RENTAL AGREEMENT

Read and Understand It Before Signing

This agreement is made between SHAVER LAKE MARINA (hereinafter referred to as SLM) and the above named customer/renter. It is mutually agreed upon as follows: In consideration for use of the boat(s) and/or personal watercraft described herein;

2. Customer agrees that the rented boat(s) and/or personal watercraft will be used only for the purpose for which it was designed.

3. Customer acknowledges receipt of check-out/instruction sheet and agrees to comply with all rules, terms and conditions.

4. Customer agrees to inspect the rented boat(s) and/or personal watercraft, for damage and to ensure that it is in proper working condition. Any and all irregularities or damage are to be brought to the attention of SLM prior to use by customer.

5. Customer agrees that he/she will not allow rented boat(s) and/or personal watercraft to be loaned, rented or operated by any other person other than the customer and those persons who have been listed and who agree to the terms and conditions in the assumption of risk on the reverse of this page. NO RE-RENTING!

6. Renter agrees that he/she will not cause or allow rented boat and/or personal watercraft to be used in violation of any City, County, State, or Federal Law, ordinance, regulation or any sanctioned or organized race.

7. Customer agrees that in the event of any accident involving rented boat(s) and/or personal watercraft he/she will provide a complete report of the accident, and, if there are any injuries, or damage over $500, you will report said accident, as per California State Law to:

California State Parks, Division of Boating and Waterways, Accident Unit at P.O. Box 942896, Sacramento, California 94296-0001, (916) 327-1826 within 48 hours of the accident. All other accidents must be reported within 10 days.

8.  CUSTOMER’S LIABILITY FOR DAMAGE OR DESTRUCTION OF EQUIPMENT IS NOT LIMITED TO SECURITY DEPOSIT. Customer agrees that in the event of loss, damage to, or destruction of rented boat and/or personal watercraft or accessories, or the inability of customer to return said equipment to SLM on demand for any reason, customer agrees to pay SLM for repairs to or replacement of said equipment and accessories. Repairs will be charged to customer at SLM’s cost plus 25%. Customer authorizes SLM to take any steps necessary for collection of said repairs, including but not limited to non-return of security deposit and charging balance due to customer’s credit card. Customer is responsible for lost rental revenue at full-day rate during time equipment is unrentable.

9.  Customer agrees to return rented boats and/or personal watercraft to SLM at or prior to the time set forth below, or on its demand to avoid late charges. Units not returned upon demand will be considered stolen.

10. SLM is not obligated to give refund or partial refund of rental fees if customer is not satisfied for any reason outside the control of SLM, or for early returns.

11. No Barbequing is allowed on board the boat

SHAVER LAKE MARINA agrees to rent said boats and/or personal watercraft for $TBD per hour / 1/2 day / day. Boats and/or personal watercraft is due returned to SLM dock by TBDA late fee of $50.00 per 15 minutes will be charged, if not returned on time. Security Deposit of $TBD is refundable only if rented vehicle(s) is returned to SLM clean, undamaged and on time, full of SLM fuel.

RENTAL INSTRUCTION SHEET

EVERYONE:

  1. No-Wake zone inside buoys means SLOW! This means no wake or white-water behind vessel.
  2. Rotation in lake is counter-clockwise.
  3. Sail and/or paddled boats have the right-of-way.
  4. Keep a minimum distance of 200’ between other vessels. Keep at least 300’ distance from any boat with a safety flag raised.
  5. Children 12 years of age and under must wear their life jackets at all times. Children should remain seated while boat is underway.
  6. Engine must be turned off when boarding craft from the water.
  7. Shift gears (forward to reverse) only when moving very slowly and engine is idling. Approach dock at idle speed.
  8. There will be a $15.00 cleaning fee for boats returned excessively dirty. Clean muddy feet before boarding boat. 
  9. Wipe up food and drink spills immediately.  No cleaning fish on boat!!
  10. In the event of trouble or mechanical breakdown, call us at 559-841-5331 or wave down another boat or sheriff.
  11. Do not remove engine cover. Do not make adjustments or attempt repairs of any kind.
  12. Even weight distribution must be maintained while the boat is in motion.

PERSONAL WATERCRAFT:

  1. STAY AWAY FROM OTHER BOATS AND/OR WATERCRAFT! Failure to observe this rule will result in confiscation of vessel and forfeiture of rental fees and security deposit! Please be courteous to fishermen by staying at least 300’ away. Keep a distance behind them of at least 500’ to avoid becoming entangled in or cutting their lines. This will help to improve the image of personal watercraft users and ensure unrestricted lake access to personal watercraft in the future.
  2. Minimum operator age is 16 years of age. Persons 12 - 15 years of age can operate a P.W. if supervised by a person on board who is at least 18 years of age. Ages Sixteen (16) through Seventeen (17) can operate solo. Eighteen (18) and older can carry passengers. 
  3. Safety lanyard must be snugly affixed to operator’s wrist at all times while operating.
  4. Life jackets are provided and must be worn at all times. 
  5. Check beach and loading/unloading area to at least 2’ depth prior to approach. Approach only smooth, sandy areas, and at idle speed. Stop motor and step off craft in knee-deep water (approx. 10’-15’ from shore). Drop sand anchor and attach clip to bow eye or tow ring. Do not allow craft to touch shore or beach. Do not start or run engine in water less than 3’ deep!
  6. If an object has become lodged in jet, ride slowly back to dock.
  7. Personal Watercraft will not steer without the throttle on.
  8. No towing or skiing or swimming from personal watercraft (waverunner).
  9. It is highly recommended that a wetsuit or wetsuit bottom be worn while operating or riding on a PWC for protection, and always turn off the engine if anyone is near the rear of the PWC. There is a serious risk of water being forced into lower body openings of both males and females as a result of falling into the water, or being near the PWC jet thrust nozzle. The throttle should never be applied when anyone is in the water near the rear of the PWC. Normal swimwear does not protect against this forceful water entry. 
  10. The jet drive intake has tremendous suction and will pull loose items (i.e. long hair, sand, stones, fishing line, loose clothing, or life jacket straps) through the jet drive. Participants must keep these objects away from the intake grate. 

