ALL PASSENGERS AND CAPTAIN MUST SIGN BEFORE DEPARTING THE MARINA.

I intend to be either the captain of or a guest and a passenger on a recreational boat that is being rented from PELORIA BRIDGE BAY LLC at the marina known as Bridge Bay at Shasta Lake.  The “Marina Parties” means Peloria Bridge Bay LLC, and all of its members, managers, officers, employees, agents and authorized representatives.

I recognize that being a guest and a passenger on a recreational boat has inherent risks.  Those risks include a broad range of things that can happen while boating, visiting waterfront areas, docks, ramps, gangways and traveling on rivers, lakes, the Delta, bays or the ocean.  Some of those risks include tripping, falling, slipping, losing my balance, line handling accidents, falling overboard, being struck by the boat, being struck by a propeller, drowning, anything that can happen when helping to handle and maneuver the boat, becoming seasick or experiencing a collision; the risks even include the boat sinking.  I recognize that all of those risks also include the possibility of all sorts of personal injuries and even death. I am choosing to participate in this activity in spite of those risks.


I therefore agree, without any reservation whatsoever, to assume all risks which may occur in connection with this activity resulting in any harm, damages, injury, illness, and/or death. 


I also assume all responsibility for all costs and medical expenses that I may incur resulting from my participation in this boating activity.  I agree that I will hold all of the Marina Parties harmless and free of all claims for liability, injury, illness, death, costs, medical or other expenses or damages incurred which may be caused by the acts, omissions or negligence of any of the Marina Parties, no matter what legal theory some lawyer may think up and try to assert against any of the Marina Parties. 


I further expressly agree that the foregoing release, waiver and assumption of risk is intended to be as broad and inclusive as is permitted by law and that if any portion, clause or sub-clause hereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and legal effect. 


I agree, by signing this Waiver and Release, that I have read and considered it carefully and that I have not been rushed or pressured in any way into agreeing to these terms.  I fully recognize that I cannot use the boat for any purpose unless I sign this Waiver and Release; and that I have the option of simply not being a captain, or guest, or passenger on the boat if I am not completely comfortable with these terms.

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above, and, for myself, my child and our heirs, assigns, and next of kin, I release and agree to indemnify defend and hold harmless, as provided above, The Marina Parties for any claims, costs or liabilities which they may incur, or which may be asserted against them, as a result of my minor child’s participation, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTY, to the fullest extent permitted by law. By signing below the parent or court-appointed legal guardian agrees that they are also subject to all the terms of this document, as set forth above.
