. I further understand that I must supervise them for the minor’s safety and the safety of other climbers. I understand that this Agreement will contain a release where I will ultimately be responsible for the claims of any minors under my supervision. 8. In the event of an accident, I authorize Stone Flow to stabilize and obtain medical care, including transportation to a medical facility, for me or the minor participant if, in the opinion of Stone Flow, medical care is needed and I am unable to make such decisions for myself. I agree to pay all costs associated with such actions on the part of Stone Flow, and to indemnify and hold RockSport harmless from any consequences resulting from such care. 9. I understand that in the event of an injury or becoming aware of a potentially hazardous condition I am to immediately alert Stone Flow staff. 10. Stone Flow is hereby authorized to take photos and video of me or the minor in connection with participation in Stone Flow Activities and has my permission to use my, or the minor’s, name and likeness, without compensation, for marketing and other promotional purposes. 11. If Stone Flow seeks either to enforce its rights under this Agreement or seeks a declaration of any rights or obligations under this Agreement, Stone Flow shall be awarded its reasonable attorney fees, and costs and expenses incurred. 12. I understand that this Agreement shall continue in effect and remain in force in perpetuity from the date it is executed, and covers my, or the minor participant’s, participation in all RockSport Activities including use of its facilities, equipment and parking areas. 13. If any portion of this Agreement is held invalid, the remaining portions shall survive and continue in full force and effect. 14. In addition, the undersigned acknowledges that novel coronavirus (“COVID-19”) infections have been confirmed throughout the United States, including several cases in Kentucky. In accordance with the most recent guidance and protocols issues by the World Health Organization (WHO, the Centers for Disease Control and Prevention (CDC), and the Commonwealth of Kentucky for slowing the transmission of COVID-19 the undersigned hereby Agrees represents and warrants that neither the undersigned nor such participating minors shall visit or utilize the facilities, services, and programs of RockSport within 14 days after (i) returning from highly impacted areas subject to a CDC Level 3 Health Notice, (ii) exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice, or (iii) exposure to any person who has a suspected or confirmed case of COVID-19. The undersigned hereby agrees represents and warrants that neither the undersigned nor such participating minors shall visit or utilize the facilities of RockSport if he/she (i) experiences symptoms of COVID-19, including without limitation, fever, cough, shortness of breath, or (ii) has a suspected or diagnosed/confirmed case of COVID-19. The undersigned agrees to notify Stone Flow immediately if he/she believes that any of the foregoing access/use restrictions may apply. 15. RELEASE OF LIABILITY, AND AGREEMENT TO HOLD HARMLESS AND INDEMNIFY: I, the undersigned, on behalf of myself or the minor of whom I am the legal guardian, my personal representatives, my estate, and my heirs, in consideration of being permitted to use the Stone Flow Facilities, including but not limited to RockSport, and mindful of the significant risks involved with the Stone Flow Activities incidental thereto do hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify, to the full extent allowed by law, Stone Flow, including but not limited to its owners, agents, directors, members, officers, insurers, assigns, and/or employees from any and all liability, claims, actions, or losses for bodily injury, property damages, wrongful death, loss of services, or otherwise which may arise out of use of the Facilities, Stone Flow equipment, my participation in Stone Flow Activities or presence at any location where a Stone Flow activity is taking place, or any activities incidental thereto, whether foreseen or unforeseen, and whenever such personal injury, property damage, or wrongful death may occur form the date of this Agreement and Release forward. I understand I am also releasing claims for injury, damage, or loss related to COVID-19 or other diseases allegedly on or from Stone Flow property or people using it. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of Stone Flow. I agree that under no circumstances will I, on behalf of myself or the minor of whom I am the legal guardian, my heirs, my estate, or my personal representatives present any claim for personal injury, property damage, or wrongful death against Stone Flow, including but not limited to, its owners, agents, directors, members, officers, insurers, assigns, and/or employees, whether said personal injury, property damage, or wrongful death arises by the negligence of Stone Flow, including but not limited to, its owners, agents, directors, members, officers, insurers, assigns, and/or employees, or otherwise. It is the intention of the undersigned individual to exempt and relieve Stone Flow, including but not limited to, its owners, agents, directors, members, officers, insurers, assigns, and/or employees, from liability for any personal injury, property damage, or wrongful death caused