PONTOON BOATS:

  1. All passengers must stay behind closed front and side gates (if applicable) while boat is underway.
  2. Adult life preservers are provided for emergency use only. Life jackets will be provided for swim/play use at an extra charge.
  3. When approaching shore, slow to idle speed. An adult should stand at front of boat to one side to watch for obstacles. When it is determined that approach is clear, turn motor off and SLOWLY coast into shore. PUSH boat from shore when leaving. Water must be at least 3’ deep before starting motor. 
  4. No Barbequing Allowed On Boats.

FISHING BOATS:

  1. Adult life preservers are provided for emergency use only. Life jackets will be provided for swim/play use at an extra charge.
  2. When approaching shore, slow to idle speed, turn motor off and flip motor tilt lever to “up” position. Coast into shore with motor up.Push boat from shore before lowering motor, water must be at least 3’ deep, then return motor tilt lever to “run” position and lower motor before starting.

ASSUMPTION AND ACKNOWLEDGMENT OF RISKS AND RELEASE OF LIABILITY AGREEMENT

In consideration for being provided with watersports recreational equipment for use by myself and others, including any minor children for whom I am parent, legal guardian, or otherwise responsible, and for my/our heirs, personal representatives or assigns, I voluntarily sign my name as evidence of my acceptance of the following provisions:

1. ACKNOWLEDGMENT OF RISKS I acknowledge that some, but not all, of the risks inherent in the use of the watersports equipment and/or participation in the watersport activity include: (1) Changing water flow, tides, currents, wave action and ships’ wakes; (2) Collision with any of the following: other participants, the watercraft or any part thereof, other watercrafts or vessels, rocks, trees, and any other object, be they natural or manmade, obvious or not, submerged in water or protruding above the surface; (3) Wind shear, inclement weather, lightning, variances and extremes of wind, weather and temperature; (4) Loss of my/our sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions; (5) Collision, capsizing, sinking or other hazard which results in wetness, injury, exposure to the elements, hypothermia, and/or drowning; (6) The presence of insects and marine life forms; (7) Equipment failure or operator error: (8) Heat or sun related injuries or illnesses, including sunburn, sunstroke or dehydration; (9) Fatigue, chill and/or dizziness which may diminish reaction time and increase the risk of an accident.

2. EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY I agree to assume responsibility for all the risks of the activity, whether identified above or not, (EVEN THOSE RISKS ARISING OUT OF THE NEGLIGENCE OF THE RELEASEES NAMED BELOW, OR ANY OTHER PERSON(S) OPERATING THE CRAFT, AUTHORIZED BY ME OR NOT). My/Our use of the equipment and participation in the activity is purely voluntary. I assume full responsibility for myself and any minor children for whom I am responsible, for any bodily injury, accident, illness, paralysis, death, loss of personal property and expenses thereof as a result of any accident which may occur while I/we operate the craft or participate in the activity, (EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE RELEASEES NAMED BELOW, OR ANY OTHER PERSON(S) OPERATING THE CRAFT, AUTHORIZED BY ME OR NOT).

I agree to wear a U.S. Coast Guard approved personal floatation device (life jacket) while operating or participating as a passenger on a personal watercraft.

3. RELEASE I voluntarily agree to release, discharge, and hold harmless SHAVER LAKE MARINA, SOUTHERN CALIFORNIA EDISON, their principals, directors, officers, agents, employees and volunteers, their insurers, and each and every land owner, municipal and/or governmental agency upon whose property and activity is conducted (“owner”) and their insurers, if any, (Collectively, “Releasees”) FROM ANY AND ALL LIABILITY OF ANY NATURE FOR ANY AND ALL INJURY OR DAMAGE (INCLUDING DEATH) TO ME OR MY MINOR CHILDREN RECKLESSNESS, STRICT LIABILITY, BREACH OF CONTRACT, OR ANY OTHER ACT OR OMISSION OF THE RELEASEES NAMED ABOVE, OR ANY OTHER PERSON (INCLUDING MYSELF).

SHAVER LAKE MARINA reserves the right to accept or deny service to any person. I hereby agree to follow all rules, regulations, and instructions of SHAVER LAKE MARINA.

I HAVE READ THIS ASSUMPTION AND ACKNOWLEDGMENT OF RISKS AND RELEASE OF LIABILITY AGREEMENT. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING VALUABLE LEGAL RIGHTS, INCLUDING ANY AND ALL RIGHTS I MAY HAVE AGAINST THE OWNER, THEIR OPERATOR NAMED ABOVE, OR THEIR EMPLOYEES, AGENTS, SERVANTS, OR ASSIGNS. I VOLUNTARILY SIGN MY NAME AS EVIDENCE OF MY ACCEPTANCE OF THE ABOVE PROVISIONS.
