Risk Acceptance

WARNING:  Any activity associated with a bouldering area, a climbing area with a self-belay system, as well as related equipment and physical conditioning activities (hereinafter referred to as "activity”) Some risks cannot be eliminated while allowing the activity to take place. The things that make this activity unique can cause loss or damage to your equipment, accidental injury, illness or, in extreme cases, permanent trauma or death. We believe it is necessary to well inform you of the risks inherent in this activity so that you can decide to participate in it knowingly. The decision is entirely up to you, although we strive to provide you with as safe an environment as possible.

 

RECOGNITION OF RISKS

I recognize that it is necessary that I participate in an orientation with a member of staff on my first visit to the climbing area, even if I am a regular / accredited of other climbing centers.

I acknowledge that the following describes some of the risks, in a non-exhaustive nor limitative manner, of indoor climbing and physical activity (outdoors, gym and group classes):

  1. Slipping, tripping, falling, or crushing in a painful manner when using facilities or equipment, climbing walls, landing pits, floors under climbing areas, training areas, sanitary facilities, or steps.
  2. The risks associated with crossing, climbing, or descending in climbing.
  3. Misuse of equipment or facilities, or equipment failure.
  4. Unexpected falls due to improper positioning, a poorly performed parry or due to an unexpected loss of control.
  5. My health, my physical strength, coordination, sense of balance and ability to follow or give directions when climbing or training may not be sufficient to allow me to practice safely the sport of indoor climbing.
  6. Fatigue, chills and / or dizziness, which can shorten my reaction time and increase the risk of accidents.
  7. Abrasions caused by equipment or structures, as well as by ropes and equipment or by becoming entangled in them.
  8. The presence, actions or falls of other participants, whether accredited or not.
  9. Slipping in the parking lot due to ice accumulation during winter months.

 

I acknowledge that the following injuries represent, but are not limited to, some of the injuries that may arise from indoor climbing and physical activity (gym and group classes).

  1. Injuries associated to falls or other movements (ex. Sprains, strains, fractures, ligament stretching, etc.).
  2. Injuries, abrasions, or cuts with blunt and / or sharp objects (ex: grips, equipment, belay devices, walls, etc.).
  3. Injuries associated with misuse of equipment or installation, or failure of personal protective equipment.
  4. Injuries resulting from accidental contact, or not, between certified individuals, or not.
  5. Injury as a result of negligent behavior on my part or that of other users.
  6. Neurodegenerative disorders following a fall or an impact.

 

ACCEPTANCE OF RISKS

I certify that I have been informed of the risks inherent in climbing and all other activities practiced at D-vert, including the use of the fitness equipment. I agree to undertake the activity with full knowledge of these risks. I accept, in particular, but not limited to, the risks of bodily harm, accidents and/or illnesses, including sprains, muscle and / or ligament tears, cracks or fractures, eye conditions, cuts, wounds, abrasions and / or contusions, dehydration, lack of oxygen (anoxia), exposure and / or altitude sickness, trauma to the head, neck and / or spine, lung problems, nervous shock, paralysis and / or death.

I understand that the description of these hazards and the injuries that may result from them is not complete and that other unknown or unforeseen hazards may result in injury, illness, or death.

I also commit to playing an active role in the management of these risks, by adopting a preventive attitude towards myself, as well as towards the other people around me, and this, at all times when I am present, at D-vert.

I understand that D-VERT reserves the right to exclude any person who represents a risk for himself or for others, at its sole discretion and without reimbursement.

 

HEALTH AND PHYSICAL STATE

I certify that I am in good physical condition and that I have no personal health problem preventing me from participating in D-VERT activities. I agree to tell the responsible staff of any physical or mental condition that could affect my safety or that of others.

I take full responsibility for choosing a responsible person to spot me.

I understand that auto-insurers are made available to me so that I can climb without a belay partner. I am responsible for following the operating procedure to ensure the proper functioning of the equipment and to be properly attached to the auto-belay. I understand that a child who wishes to use an auto-belay must be accompanied by a parent.

