Rental Agreement & Release of Liability

REQUIRED IDENTIFICATION: Proper identification (Official ID or Driver's Licence) must be presented to rent equipment.

EQUIPMENT RETURNS: No equipment will be considered returned until it is inspected. Plan accordingly and allow time for this inspection. There are no refunds for early returns.

LATE FEE: Equipment returned past due will be subject to a daily late fee.

CLEANING: Rental items must be clean when returned. A $10 per item cleaning fee will be charged for equipment that must be cleaned.

DAMAGE / LOSS: The renter is responsible for all costs of repair or replacement.

RESPONSIBILITY: It is responsibility of the Renter to know how to use the requested equipment. The renter may ask a staff member for clarification about the proper use of equipment; however, such an explanation is not a substitute for proper training from a certified instructor. It is the responsibility of the renter to check all equipment prior to use, and the renter must agree to accept the equipment “as is.”

LIABILITY: This Rental Agreement Form must be signed to rent equipment. The Renter agrees to pay for any damages or loss of equipment and also agrees not the hold Flexpeditions Inc. or its employees responsible for injuries, accidents, or other mishaps which may occur while using the equipment.

By signing this form, I certify and acknowledge that I have read the above equipment rental policies and procedures and agree to abide by these guidelines.

I hereby acknowledge that I voluntarily request to participate in the activity of canoe paddle boat rental through the services of Flexpeditions Inc, and I am aware that it is the responsibility of the Renter to return all equipment on time and in the same condition as received.

I am aware that operating a boat is a hazardous activity including but not limited to injury, loss, damage or death as a result of slips, falls, collisions, muscle strains, property damage, water temperature, changing water levels, weather, and/or wildlife. I am voluntarily participating to operate a canoe/kayak with full knowledge of the dangers involved and hereby agree to in this paragraph, was fully discussed and negotiated with representative of Flexpeditions Inc. prior to execution of this agreement.

As lawful bargained for consideration for being permitted by Flexpeditions Inc.to engage in operating a canoe/kayak and use of
its equipment, and to participate doing so on put in property. PARTICIPANT hereby agrees that neither PARTICIPANT(S), heirs,
distributes, guardians, legal representatives, and assigns will make claim against, sue, attach the property of or actions claims, or demands which I, my heirs, distributes, guardians, legal rep or assigns now have or hereafter have for injury or damage resulting from participating in operating a canoe/kayak.

I am aware the Transport Canada has classified canoes/ kayaks as human powered vessels and know that I must abide by its Personal Flotation Device (PFD) regulations. Flexpeditions Inc. has ensured that I am fully equipped to do so. I acknowledge the benefits and recommendations to exceed this minimum and am responsible for being prepared for my personal adventure on the water.

I have carefully read this agreement and fully understand Its contents. I am aware that this is a Release of Liability and Rental Contract between myself and Flexpeditions Inc.
