Street-Legal Cart Agreement

In exchange for the privilege of using the Street-legal electric cart (the “Cart”), you hereby accept full responsibility for its use.  You agree to operate this vehicle in a safe manner and adhere to all applicable laws and regulations as well as the rules set forth by Bay Creek Realty, LLC and Bay Creek Resort, LLC (collectively, “Bay Creek”).  Specifically, you agree that:  

You are liable for all medical and legal claims that may arise from use of the Cart. 

The Cart is a motorized vehicle and driving or riding in such vehicles can lead to serious injury, property damage, and even death. No excessive speed, joyriding, or any type of unreasonable activity with the Cart will be tolerated.  You voluntarily agree to accept the risks of using the Cart on behalf of yourself, your family members and guest riders.   

You, your personal representatives, family members and your heirs hereby voluntarily release Bay Creek,  its owners, officers, employees, affiliates and agents for any and all claims, actions, causes of actions, suits, judgements, and demands for bodily injury, property damage, loss of life and/or loss of services, in law or equity, that may in any way or manner arise out of the use of the Cart. 

You must be at least 16 years of age and possess a valid drivers’ license to drive the Cart.  Under no conditions are you allowed to let another driver drive the Cart, unless cleared by Bay Creek staff upon signing of this waiver. At no time may a minor have a hand or hands on the steering wheel when the vehicle is moving. This requires you to have possession/control of vehicle keys when not in use.  


NO PERSON UNDER THE AGE OF 16 OR UNLICENSED PERSON IS PERMITTED TO OPERATE THE CART AT ANY TIME.  


The Cart must remain on roads with posted speed limits of 25 miles or less and only within the city limits of Cape Charles, VA. Do not take Cart off the trails and roadways that permit vehicular traffic. Do not operate Cart on native grass areas, off road, on dunes or beaches.  Do not operate cart on the golf course. Please go to the pro shop to rent a golf cart for use on the golf course.   

A Maximum of 4 people on the cart and all passengers must be seated and belted. NO CHILDREN ALLOWED IN DRIVERS LAP.   

Anyone observed abusing cart rules and regulations will forfeit all use privileges immediately.  This includes reckless driving or allowing underage guests to operate the cart.  


You agree that you are responsible for all damage to the Cart or other property resulting from your use of the Cart and to pay for any costs we incur to collect for such damages.  


Bay Creek reserves the right to charge the Credit Card provided at check-in to cover the cost of any necessary repairs resulting from damage done to the cart during your stay.