I take full responsibility for my actions when using an auto-belay.

 

COMMITMENT TO RESPECT THE RULES AND REGULATIONS

I confirm that I understand and agree to abide by the rules and regulations of D-VERT, a copy of which is displayed in the climbing center. A copy is available on the D-vert website and a printed copy of the regulations is available on request.

The D-VERT and its representatives reserve the right to refuse or suspend the right of access to the center of any person who demonstrates a dangerous attitude towards safety in indoor climbing and all other activities at D-VERT, or who does not respect the rules and regulations of D-VERT, at its sole discretion, without refund.

 

CHILDREN CLIMBERS AND VISITORS (if applicable)

I affirm that the child eighteen years of age and under for whom I am signing the form is indeed my biological son or daughter or that I am the legal guardian or I affirm that the parent or legal guardian of the child I am accompanying has entrusted me with custody and accepts that he or she participates in the activities of D-VERT. I assume all responsibility for the continuation of the activity by the child I am accompanying.

I agree to abide by the rules that I have read and understood when I am with a child at D-VERT as a climber, or guide.

 

PHOTOGRAPHS AND PUBLICITY MATERIAL

I hereby authorize the D-VERT to use photographs and video material in which it is possible to recognize me, for advertising purposes, without any compensation whatsoever.

 

ORIENTATION AND FALL TESTS

I understand that, for everyone's safety, I must participate in a safety orientation before starting my activity.

 

I understand that I must respect my body and my skills in choosing the height to which I climb.

 

I acknowledge having read and understood the acknowledgment and acceptance of the above risks and responsibilities,

I FREELY AND FULLY AGREE TO ASSUME ALL THE RISKS AND DANGERS MENTIONED ABOVE AND I UNDERTAKE TO RESPECT THE RULES AND REGULATIONS OF D-VERT.

I certify that I am not under the influence of any substance (drugs and / or alcohol) and I will not consume any during all D-vert activities (present and future).

I, the undersigned, hereby waive any claim, as well as any action for damages, including for any damage to property and equipment belonging to me.


Rules for D-Vert clients

  • If you have flu-like symptoms, you stay home.
  • Answer the questions honestly related to COVID-19 that you will be asked.
  • If you must cough and / or sneeze, do it into your elbows or tissues.
  • Already wear climbing clothes and minimize non-essential items.
  • Wash your hands when entering the center and as often as possible between climbs.
  • Check your emails, the D-VERT posters in the center, the D-VERT website, or its social networks for updates on regulations related to the evolution of the situation.
  • Respect the center and its employees and show understanding of the situation.

 

GENERAL REGULATIONS OF THE CENTER

The following regulations are established to create a safe and pleasant environment for all D-VERT customers. Anyone entering D-VERT must always comply with them, under penalty of expulsion.

D-VERT reserves the right to assess the mastery of the basic knowledge of any member and, if they are not mastered, withdraw the member's accreditation or have him undergo training before allowing him access to the various spaces.

All D-VERT users must have signed the risk acceptance document before using the equipment, whether it is the climbing area, the fitness area or the D-Vert studio.

At all times, when users are present at D-VERT, they must comply with the following regulations, under penalty of expulsion without reimbursement:

  • To use the climbing areas independently, the minimum age is 13 years old.
  • Climbers 12 and under must be accompanied and supervised by an adult (18 and over). The accompanying adult can supervise a maximum of one child at the time. In the vent that a parent would be alone with more than one child, there can only one active child at a time. The other child (s) should wait until they are supervised before climbing. Children waiting, must always stay in the same room as the adult companion and stay on the ground. The adult guide cannot climb when supervising children, unless they all have a "young responsible" card.
  • Children 12 years old and under must always be accompanied by an adult and this adult must have received the special training given by a D-Vert employee upon arrival at the center.
  • You must be at least 13 years old to access the training area and be 3 years old to use the self-belay. The accompanying adult is responsible for securing the child to the self-belay device. The child must weigh a minimum of 22 pounds to be able to use a self-belay device.
  • Climbers must be properly dressed and remove all jewelry from hands and wrists.
  • Climbers must wear compulsory shoes for climbing (climbing shoes are mandatory.)
  • Climbers must always wear shoes when moving (no movement with bare feet).
  • Clients should not run to move around in D-vert.
  • Climbers avoid placing any material on the ground, including their bag of chalk, their water bottle, or their shoes.
  • It is forbidden to move the equipment of the center without the authorization of the staff.
  • Dogs are not allowed inside the D-VERT.
  • It is forbidden to use the center's facilities, both the climbing section and the physical conditioning area, under the influence of drugs, alcohol or any form of medication that affects the level of vigilance and time response from participants.

 

SPECIAL REGULATIONS

Self-belay section

  • The holds in the self-belaying section (« D-Vert Tower») are reserved for this activity, it is therefore strictly forbidden to climb them without being tied up by an auto-belay.
  • The climber must receive accreditation from the D-VERT center before using the auto belay devices.
  • An accompanying parent alone with one or more children cannot climb, unless all the children he is accompanying have their "young responsible" card.
  • Children of 13 years old and under must always be supervised by an adult. The adult has the responsibility to attach the child to the auto belay device.
  • Long hair should be tied back before using auto belay devices.
  • Before climbing with the self-belayers, the climber must complete the following checklist: 
  • A) ATTACHED (check that the carabiner is properly closed and that it is located on the correct part of the harness, i.e., the trigger guard).
  • B) WELL ADJUSTED (ensure that the harness is worn above the hips and that it is sufficiently tight).
  • C) CORRIDOR (validate that the self-belay you are attached to is above your route).
  • When climbing with the auto belay, the climber must not pull on the cable or strap of the auto belay at any time.
  • Minimal weight of 22 pounds to use the self-belay system and 330 pounds maximum.
  • Climbing shoes are mandatory.

 

Boulder climbing section

  • The bouldering area is not accessible to children 12 years old and under, unless you are accredited with the "young responsible" card.
  • When he comes to D-VERT for the first time, the climber must indicate this to the staff to receive instructions verbally. It is the climber’s responsibility to request a reminder of the instructions if necessary.
  • The climber does not wear a harness when using the boulder walls.
  • The climber waits out of the mattress area when not climbing.
  • It is forbidden to sit on the mattresses or put their feet on them.
  • When moving on the mattresses, the climber avoids doing it sideways.
  • When climbing, the climber makes sure to choose a route that is not in the potential fall zone of another climber (always keep an empty route between each climber).
  • When possible, the climber “un-climbs” a route, rather than letting himself fall.
  • The climber is always ready to fall and cushion his fall in the right way.
  • It is forbidden to run on the mattresses
  • The climber does not do a “top out”, except in places where it is specifically indicated that this is allowed.
  • In the “top out” section you must circulate in the corridor and come down the stairs. You cannot walk on top of the wall.
  • You cannot circulate under the arches.
  • climbing shoes are mandatory.

 

Training section

  • The fitness area is strictly prohibited for children 12 and under, even if they are accompanied.
  • The user must wear appropriate clothing for the practice of physical activity, always including a t-shirt or tank top.
  • The user must always have closed sports shoes, not worn outside.
  • The user must remove their harness when in the fitness area. However, he can put it back on to ballast.
  • The user must clean the equipment he uses after use and put it back in its place.
  • The user should always have a towel with them and wipe down the bench they are using when they are finished using it.
  • It is forbidden to throw weights and bars on the ground (they must be put down gently).
  • It is forbidden to throw balls at the wall.
  • The user should act with consideration for other users and release the material as soon as possible. Use of cardiovascular activity equipment (treadmill, stationary bike, elliptical, etc.) is limited to 30 minutes if other users are waiting to use it. In the event of material abuse, the user will be denied access to the fitness area.
