Waiver of Liability, Assumption of Risk, and Indemnity Agreement

Mendocino Magic LLC Campground & Events

In consideration for being allowed on the property known as Mendocino Magic Campground, located at 3000 Branscomb Road, Laytonville, California 95454 (the “Property”), I, for myself, my heirs, personal representatives or assigns, do hereby agree as follows: 

Waiver: I release, waive, discharge, and covenant not to hold responsible, Mendocino Magic LLC or Branscomb Road, LLC, any of its employees, officers, directors, volunteers, and agents, including owners and their family, employees, heirs and agents, from any and all liability for any loss, damage, injury, or expense, resulting from personal injury, accidents or illnesses, including psychological injury, emotional loss, or death, or property loss arising from, but not limited to, my presence at, or participation in, any activities at the Property.

Assumption of Risks: Participation in activities at the Property carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, and range from, but are not limited to: 1) minor injuries such as scratches, bruises, sprains, mosquito and spider bites or bee stings, poison oak or other rashes to 2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions to 3) catastrophic injuries including paralysis, drowning, or death. By signing below I understand the inherent dangers associated with visiting the property and risks associated with events on site.

I am responsible for myself, my own property including pets and vehicles, my decisions, and my own actions. 

NO CONSUMPTION OF ILLEGAL DRUGS ALLOWED ON PROPERTY.

NO ALCOHOLIC BEVERAGES for PARTICIPANTS UNDER 21 YEARS OF AGE.  

I have read the previous paragraphs and I know, understand, appreciate, and voluntarily assume these and other risks that are inherent in activities at the Property.

Indemnification and Hold Harmless: I hereby RELEASE, INDEMNIFY AND HOLD HARMLESS Mendocino Magic LLC and Branscomb Road, LLC, their family, employees, heirs, and agents and guests, from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities of any kind whatsoever, including attorney's fees brought as a result of my involvement of activities at and to reimburse them for any such expenses incurred. All the rights to indemnify hereunder shall survive termination of any agreement or this agreement. Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid by a court of competent jurisdiction, it is agreed that the invalidity of such clause or provision shall not otherwise affect the remaining portions of this agreement. 

Governing Law and Signatures: This agreement and all acts and transactions pursuant hereto and the rights and obligations of the parties hereto shall be governed, construed and interpreted in accordance with the laws of the state of California, without giving effect to principles of conflicts of law. I hereby submit to the exclusive jurisdiction of the courts of the State of California sitting in the County of Mendocino, and I waive any and all right I may have to such claims adjudicated in any other forum or venue. I agree that an electronic version of this agreement, or a copy of this agreement retained electronically, shall have the same validity and effect as a manually signed agreement.

 

I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights in a court of law, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability, and assumption of risk, to the greatest extent allowed by law.
