ACKNOWLEDGEMENT, ASSUMPTION OF RISKS, WAIVER AND RELEASE OF CLAIMS

PLEASE READ CAREFULLY

Project Love Run Inc. (also known as Project Love Run, PLR and/or PLR Collective), and each of its (theirs) current or future directors, officers, employees, instructors, guides, facilitators, agents, sponsors, independent contractors, subcontractors, suppliers, successors assignees and representatives (all of whom are hereinafter collectively referred to as the “Releasees ”)

“SPORTS ACTIVITIES”: (to be defined as “RUNNING” in this document)

Here at PLR, the safety and wellbeing of our PLR collective has and continues to be our top priority. In order to provide our members with a safe, effective and enjoyable training environment, while at the same time doing our best to prevent the spread of COVID-19, we will now require that all members sign this Acknowledgement, Assumption of Risks and Waiver and Release of Claims Agreement prior to engaging in any “RUNNING” activities and/or services associated with PLR.

In this Release Agreement, the term “RUNNING” shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authourized by the Releasees and shall include, but is not limited to: “RUNNING”; “RUNNING” events; orientational and instructional courses, seminars and session; travel, transport and accommodation; and other such activities, events and services in any way connected with or related to “RUNNING”.

PROTECTIVE EQUIPMENT

I have been advised to wear all protective equipment that is required by the rules and regulations of the governing body for my sport.

CLIENT ACKNOWLEDGEMENT

In order to best ensure your own safety, as well as the safety of our other PLR members and the RELEASEES, PLEASE READ THE BELOW CAREFULLY, AND SIGN THIS DOCUMENT ONLY IF EACH STATEMENT BELOW IS CORRECT IN RESPECT OF YOURSELF:

  • I am not currently experiencing COVID-19 symptoms nor have I experienced COVID-19 symptoms in the last 14 days.
  • I have not travelled outside of Canada or in an area under a travel health advisory in the last 14 days.
  • I have not provided care or had close contact with any person: with COVID-19; reasonably suspected of having COVID-19; who travelled outside of Canada in the last 14 days; or who travelled in an area under a travel health advisory in the last 14 days.
  • I have not been advised by the Government of Canada, British Columbia Provincial Health Services Authority (or a similar public health authority or government health website), the Provincial Health Officer a doctor or a health care worker to self-isolate due to possible exposure to COVID-19.

ASSUMPTION OF RISK AND INFORMED CONSENT

I hereby acknowledge that:

I am aware that “RUNNNING” involves many risks, dangers and hazards. The risks, dangers and hazards, including but not limited to: loss of balance; difficulty or inability to control one’s speed and direction; variation or steepness in terrain; rapid or uncontrolled acceleration on hills and inclines; mechanical failure of equipment; variation or changes in running surface including rocks, gravel; changing weather conditions; exposure to temperature extremes or inclement weather; travel or transport to and from the sites used for “RUNNING”; travel on highways and backcountry roads; encounters with domestic and wild animals including dogs, bears and cougars; collision with pedestrians, motor vehicles, cyclists and other players; failing to play safely or within the limitations of one’s own abilities, negligence of other participants; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RISKS RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF “RUNNING”

I AM FULLY AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH “RUNNING” AND THE RISKS AND HAZARDS WITH RESPECT TO COVID-19 INHERENT IN MY ATTENDANCE AND PARTICIPATION IN “RUNNING”.

I FREELY ACCEPT AND FULLY AND VOLUNTARILY AGREE TO ASSUME, WITHOUT QUALIFICATION OR LIMITATION, ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM, INCLUDING THE RISKS ASSOCIATED WITH COVID-19.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the RELEASEES agreeing to my participation in “RUNNING” and permitting my use of their services, equipment and other facilities and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

  1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the THE RELEASEES AND TO RELEASE THE RELEASEES from any and all claims and liability arising from any loss, damage, expense or injury, including death, cost or relief of any kind due to or associated with COVID-19, that I may suffer or that my next of kin may suffer as a result of my participation in “RUNNING” DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN “RUNNING” REFERRED TO ABOVE;
  2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES for any and all claims or liability for any property damage, loss or personal injury to any third party, due to or associated with COVID-19 resulting from my participation in “RUNNING”;
  3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity;
  4. The Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the province where the “RUNNING” takes place and no other jurisdiction; and
  5. Any litigation involving the parties to this Release Agreement shall be brought solely within the province where the “RUNNING” takes place and shall be within the exclusive jurisdiction of the Courts of that province. In entering into the Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in “RUNNING”, other thatn what is set forth in this Release Agreement. I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
