Release of Liabilty, Waiver of Claims, Assumption of risks and indemnity agreement.

By signing this document you will waive or give up certain legal rights, including the right to sue or claim compensation following an accident.

Definition

In this release agreement the term "Activities" shall include any use or participation at The Smashit & The Axe Hole House facility and it's equipment.

Assumption of Risks

I am aware that the activities I/or my child may take part in as described below, the Participant released and forever discharges the activity provider, its owner, officers, employees, agents, and legal representatives from all manner of actions, causes.

Activities

The Participant will participate in the following activity: Destroying objects, throwing axes, paintball shooting, and/or escape room at The Smashit and/or The Axe Hole House.

Medical Condition

I understand that the activities may place unusual stresses on the body. The activities are not recommended for persons suffering from asthma, epilepsy, cardio/respiratory disorder, hypertension, skeletal, joint, or ligament problems, and certain mental illnesses. Women who are pregnant or suspect they are pregnant, and persons who have consumed alcohol, are not recommended to engage in the activities. I have been advised to consult with my medical practitioner of I have any questions about my medical condition or fitness to engage in the activities.

Release of liability, waiver of claims and indemnity agreement

The Participant agrees to participation in the activities and use of equipment at The Smashit and/or The Axe Hole House, I hereby agree as follows:

* To waive any and all claims and to release the releasees from any and all liability for any loss, damage, expense, or injury including death that I may suffer, or that my next of kin may suffer, as a result of my participation in the activities.

* To hold harmless and indemnify the releasees from any and all liability for any property damage or personal injury to any third party resulting from my participation in the activities.

* This release agreement Shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives, in the event of my death or incapacity.

* This release agreement and any rights, duties, and obligations as between the parties to this release agreement shall be governed by and interpreted solely in accordance with the laws of the state of Florida and no other jurisdiction.

* Any litigation involving the parties to this release agreement shall be brought solely within the state of Florida and shall be within the exclusive jurisdiction of the courts of Florida.

Photo/Video Release

I consent that any photographs or videos taken by The Smashit and/or The Axe Hole House during my participation in the activities may be used by The Smashit and/or The Axe Hole House for advertising, promotional, and marketing purposes.

I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS AGREEMENT PRIOR TO SIGNING IT, AND AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHCIH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
