RELEASE OF LIABILITY, WAIVER, AND ASSUMPTION OF RISK

LITCHFIELD COUNTY AXE HOUSE, LLC, for themselves, their owners, directors, agents, servants, employees, volunteers, parent and subsidiary companies, administrators, trustees, successors and assigns, and any party who claims a right or interest through them (hereinafter the “Releasees”)

REGARDING: RECREATIONAL AXE THROWING (hereinafter the “Activity”)

I, the undersigned participant, hereinafter the “Releasor”, desire to participate in the Activity on the date set forth below, which has been organized by the Releasees.

In consideration for being allowed to participate in the Activity on the date set forth below, I, on behalf of myself, my representatives, heirs, successors, assigns, administrators, trustees, executors, and on behalf of any party who may claim a right or interest through me (the “Releasor”), hereby release, acquit and forever discharge, without qualification or limitation, the Releasees from any and all claims I may now have or may in the future have against the Releasees, including but not limited to claims against the Releasees for negligence, gross negligence, carelessness, or claimed failure to take reasonable steps to protect me from the risks, hazards or dangers of participating in the Activity, and from any and all claims for liability, for any personal injury, death and/or property damage, expense and/or loss sustained by me as a result of my participation in the Activity due to any cause whatsoever.  

Releasor hereby acknowledges and accepts that participation in the Activity carries inherent risks and danger, and there is the possibility of personal injury, death, property damage and/or loss resulting from participation in the Activity.  Releasor acknowledges that injury might result not only from their own actions, but also from the action or inaction of others, the condition of the premises or any equipment used.  Knowing this, Releasor voluntarily assumes all risks, known and unknown, associated with participating in the Activity on the date below.

Releasor agrees that as a condition precedent to participation in the Activity on the date set forth below, he/she must agree to be bound by the terms of this waiver and release of liability, and by signing below Releasor represents and acknowledges that he/she understands this waiver and agrees to be bound by its terms.  Releasor further understands and agrees that he/she is not compelled to sign this waiver; should Releasor decline to sign the waiver prior to engaging in the Activity he/she will be issued a full refund of any sums paid for participation in the Activity on the date set forth below.

Releasor agrees that this Release of Liability, Waiver, and Assumption of Risk contains the entire agreement between the parties hereto, that the terms of this document are contractual and not a mere recital, that any breach of these terms may be enforced against the Releasor, and may give rise to a damage claim against the Releasor enforceable by a further legal proceeding.  Releasor further acknowledges that the Releasees have made no oral, written or visual representations or statements that are not otherwise reflected in this agreement.

Releasor agrees that this agreement will be interpreted pursuant to the laws of the State of Connecticut, which shall retain exclusive jurisdiction over any legal claim arising from it or Releasor’s participation in the Activity.

Releasor acknowledges that during the course of participation in the Activity, Releasees may photograph, record or videotape Releasor for promotional or other purposes.  Releasor hereby gives express permission for Releasees to capture his/her image and to use same for promotional or advertisement purposes, including publishing, displaying and/or distributing said images or videos.  Releasor acknowledges that any images or videos so taken shall be the exclusive property of Releasees and waives any right to inspect or approve of said images prior to their use by Releasees.  Releasor hereby releases and holds Releasees harmless from any liability arising out of the use of said images in any manner or media whatsoever, and hereby waive any claims and causes of action relating to the use of said images including, but not limited to, claims for invasion of privacy.

The undersigned Releasor hereby states he/she has read the above Liability Waiver, Release and Assumption of Risk, understands that he/she is giving up substantial rights by signing it, and hereby signs it voluntarily.
