All renters must be 21 years or older, with a valid US drivers lisence. 

This jet ski rental agreement is made by SEA BREES JET SKI RENTALS and the renter identified below and is effective as of the date of the signature of the renter. 

RULES FOR USE OF JET SKI AND EQUIPTMENT. renter agrees that he or she shall use the jet ski, including alls its equiptment, safety, (life) vests, motor, gas tank, and jet ski. only for the purpose of personal boating in MISSION BAY. with safety in mind and always follow these rules. 

1-Renter shall not consume, nor be under the influence of any intoxicant.  ( including but not limited to alcohol ) 2- renter shall follow all posted speed limits and rules of navigation on the water, and shall stay clear of all other vessels on the water. renter shall not attempt to board another vessel or tie jet ski to any other boat. renter shall protect the ski from coliding into other boats or docks, avoiding damage to the ski and docks 3- renter shall not allow anyone else other then those on the rental agreement to operate or ride the ski. if a renter fails to disclose other operators, passengers, or users of said equiptment, he/she  willl be personally held responsible for any damage done to the undisclosed person. even if damages done arise out of negligence of fault of fun on MISSION BAY san diego. 4-renter shall not ever replace any fuel into the jet ski unless in a case of an emergency, if this happens, they are only allowed to fill gas at the marina on MISSION BAY. 5- Renter shall not allow anyone to ski or ride tubes tied to the back of the jet ski, .

RESPONSIBILTY AND DAMAGES. renter shall return the jet ski in good working condition, at the end of the rental. if any equiptment has been lost or damaged. renter shall inform the Sea Brees jet ski rental staff upon return. Renter is finanically responsible for all lost or damaged equiptment or the damage of the jet ski, Sea Brees Jet ski rentals will charge the renter for all lost items or damaged items to the credit or debit card on file according to the following schedule of charges. 

*Impeller $1000.00  *storage straps $40.00 *Glove box cover $60.00 * Storage cover $150.00 *Torn or damaged seats  $300.00  *oil cover $60.00 *Life jacket $50.00 * totaled jet ski  $6000.00 *battery cover $75.00  *extinguisher $50.00 *lic./reg/ins. paperwork $200.00  *front bumper $200.00 *crackeed hull $1000.00 *flooded engine $500.00

The list of charges is not exhausrive and not a waiver of responibilty for other damage to the jet ski and renter shall be fully financially responsible to Sea Brees jet ski rentals for damages incurred. If jet ski is returned in a unrentable condition. Renter agrees to pay Sea Brees jet ski rentals an additional $200.00 a day until jet ski is able to be repaired to rentable condition again. with a maximum rental charge of $6000.00

ACKNOWLEDGEMENTS AND AGREEMENTS. by executing this jet ski rental agreement, undersigned renter acknowledges and agrees :     A- Although renter may recieve general instructions on these forms and from Sea Brees jet ski rentals staff (including Jeffrey Selke and Breanna Fryer) prior to rental, I acknowledge that the instructions recived do not qualify as watercraft operation training or safety training. The staff are human and this amount of information prior to the rental is limited. There is no amount of instruction which can prepare an individual for all of the foreseeable risks associated with operation of the jet ski.                                             B- renter acknoledges and agrees that he or she has the requirable skills, physical and mental necessary for the proper and safe use of the jet ski and swimming skills as may be needed in an emergency.               C- Renter is responsible personally and will be held liable for any injury or damage caused to others or their property regardless of wether in renters party or third parties.                                                                      D- renter agrees to wear a perperly fitted and fastened U.S coasr guard approved floation device ( life jacket ) while aboard the jet ski or on or in the water and require the same of any passangers.                                  E- Renter shall not sell or assign this agreement or sublet the jet ski or any part thereof, and at all times during the rental period, the person listed as the renter shall be the person operating the jet ski. F-Sea Brees jet ski rentals provides the jet ski without warranty and any and all waranties capable of waiver under state of california are hereby waved. Sea Brees jet ski rentals does not maintain or provide emergency personel or watercraft.  G- Sea Brees jet ski rentals is not liable for the loss or damage to the personal property of the renter

WARNINGS. THERE ARE SIGNIFICANT ELEMENTS OF RISK IN ANY ADVENTURE SPORT OR ACTIVITY ON THE WATER OR ASSOCIATED WITH THE USE OR PRESENCE OF WATERCRAFT, INCLUDED BUT NOT LIMITED TO JET SKIS AND THERE RELATED USE. THESE RISKS ARE INHERENT IN BOATING AND MAY BE PRESENT EVEN IF THE JETSKI IS USED PROPERLY, AND EVEN IN STILL WATER. THE RENTER UNDERSTANDS AND ACKNOWLEDGES THAT THE OPERATION OF JET SKIS INVOLVES RISK. 

risks such as, but not limited to, A- changing water flow, conditions, and currents. B- collision with other water vessels, including rocks, bolders, sand, manmade and natural objects also including trees and branches. C- cold weather and heat related injuries including hyperthermia, frostbite, heat exhaustion, sun stroke, and dehydration. D- inclement weather, variances and extremes of wind, weather and temperature, lightning and the presence of insects and animals. E- sense of balance, physical coordination, ability to swim, and/or ability to follow directions, F- loss of control of the watercraft, collision, capsizing, and sinking to the elements, hypothermia and drowning. G- injury while getting on and off of the watercraft. H- travel, including hiking, portaging, and travel to and from the related and unrelated activities. I- the presence of wild animals, including marine life. J- unavailability of emergency aid services and emergency medical care. The listing of these risks is not intended, and shall not be constructed as, all of the possible risks associated with the use of the jet ski. 

ASSUMPTION OF RISK. Based upon the warnings above renters acknowledgement of the inherent risks of using and operating a jet ski and the jet ski, and that some or all of those risks may be unavoidable even with reasonable care in the use and operation of the jet ski, by executing this agreement renter expressivly assumes all risks that arise from the use and operation of the jet ski, including the use of property damage, bodily injury, and possibly death, including the acts of others, the unavailability of emergency care and any other foreseeable factors or circumstances related to the use of the jet ski.  To explicitly acknowledge the renters assumption of risk, Renter shall place their initials here.

WAIVER AND RELEASE OF LIABILTY. the undersigned renter, based upon the warnings and understanding of risks, and predicated in part upon the acknoledgements and assumption of risks described above, does hereby waive, release, and discharge Sea Brees jet ski rentals, its officers, agents, employees, successors, and assigns, from any and all claims or liability arising from the use or operation of the jet ski, or use of the property, facilities, services, or activities organized or sponsored by Sea Brees Jet ski rentals and agrees that it shall not sue them on account or in connection with any claims , causes of actions, injuries, damage, cost of expenses arising therefrom, whether arising from negligence or strict liability, and regardless of the participation of any other third parties in the causation of any such injuries, damages, or liability, but excluding claims which arise from gross negligence or willful misconduct on the part of Sea Brees jet ski rentals. renter acknowledges that this wavier and release includes the waiver of future, unknown claims.