by negligence, including the negligence of Stone Flow, including but not limited to, its owners, agents, directors, members, officers, insurers, assigns, and/or employees. It is the intention of the undersigned that this Agreement and Release be in effect for use of the Facilities on the date of this Release and for use of the Facilities in the future. This Release shall be legally binding upon me, my heirs, my estate, my personal representatives, as well as upon any and all other persons authorized to act for me or on my behalf or on behalf of my heirs, my estate, or my personal representatives. I also agree to indemnify and hold harmless Stone Flow, including but not limited to, its owners, agents, directors, members, officers, insurers, assigns, and/or employee, from all liabilities incident to my involvement or participation in the Stone Flow Activities at the Facilities. I understand I am releasing, and agreeing to hold harmless and indemnify, Stone Flow, including but not limited to, its owners, agents, directors, members, officers, insurers, assigns, and/or employees, for all liability related to my participation in Stone Flow Activities 16. This Agreement shall be construed in accordance with the laws of the Commonwealth of Kentucky and for any suit, mediation or other resolution of a dispute arising under this Agreement I, for myself and on behalf of the minor participant hereby submit to the exclusive jurisdiction of Jefferson County, Kentucky. I voluntarily waive any right I or the minor child may have to a jury trial in any action under this Agreement. I HAVE CAREFULLY READ, UNDERSTAND, AND VOLUNTARILY SIGN THIS ACKNOWLEDGMENT AND ASSUMPTION OF RISKS, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT. I intend for it to apply to the fullest extent allowed by law, and to be binding upon all members of my, or the minor child’s, family, and our respective, heirs, assigns, and administrators.
ROCKSPORT GYM RULES - Safety is the responsibility of every visitor and member.
- If you see something unsafe, you are expected to intervene.
- If someone is confrontational or dismissive of your concern, alert staff immediately Rocksport staff has final discretion about what activities are permitted or not permitted on each individual day.
- Climbing carries inherent and serious risks. All children must be attended to at all times as Rocksport is not a childcare facility or playground. Failure to follow these standards and rules will result in loss of access to our facilities.
I Agree General Rules and Warnings- Everyone entering the facility must have a signed “Stone Flow Release of All Claims, Waiver of Liability, Assumption of Risk, and Indemnification Agreement, Rules.
- Agreement, and General Warnings” form on file.
- Members, guests, and Participants under 18 must have the form signed by their parent or court-appointed legal guardian.
- Everyone must check in at the front counter before entering the climbing area. Members must show their membership card and a valid photo ID.
- All members and guests must participate in a Facility Orientation during their initial visit or retake it if they have not visited in the past 180 days.
- Groups of 8 or more must make a reservation prior to their visit.
- Parents must maintain a Child:Parent ratio of no more than 3:1 and be present and attentive to dependent children throughout the visit.
- Children under 14 must be supervised by an adult unless part of a special RockSport program.
- Only rock climbing equipment approved by RockSport staff may be used.
- Rock climbing instruction is only permitted by RockSport staff.
- No climbing or other activities are allowed while under the influence of intoxicating or mood-altering substances.
- No horseplay, running, swinging, spinning on ropes, or throwing rubber is allowed.
- Cellular phones, audio players, headphones, or similar devices are prohibited while belaying or climbing.
- Only appropriate climbing footwear (rock climbing shoes) is permitted on climbing surfaces.
- For hygiene and comfort, we encourage all climbers to wear shirts while in the facility, except in restrooms.
- No snacks, food, or beverages (except bottled water) are allowed in climbing areas. Snacks and beverages are permitted in concrete areas.
- No climbing shoes or harnesses are allowed in restrooms.
- No climbing above or below other climbers.
- No walking under climbers.
- The training area is for adults ages 18 and older.
- RockSport is not responsible for lost, stolen, or broken items. Do not store items in shared spaces (e.g., workout areas, climbing areas, landing mats).
- The use of vulgar language or improper conduct is prohibited.
- Groups and lessons in progress have priority on certain routes. If an instructor needs a route, participants may be asked to move.
- If unfamiliar with weight or exercise equipment, request an orientation prior to use.
- Parking restrictions exist at RockSport facilities. Overnight parking is prohibited, and vehicles may be towed at the owner’s expense.
- RockSport is committed to maintaining an environment free from discrimination, harassment, and offensive behavior, including inappropriate remarks or conduct related to race, color, creed, religion, national origin, sex, sexual orientation, marital status, or age. Verbal or physical conduct of a sexual nature is strictly prohibited.
- All members and guests must comply with the judgment, direction, and decisions of RockSport staff.
- Climbing on any artificial climbing wall may result in falls and/or injuries. By participating, you assume all risks, including serious injury or death.
- Padded landing surfaces may not prevent injuries to extremities. Serious injuries can occur on any landing surface. Climb at your own risk!
- Inherent risks include, but are not limited to:
- Failure to properly clip into an auto belay or tie into a roped belay system.
- Belayers may not properly arrest falls, and arresting falls may cause injury.
- Hair, clothing, or jewelry may come into contact with climbing structures or belay
- devices, causing injury. Restrain hair, remove jewelry, and secure loose clothing.
- Landing on items left in the landing zone. Always check your landing zone.
- Swinging or falls that may result in contact with other persons, climbing wall features, or
- structures.
- Failure of equipment supplied by you or RockSport.
- Physical demands associated with participation.
- Slips, trips, or falls on landing surfaces or curbs.
- Falling objects or falling from any height.
- Misuse of the facility or personal protection equipment.
- Lack of adequate training.
- Negligence of other climbers.
- Using or acting as a spotter may not prevent injuries to yourself or others.
- Cuts and abrasions from ropes, walls, or hardware.
- RockSport may institute new or facility-specific rules at any time. Check with staff for current rules.
Note: Any infraction of these rules may result in loss of privileges for that event. Repeated infractions may result in loss of membership privileges. I Agree Auto Belay Rules- All users must be oriented by RockSport staff on proper auto belay use before use.
- Climbers are responsible for properly clipping into the auto belay, second hand carabiner, and performing double checks. Always “DOUBLE CLIP” and “DOUBLE CHECK”!
- Stay in line with the top anchor and never climb into slack.
- Children under 12 must be supervised and connected to auto belays by an adult.
Note: Any infraction of these rules may result in loss of privileges for that event. Repeated infractions may result in loss of membership privileges. I Agree Bouldering Rules- Bouldering is only allowed over padded areas. Do not boulder under roped climbers.
- A minimum of one spotter per climber is recommended. Bouldering is dangerous, and spotters may not prevent injuries. Spotters may also be injured by a falling boulderer.
- Pull a smaller pad over seams in the modular pad system to ensure safety during falls.
- No flips, tricks, or jumping from top-out bouldering areas.
- Practice safe falling techniques; roll if needed to reduce impact. All falls are ground falls!
- Only authorized participants may boulder, after demonstrating appropriate skills to RockSport staff.
Note: Any infraction of these rules may result in loss of privileges for that event. Repeated infractions may result in loss of membership privileges. I Agree Belaying Rules- All belayers and climbers must use proper belaying technique (PBUS) and double-check their setup before each climb. The belayer checks the climber’s gear and knots, and the climber checks the belayer’s system, exchanging confirmation.
- Belay certification tags must be worn and visible on the harness at all times.
- Everyone who belays must be certified/tested by a RockSport employee. Top rope and lead certifications are separate.
- Whether an individual qualifies for “testing out” or must attend a training class is at the discretion of the RockSport instructor.
- All climbers must tie in using a figure-eight follow-through knot. Other knots are not acceptable.
- Belay devices must stay on their respective top ropes. Lead climbers supply their own belay devices.
- All belayers must use an assisted braking belay device.
- The belayer must pay attention to the climber at all times.
- A stopper knot is required on the brake side of the rope to prevent it from passing through the belay device.
- Children must be 13 or older to belay (exceptions by arrangement only).
Note: Any infraction of these rules may result in loss of privileges for that event. Repeated infractions may result in loss of membership privileges. I Agree Lead Climbing Rules- Lead climbing is a privilege. Guests must be checked out and qualified by a RockSport staff member to lead belay or lead climb.
- Lead climbers who do not follow rules will be warned, and privileges may be revoked.
- A stopper knot is required on the brake side of the rope.
- Stick clipping is mandatory on all lead routes.
- Skipping clips is not allowed and will result in revoked climbing privileges.
- No unnecessary or lengthy falls.
- No mock leading on a top rope unless supervised by a RockSport instructor in a lesson or approved by a manager.
- Following on lead routes is not allowed.
- Practice lead falls are not allowed except in lessons supervised by RockSport staff.
- All lead climbers must wear a visible RockSport lead-qualified tag on their harness.
- Children must be 16 or older to lead belay or lead climb (exceptions by arrangement only).
