Spy Hop Student Liability Waiver 




PLEASE READ AND UNDERSTAND THIS POLICY BEFORE AGREEING

 This Agreement must be completed by the Parent/Legal Guardian or adult participant (18-20 years of age) in order to participate in the activities associated with the program. Participants over the age of 18 can complete this agreement.

Parent/Guardian's Responsibility


Spy Hop Productions strongly encourages parents/guardians to participate with their children by taking an interest in their Spy Hop activities. 

 Parent/Guardian’s Rights/Adult Participants (18 - 20 years of age)


Parents/guardians/adult participants (18-20 years of age) have a right to have any and all of their questions answered and their concerns addressed. If you ever have any questions or concerns, you have the right to call Spy Hop Productions and ask to speak with your child’s mentor or the Education Director.

SPY HOP GRANT OF RIGHTS AGREEMENT

For good and valuable consideration, receipt and sufficiency of which is hereby acknowledged, I hereby agree that Spy Hop Productions, Inc., a Utah non-profit corporation (“Spy Hop”), and its directors, officers, employees, agents, affiliates, successors, assigns, and designees shall have the right in perpetuity throughout the universe to use my name, likeness, image, voice, sound effects, interview, biographical information and/or performance in connection with my participation in the program or programs (collectively, the “Program”) offered by Spy Hop and any other legitimate business purpose of Spy Hop, in any and all media now known or hereafter devised, including without limitation pictures, photographs, audio and video recordings, digital images, websites, television programs, advertising, marketing, promotional materials, brochures, books, magazines, other publications, CDs, DVDs, other disc formats (e.g., Blu-ray Disc, etc.), tapes, social-media posts and content, and all other physical and/or electronic form(s) (collectively, “Permitted Uses”). I hereby irrevocably grant Spy Hop and its successors and assigns the right to photograph and make motion pictures and sound recordings of my physical likeness and voice in connection with my participation in the Program or any other legitimate business purpose of Spy Hop, to use, edit, and incorporate such motion pictures and/or sound recordings in connection with the Program and all related materials or any other legitimate business purpose of Spy Hop, and to reproduce the same in any manner or medium whatsoever in perpetuity throughout the universe without further compensation.

I hereby forever release Spy Hop and its directors, officers, employees, agents, affiliates, successors, assigns, and other representatives of any kind from any and all claims, actions, damages, losses, costs, expenses, liability of any kind, including attorney’s fees, and rights to compensation or royalties or compensation arising under any legal or equitable theory whatsoever in connection with any Permitted Uses, including, but not limited to, any and all claims, demands, or causes of actions for libel, defamation, invasion of privacy, right of publicity, copyright infringement, or violation of any other right arising out of or relating to the Permitted Uses.

I hereby forever release Spy Hop and its directors, officers, employees, agents, affiliates, successors, assigns, and other representatives of any kind from any and all claims, actions, damages, losses, costs, expenses, liability of any kind, including attorney’s fees, and rights to compensation or royalties or compensation arising under any legal or equitable theory whatsoever arising out of or relating to the production and distribution of, or failure or omission to use, any and all media now known or hereafter devised, including without limitation pictures, photographs, audio and video recordings, digital images, websites, television programs, advertising, marketing, promotional materials, brochures, books, magazines, other publications, CDs, DVDs, other disc formats (e.g., Blu-ray Disc, etc.), tapes, social-media posts and content, and all other physical and/or electronic form(s) which I create, am involved in, or otherwise participate in through my participation in the Program (collectively, the “Content”). I acknowledge and agree that Spy Hop may display the Content in the community and other public venues and may submit the Content to festivals and hereby expressly consent to such uses of the Content by Spy Hop. I hereby irrevocably grant Spy Hop and its successors and assigns a royalty-free license to use the Content in connection with my participation in the Program or any other legitimate business purpose of Spy Hop, to use, edit, and incorporate such Content in the Program and all related materials, and to reproduce the same in any manner or medium whatsoever in perpetuity throughout the universe without further compensation.

Notwithstanding the foregoing, I understand that I retain copyright and trademark ownership of the Content. I hereby acknowledge and agree that due to the collaborative nature of the Program, the Content may have multiple authors and that each author will retain ownership of the Content. I understand, acknowledge, and agree that Spy Hop is not responsible for determining ownership of the Content or registering or maintaining copyright or trademark in or to the Content or otherwise having any involvement or liabilities whatsoever related to ownership of the Content. 

Any and all rights, titles, and/or interests granted to Spy Hop hereunder shall survive any purported expiration, termination, or breach, by any party, of this Agreement. Neither Spy Hop nor any of its designees, licensees, successors, or assigns shall owe me any compensation of any kind, including without limitation appearance fees, advances, or royalties, in exchange for the rights, titles, and/or interests granted, transferred, and/or assigned hereunder.

INFORMATION, RECORDS, AND EVALUATION CONSENT & RELEASE AGREEMENT

Participant and Parent consent to Spy Hop Productions, Inc., a Utah non-profit corporation (“Spy Hop”) collecting information in order to evaluate its program or programs (“Program”), including interviews, observations, surveys, and other class activities and materials. Participant and Parent understand that Participant and/or Parent will complete a confidential survey about Participant’s attitudes and opinions as part of this evaluation. Participant and Parent understand that the information obtained will be analyzed and that Participant and Parent’s names will be withheld for confidentiality purposes. Participant and Parent understand that the information collected by Spy Hop will be part of a larger evaluation and only the evaluation team and program staff will have access to this confidential information.

SPY HOP EQUIPMENT USE & STUDENT RESPONSIBILITY AGREEMENT

I hereby accept responsibility and acknowledge accountability for any damage, loss, or theft of any or all equipment used in conjunction with my participation in the program or programs (“Program”) offered by Spy Hop Productions, Inc., a Utah non-profit corporation (“Spy Hop”). I agree to take responsible care in the handling, transportation, and storage of all Spy Hop equipment in my care (the “Equipment”). In the event of any breakage, loss, or theft of the Equipment, I will be advised by a Spy Hop Production staff member as to the extent of damages, which I acknowledge and agree shall be my sole financial responsibility. I understand and agree that I shall not repair the Equipment myself or have it repaired without prior written approval from Spy Hop. I understand and agree that I must satisfy all payments and/or replacements related to the damage of the Equipment must be settled in full before any additional use of Equipment or Spy Hop’s facilities will be authorized. In the event that I have received prior written approval to have the Equipment repaired or replaced, I acknowledge and agree that I must document that the repair or replacement has been undertaken by an approved vendor before any additional use of Equipment or Spy Hop facilities will be permitted. I understand, acknowledge, and agree that I am responsible for loss or damage of the Equipment due to negligence, including items left in vehicles (even if locked or hidden from sight) or other unattended locations.


In cases of loss, theft, or damage, I expressly acknowledge and agree that I may be responsible for the FULL VALUE of the equipment.

TRANSPORTATION RELEASE

I fully understand that the Program staff may transport my child in a vehicle to and from various activities and hereby release and hold the Spy Hop Parties harmless against any liability, loss, or expense incurred or suffered in consequence of any action or actions, suit, or suits, in law or equity, which may be brought by any person or persons in connection with, or with reference to, the administration, planning, preparation, development, conduct, and execution of the Spy Hop Program.

PARENTAL/GUARDIAN CONSENT/ADULT PARTICIPANT (18-20 YEARS OF AGE)

In order to induce Spy Hop to enter into the foregoing Agreement, I represent and warrant that I am the parent or guardian of the below-signed minor (“Minor”) or I am an Adult participant (18-20 years of age). I have read the foregoing Agreement and am familiar with all of the terms and conditions thereof, and I consent to its execution by Minor. I agree that neither I nor the Minor will revoke or disaffirm the foregoing Agreement at any time. In addition to and without placing any limitation on any rights, Spy Hop may have against Minor; I agree to indemnify and hold Spy Hop and its designees, successors, licensees, and assignees, and any employee, agent, or other representative thereof, harmless from and against any and all claims, liabilities, costs, or expenses, including attorney’s fees and costs, which may arise from the breach or alleged breach by the Minor or me of the foregoing Agreement or this consent.
