Texas Ninja League Waiver and Release of Liability

This Waiver covers persons participating (“the Participant”) in Texas Ninja League, Inc.(“TNL”) events including ninja obstacle competitions and tournaments hosted by participating gyms.

I Agree

I am the Participant or the parent or guardian of a minor under the age of 18 consenting here for the minor in my care to be the Participant in TNL events.  In consideration for the Participant being permitted to participate in TNL events, I, for myself, my personal representatives, assigns, heirs and next of kin:

1. ACKNOWLEDGE, agree, and represent that I understand the nature of TNL events and that the Participant is qualified, in good health and in proper physical condition to participate in such TNL events.

2. FULLY UNDERSTAND that TNL events involve risks and dangers of serious bodily injury, including the potential for permanent disability, paralysis and death (“Risks”) and while particular rules, equipment and personal discipline may reduce these Risks, these Risks of serious injury do exist; and that these Risks and dangers may be caused by the Participant’s actions or inactions, the actions or inactions of others participating in TNL events, the conditions in which TNL events takes place, or the negligence of the Releasees.

3. KNOWINGLY and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and all responsibility for losses, costs and damages that occur as a result of the Participant’s participation in TNL events.

4. HEREBY release, discharge and covenant not to sue the TNL, its affiliates, owners, directors, agents, officers, managers, partners, members, volunteers, employees, other participants, and its attorneys (“the Releasees”) from all liability, claims, demands, losses or damages caused, or alleged to be caused, in whole or in part by the negligence of the Releasees or otherwise to the fullest extent permitted by Texas law, including negligent rescue operations; and I further agree that if, despite this Waiver, I or anyone on behalf of the Participant, makes a claim against any of the Releasees, I will indemnify, save and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may be incurred as the result of such claim.

5. RECOGNIZE that infectious diseases such as COVID-19 may be spread through person-to-person contact or otherwise and may lead to severe illness, personal injury, permanent disability and death; and that while TNL recommends that participants in TNL events adhere to guidelines and restrictions set by facilities, state, federal or other governing entities, participation in TNL events could increase the risk of contracting an infectious disease by the Participant.

6. GIVE PERMISSION to TNL to use photographs, film footage, or video recordings which may include the Participant’s image or voice while participating in TNL events.

I acknowledge that I am age 18 or older, have read this Waiver and fully understand its terms; and that I understand that I have given up substantial rights by signing it, have signed it freely and without inducement, intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this Waiver is held to be invalid, the remainder shall continue in full force and effect.
