RELEASE AND INDEMNITY AGREEMENT

I/We hereby indemnify and agree by signing this to release Jennifer and Jeff Goebel (Stable/Owner), Train Robber Ranch Texas, LLC and all associated persons from liability for any accident or injuries sustained by me, my employees, heirs, representatives, dependents and/or guests. It is understood that wherever the words “Stable/Owner” are used in this agreement, it includes landowners, heirs, stable owners, trainers, independent-contractors, employees and/or any other individual related to the ownership or management of the horse facilities.

As an owner, student, contestant, spectator, employee independent contractor, or parent, I/We, the undersigned, recognize that all equestrian related activities are extremely dangerous, that accidents involving horses are frequent, that the condition of the land is often hazardous and that ring, pasture, and trail footing is rarely perfect. In light of this knowledge, I/We undertake full responsibility for all harm that comes to me/ ourselves, my/our stock and my/our associates, with full knowledge, I/We release the herein above Stable/Owner from any and all responsibility for accidents and injuries.

Signing this release implies that I/we have adequate medical and liability insurance/protection and that the Stable/Owner will assume no responsibility for horse or rider. Losses occasioned by the injury or death of rider, spectator, or horse is agreed to be covered by the insurance of the undersigned and is further agreed that the undersigned, heirs, representatives, dependents and/or guests shall have no right or action against the Stable/Owner, employees, independent-contractors, landowners, Train Robber Ranch Texas LLC or any of their insurance carriers.

If the person is under 18 years of age, signature of the parent or guardian indicated acceptance of responsibility by said parent or guardian and release of liability of the Stable/Owner and affiliated persons.

If damage is caused by or to the undersigned’s horse or horses (including, but not limited to. escape from enclosures) the undersigned takes full responsibility for damages to persons, property, or other horses and agrees to indemnify Stable/Owner against liability for such damage. All damages caused by the horse/horses are the responsibilty of that owner to make the necessary repairs to the facility. The on file contractor for Train Robber Ranch Texas LLC will do the work or an mutually agreed party prior to completing the repairs. 

The undersigned further agrees to indemnify Stable/Owner against any liability for physical loss or injury, or damage causing death, or making destruction necessary to horse or horses in Stable/Owner’s care.

It is understood and agreed that the Stable/Owner assumes no responsibility for personal property of the horse owner’s and said property is stored on the premises at the sole risk of the horse owner.

Use of the tank pool is strictly at your own risk. Do not fill the pool if you or any member of your party cannot swim. No diving. Pools can be slippery so caution is recommended. TRR will not be liable for any accidents or deaths resulting from the use of the tank pool.
