RELEASE OF LIABILITY, INDEMNITY AND ASSUMPTION OF RISK
READ BEFORE SIGNING

IN CONSIDERATION of being permitted to participate in any Paintball and/or Airsoft activities including, but not limited to, playing, using the premises of, renting and operating equipment leased, sanctioned and/or operated by the above named vendor, I acknowledge and agree that:

I fully understand and acknowledge that; (a) risks and dangers exist in my use of any and all activities to include but not limited to Paintball, Airsoft, nerf. gellyball  and /or Axe Throwing.  (b) my participation in such activities and/or use of such equipment may result in my injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of B&A; the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, employees of B&A paintball LLC, or by any other person.

I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify B&A paintball LLC and it’s owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Paintball and/or Airsoft equipment or my participation in Paintball and/or Airsoft activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of B&A Paintball LLC.

RISKS OF COVID19 EXPOSURE: 

The Coronavirus (COVID-19) pandemic is a worldwide risk to human health. COVID-19 is highly contagious. While people of all ages are at risk of catching COVID-19, persons with compromised immune systems and older persons may be at particular risk.  Participate agrees to take all reasonable and necessary precautions to protect Participate and others from the spread of COVID-19, including, but not limited to, the following: 

A. Following all Federal, State, and local laws and Stay at Home Orders, even though they may be changing rapidly:

B. Exercising care to protect yourself, and assessing your own risks, by considering your age, underlying health conditions, recent travel, possible exposure to COVID-19, doctor's recommendations, and local, State and Federal recommendations. You agree and understand that it is your responsibility to evaluate the risks and protect yourself;

C. Washing your hands with soap and water or using hand sanitizer, before the after using the rental equiptment. Remember to not touch your eyes, nose or mouth;

D. Wearing a protective face covering when unable to social distance;

E. Practicing social distancing by keeping at least 6 feet between yourself and others.

Participate can obtain online information about COVID-19 Directives from the California Departments of Public Health (CDPH) and Industrial Relations (Cal/OSHA).  You understand that accessing a property for any of the purposes above (i) may be dangerous or unsafe and (ii) could expose you or others to COVID-19. You are voluntarily accessing the facility; To the best of your knowledge, you are not currently afflicted with COVID-19; To the best of your knowledge, you have not knowingly, within the last 14 days, been in contact with someone afflicted with, COVID-19; You are not experiencing a fever, or signs of respiratory illness such as cough, shortness of breath or difficulty breathing, or other COVID-19 symptoms; You understand that persons may be afflicted with COVID-19 and: (i) not exhibit symptoms, (ii) not be aware that they are afflicted or (iii) may not voluntarily agree to disclose their condition.

AGREEMENT, DECLARATION AND ASSUMPTION OF RISK: By signing below, you are declaring the foregoing is true, that you agree to take all recommended and reasonable actions to protect yourself and others from exposure to COVID-19, and that you ASSUME THE RISK, of entering the facility. You understand and agree that no one, including but not limited to the owners or the staff, can guarantee that you will not be exposed to or contract COVID-19.

MEDICAL PERMISSION AUTHORIZATION

 
If the participant is of minority age, the undersigned parent or guardian hereby gives permission for B&A Paintball LLC to authorize emergency medical treatment as may be deemed necessary for the child named below while participating in activity.
 
I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE B&A FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

Ranges and Training Areas Liability Waiver Form

Program Activity: 
In consideration for receiving permission to use equipment and participate in/on any Ranges or Training Areas, I agree for myself, my heirs, assigns, executors, administrators, personal representatives, and derivative claimants, that my participation in in/on any Ranges or Training Areas be undertaken at my own risk, and that in/on any Ranges or Training Areas, Camp San Luis Obispo, the California Army National Guard, the Department of the Army, the Government of the United. States, and its officers, agents, and employees, whether acting officially or otherwise, shall not be liable for any claims, demands, injuries, damages, actions or causes of action which arise wholly or partially due to the negligence of the.entities above, arising out of or in connection with my participation in in/on any Ranges or Training Areas, to include use of equipment provided for use in/on any Ranges or Training Areas. 

I understand that there are risks and dangers inherent in all outdoor recreation activities, including, but not limited to paintball, axe throwing, airsoft, rock climbing, mountain biking, high ropes course, climbing wall, rappel tower, and obstacle course. I am aware that the use of equipment relating to these activities can be hazardous, involving inherent and other risk of personal injury, property damage, and death. I understand and agree that by signing this release I am assuming full responsibility for any and all risk of death or personal injury or property damage suffered by me while participating in/on any Ranges or Training Areas at Camp San Luis Obispo. I understand and agree that by signing this release, indemnify, and hold harmless in/on any Ranges or Training Areas, San Luis Obispo, the California Army National Guard, the Department of the Army, the Government of the United States, and its officers, agents, and employees from any and all liability or costs, including attorney fees, associated with or arising from my participation in/on any Ranges or Training Areas and equipment provided for use in/on any Ranges or Training Areas. 

I agree to allow the Outdoor Recreation Program to utilize any photograph taken from my participation in any Outdoor Recreation Program for promotional purposes. 

The information requested above is solicited under the authority of 10 U.S.C. 3012 and will be used to ensure correct identification, to verify participation, and to determine responsibility in the event of accident, loss, injury, or death. It may be routinely provided to other Government agencies as necessary to resolve claims against the United States and to private insurance companies if necessary for these purposes. Disclosure of the information requested is voluntary; failure to provide this information will result in denial of the request to participate in Leadership Challenge Courses and the use of equipment provided by Outdoor Recreation.
