With the recent challenges posed by COVID-19, the James River Association is asking participants to help us run programs as safely as possible. Please know that the risk of exposure to the COVID-19 virus cannot be completely eliminated. JRA asks each participant to fully evaluate your ability and willingness to participate in guidelines and understand the risks. ALL JRA EVENT PARTICIPANTS (AND/OR THEIR GUARDIANS) PLEASE READ AND SIGN THE FOLLOWING: I understand and agree that I will not participate in this activity if I have experienced any of the following symptoms in the 14 days prior to this activity: new or worsening cough; shortness of breath or difficulty breathing; fever greater than 100.4ºF; chills; unexplained muscle pain, sore throat, new loss of taste or smell. I also agree that no one in my household has exhibited the above symptoms or that I have knowingly been in contact with anyone with confirmed COVID-19 in 14 days prior to this activity. All this information is to the best of my knowledge, correct. I understand that participation in James River Association (JRA) activities is entirely voluntary. I understand that the JRA event may involve “hands on” activities such as planting, picking up trash, using equipment, or wading in shallow water; and I understand the risks and dangers involved in the above-named activities. I know and understand that unanticipated dangers might arise. I, being of lawful age, on behalf of myself, my personal representatives, heirs and next of kin hereby release and forever discharge JRA, its Board of Directors, agents and employees (all hereinafter referred to as releasees) from any and all liability or responsibility for injury to person or property which might occur as a result of participation in JRA activities, whether caused by the negligence of the releases or otherwise. I further agree to indemnify, defend, save and hold harmless the releasees from any loss, liability, damage or cost I may incur. I agree that this release and indemnity agreement is intended to be as broad and inclusive as is permitted by laws of the Commonwealth of Virginia. I give permission to authorize personnel to carry out such emergency diagnostic and therapeutic procedures as may be necessary for me / my child, and also permit such treatment procedures to be carried out at and by local hospital(s) for me / my child in the event of an emergency. I understand that any medical expenses will be billed directly to me or my insurance company. I hereby grant the JRA the unconditional right to use my / my child’s name, voice, and photographic likeness in connection with any audio video production, articles, website materials or press releases, but not as an endorsement. Under no circumstances will a name be used in conjunction with an image or voice without prior consent RIPARIAN STEWARD AGREEMENT I understand that I am a volunteer for the James River Association's (JRA) Riparian Stewards Program and agree to abide by all of the terms and conditions set forth in this agreement. I understand that I will receive no financial compensation or benefits for assistance in any capacity. I understand that participation in the JRA’s activities is entirely voluntary. I know and understand that unanticipated dangers may arise. I hereby release the JRA from any responsibility for injury which might occur as a result of participation in the JRA activities. I understand that any medical expenses will be billed directly to me or my insurance company. I agree to the following commitments and terms and conditions. COMMITMENT I will attended one initial training session, learning the basic Riparian Steward protocols. I will select at least one Riparian Buffer site and assist in the maintenance of such site. I conduct at least two visits to each site per year to perform maintenance, and notify the Riparian Steward Coordinator or Middle James Restoration Manager regarding any work that has to be done to the site. The period of maintenance shall be 3 years from the installation date of the riparian buffer. I will notify the Riparian Steward Coordinator or Middle James Restoration Manager when I am planning to visit a site for maintenance. Notice shall be given no less than 10 days prior to your planned visit. After buffer maintenance has been completed, the maintenance log shall be submitted to the Riparian Steward Coordinator within 10 days. TERMS AND CONDITIONS I will conduct myself in a safe, positive, friendly, and informative manner as a visible ambassador of the JRA, and Riparian Steward Program, understanding that I have no legal authority to act on behalf of the JRA I am to report, but never directly interfere with illegal or suspicious activity. I will report illegal activity to local authorities and alert the Riparian Steward Coordinator about the report. I will report watershed issues to the Riparian Steward Coordinator. In my capacity as a Riparian Steward, I will not trespass on the property of any party, damage the property of any party, or partake in any other illegal activity. While serving as a Riparian Steward any communication with the landowners will be handled through the Riparian Steward Coordinator. Direct contact with landowners is prohibited unless explicitly given permission by the land owner. I will not use alcohol or illegal drugs when on site, nor act as a Riparian Steward while in an impaired state. Should any issues or confrontations arise between myself and a landowner, or employee of a land owner, that I will contact the Riparian Steward Coordinator and notify them of the situation. I will not act in an unsafe manner or perform any act that may result in injury to others or myself and that safety will always be my number one priority. I will take full and sole responsibility for all of my actions while acting as a Riparian Steward and will hold the JRA, the Association’s Board of Directors, JRA staff, and any other party acting as an agent for JRA, harmless against any and all claims for injury or death which may originate from me, my heirs or assigns. I will hold the JRA, Associations Board of Directors, JRA Staff, and any other party acting as an agent of JRA, harmless against any and all claims of others which may be brought against them for any act or omissions on my part while serving as a Riparian Steward and indemnify them against any damages or liabilities resulting from my actions as a Riparian Steward. I grant permission for my name, image, likeness, and voice to be used by the JRA or any agent of JRA for legitimate purpose in media or promotional materials developed. I acknowledge that I received, read, and fully understand all of the responsibilities listed and agree to abide by all of the commitments listed herein and any other legal responsibilities not specifically listed in this document. |
