WAIVER and RELEASE OF LIABILTY. DO NOT SIGN BEFORE READING!
By signing up for and/or attending Sweat Cycle classes, activities and other programs, including, but no limited to, Sweat Cycle Outdoors, and using Sweat Cycle’s premises, facilities, and equipment (collectively, Classes and Facilities), you hereby agree that there are certain inherent risks and dangers in indoor cycling and exercise and in using indoor cycling and exercise equipment in association with the Classes (including outdoor classes) and Facilities and you knowingly, voluntarily and intentionally agree to not sue or otherwise hold the Sweat Shoppe Toluca Lake LLC, Sweat Cycle DTLA LLC, Sweat Cycle ATL LLC and it’s owners, staff, employees, agents, representatives, insurers and successors (collectively referred to herein as “Sweat Cycle”) liable for any injuries regardless of the cause and to indemnify Sweat Cycle, and release, waive and hold Sweat Cycle harmless from any and all claims, demands, damages, rights of action or causes of action, present or future, arising out of or connected with your use of the Classes and Facilities, including any injuries resulting there from. THIS WAIVER AND RELEASE OF LIABILITY INCLUDES, WITHOUT LIMITATION, INJURIES WHICH MAY OCCUR AS A RESULT OF (1) EQUIPMENT BELONGING TO SWEAT CYCLE OR THAT MAY MALFUNCTION OR BREAK; (2) ANY SLIP, FALL, DROPPING OF EQUIPMENT; (3) AND/OR INSTRUCTION OR SUPERVISION. You also agree that you will be participating in indoor cycling classes which entail intensive physical activity (some of which are conducted in a heated room - approximately 80-86 degrees Fahrenheit). In consideration of being allowed to participate in and access the Classes and Facilities provided by Sweat Cycle, in addition to the payment of any fee or charge, you hereby knowingly, voluntarily and intentionally (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Classes and Facilities, (2) waive, release and forever discharge Sweat Cycle, its officers, agents, members, employees, representatives, and all others from any and all responsibility, claims, rights, causes of action and/or liability from injuries or damages to your person or property resulting from your participation in and use of the Classes and Facilities, and (3) represent you have no medical or physical condition which would prevent you from attending and/or using any of Sweat Cycle’s Classes and Facilities and/or put you in any physical or medical danger, and have not been instructed by a physician not to do so. You have been informed of, understand and you are aware that any exercise program, whether or not requiring the use of exercise equipment, is a potentially hazardous activity. You have also been informed of, understand and are aware that any exercise and/or fitness activities involve a risk of injury, as well as abnormal changes in blood pressure, fainting, and a remote risk of heart attack, stroke, other serious disability or death, and that you are voluntarily participating in the Classes and Facilities and using equipment and machinery with full knowledge, understanding and appreciation of the dangers involved.
THIS FORM IS AN IMPORTANT LEGAL DOCUMENT THAT EXPLAINS THE RISKS YOU ARE ASSUMING BY USING SWEAT CYCLE’S CLASSES, INCLUDING OUTDOOR CLASSES AND FACILITIES AND UNDER WHICH YOU WILL BE WAIVING IMPORTANT LEGAL RIGHTS. It is critical that you have read and understand this Waiver & Release of Liability completely. If you do not understand any part of this document, DO NOT SIGN! If you sign, you have acknowledged that you read and fully understood this Waiver & Release of Liability and have knowingly, voluntarily and intentionally agreed to its terms.
BUSINESS POLICIES Riders are able to reserve a bike in advance using our online bike booking system. You must have a current series in order to book in advance or be prepared to make a purchase when making a reservation. If you are registered for a class, please note that you must show up to claim your bike prior to the scheduled class time. Once the class begins, we will begin to release bikes to standby students. If you are registered and are running late, we will hold your bike up to 5 mins after the class start time if you call the studio to inform us of your tardiness. If you have signed up for a class online, make sure to check for an email confirmation. If you do not receive an email confirmation, please call the studio to make sure you were added to the class. If you are a NEW RIDER to the studio, you MUST show up 15 mins before your scheduled class. You will need to fill out a waiver and the trainer will need to set you up on your bike prior to the class start time. We do not permit new riders to enter class late under any circumstances. CANCELLATION You may cancel a reservation up to 12 hours prior to the start of class. If you cancel after that window of time, you forfeit a class from your series, regardless of whether you transfer into another class or not. If you have the New Rider package or any Unlimited package, you will be charged a $26 fee in the Los Angeles area or a $20 fee in the Atlanta area. If you do not show for your reserved class, you will be charged a $26 no show fee in the Los Angeles area, or $20 in the Atlanta area. Having another client show up “in your place” will not prevent a late cancel or no show fee from being charged on your behalf. If another client shows up and takes your reserved bike, they will be treated as a “walk in” client and your no-show or late cancel status will still apply. It is best to notify our front desk if you are unable to make it to your reserved class. STUDIO ETIQUETTE Please check in at the desk every time you come to ride. Please do not assume we see you when you walk in. If you are new to indoor cycling and arrive late, you will not be allowed into class. We encourage new riders to arrive 15 minutes early so that the trainer can perform proper bike set up prior to the start of class. No cell phones, ipods, ipads or mp3 players in class. Please silence your phones and put them away. Dedicate that hour to you. Leave everything but your mind and your body at the door. No talking during class. Please follow the instructions of the trainer during class. If you like to do your own thing, we encourage you to ride in the back row. ALL SALES ARE FINAL No returns or refunds on any purchase of a class package. WAITLIST After a class if full with online reservations, a waitlist opens up for 5 riders. Waitlisted riders will automatically be added to class by the order in which they signed up when/if reservations are canceled. Waitlisted riders will be notified via email up to 2 hours before the class start time if they are added. Waitlisted riders are responsible for attending or canceling from class once they are added. (All regular cancelation/ no show policies apply) Waitlist will be locked 2 hours before the class start time. After 2 hours, Standby will be implemented for any available bikes that open up due to late cancelations or no shows. Standby will be offered to students on a first arrive/ first serve basis. Riders must be present and waiting in the lobby to be placed on Standby. Standby riders may not claim a bike until the front desk releases an available spot to them. If a reserved bike is not claimed by the start of class, the front desk may release those bikes to standby riders. (Please wait to be permitted) Please note: Students with reservations that are running late MUST CALL the studio to be given a 5 minute grace period. Assumption of the Risk & Waiver of Liability Release to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Sweat Cycle has put in place preventative measures to reduce the spread of COVID-19; however, Sweat Cycle cannot guarantee that you will not become infected with COVID-19. Further, attending Sweat Cycle classes could increase your risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending Sweat Cycle and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Sweat Cycle may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Sweat Cycle employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at Sweat Cycle or participation in Sweat Cycle programming (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Sweat Cycle, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Sweat Cycle, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Sweat Cycle program. |
