SHOOTING SPORTS ARE INHERENTLY DANGEROUS. SERIOUS INJURIES AND EVEN FATALITIES CAN OCCUR. BY SIGNING BELOW YOU ACKNOWLEDGE THESE WARNINGS AND AGREE THAT  ELK CREEK HUNT CLUB, IT’S OWNERS, EMPLOYEES, AGENTS AND OFFICERS ARE RELEASED AND HELD HARMLESS BY YOU AND/OR YOUR REPRESENTATIVES FROM ANY AND ALL INJURIES AND DAMAGES YOU MAY INCUR WHILE ON THIS PROPERTY TODAY OR AT ANY DATE HERE AFTER. YOU ARE A PARTICIPANT OR SPECTATOR ON THIS PROPERTY AT YOUR OWN RISK AND ASSUME ALL RISK OF INJURY OR DAMAGE OF ANY KIND.

  1. Think “safety first and always.”
  2. There will be no loaded guns going to and from the sporting clays course.
  3. No gun can ever be loaded unless the shooter is in the station stand.
  4. When not on station, your gun must be empty and the action kept open.
  5. There will be no shooting at any other location on Elk Creek property other than on the sporting clays course or a designated area.
  6. When shooting you must shoot in the area provided and not shoot into any other area on the property.
  7. Only one shooter on a station at a time. Spectators and waiting shooters must stay behind the shooting station.
  8. Shooters and spectators must wear eye and ear protection at all times.
  9. Load only one shell for singles, two shells for doubles, and maximum two shells in any gun at one time. Those shooting pumps and autos, please pick up your hulls. Throw them in the trash.
  10. In case of misfire, keep gun pointed in safe direction for 30 seconds with action closed until the situation is corrected.
  11. There will be absolutely NO alcoholic beverages allowed before shooting or on the sporting clays courses.
  12. Children must be under close supervision by adults at all times.
  13. No one is allowed in restricted areas or off pathways at any time.
  14. Please no littering.
  15. All empty hulls on ground are the property of the club.
  16. Tipping of all trappers is discretionary.
  17. Do not attempt to repair any equipment yourself.  Call the Clubhouse and someone will assist you.
  18. Riding on golf carts in seats only. No standing while cart is moving.
  19. You will be responsible for any accidents resulting from use of golf carts, including damage to guns.
  20. Appropriate Dress Required.
  21. You must have a valid driver’s license in order to drive a golf cart.

Failure to follow these rules, and any unsafe or unsportsmanlike conduct, will result in the shooter’s removal from the grounds.

I have read this Release and Rules and agree to abide by the Rules listed above and any others posted or communicated to me, and understand and agree to the Release stated above.

GOLF CART RELEASE AND WAIVER LIABILITY FORM

This golf cart is hereby rented from Elk Creek Hunt Club and driver agrees to accept personal and collective liability for any damages to this golf cart and/or the property of Elk Creek Hunt Club or any neighboring properties caused by use of this golf cart.

I acknowledge that the use of this golf cart can be dangerous and includes the risk of injury from collision with people, objects, and falling from the cart. I expressly assume all risks associated with the use of this rented golf cart and agree to hold harmless Elk Creek Hunt Club, or any of its personnel responsible for any accident, or injury to others or myself as a result while operating this rented golf cart

I agree to operate this rented golf cart at a safe speed while traveling throughout the property at Elk Creek Hunt Club or any neighboring property.  I agree that I will be responsible to transport only passengers on the designated seats of the golf cart.  Golf carts with one seat will safely transport two passengers and golf carts with 2 seats will safely transport four passengers.  This capacity is not to be exceeded.  There is to be NO standing passengers on this rented golf cart, as this could result in an accident, causing bodily injury or death.

Any person that has knowingly consumed alcohol will not be permitted to rent a golf cart.  Any person that has consumed alcohol while operating this golf car, or its passengers, will be fully responsible for ALL accidents that could possibly result in bodily injury, death, or property damage.

Upon return of all golf carts, they are subject to inspection and if ANY damage is committed you are held responsible for the damages.

I have read this complete release and waiver of liability, assumption of risk and indemnity, and fully understand its terms.  I understand I have given up substantial rights by signing it.  I further intend my signature to constitute a complete and unconditional release of all liability to the fullest extent allowed by law.  I agree that I am a minimum of 16 years of age and hold a valid driver’s license.

GOLF CARTS ARE NOT PERMITTED OFF OF THE ELK CREEK HUNT CLUB PROPERTY, DO NOT TAKE TO THE WINERY!!!!
