The Ordinary Climbers Limited – The Ordinary Climbers Climbing Gym Release of Liability and Assumption of Risk

Please ensure that you read and understand this agreement before proceeding. This document contains information on rules of the Centre, conditions of use and risks involved with participation. Release of liability is described below, if there is a question or a point that requires further clarification please contact a member of staff.

 

Participant Statements

BMC – “The British Mountaineering Council recognises that climbing and mountaineering are activities with a danger of personal injury and death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions.”

ABC – “All Climbing activities have a risk of serious injury. Participants must recognise that even if they follow all good practice there may still be the risk of accident and injury. It is the responsibility of the participant to adhere to the conditions of use.”

 

1.1   Assumption and Acknowledgement of Risk

I hereby acknowledge and accept that the activity of climbing, both indoors and out, and the use of The Ordinary Climbers Climbing Gym facility’s, participation in its activities and/or observation of such activities, involves risk. I recognise that some risks are inherent and as such cannot be eliminated or reduced. I can confirm that I fully understand the nature and extent of these risks, which can include, but are not limited to:-

  • All manner of injury resulting from falling from a height and coming into contact with the floor, climbing surface, holds, people and/or permanent or non-permanent structures.
  • Rope Abrasion, entablement and other injuries resulting from activities on or near the climbing structure, such as, but not limited to; climbing, belaying, abseiling, rescue systems, and any other rope activities.
  • Injuries resulting in the actions or oversight of others, including but not limited to; falling persons or equipment.
  • Failure to misuse any of any equipment, or part of The Ordinary Climbers Climbing Gym
  • Failure to follow The Ordinary Climbers Climbing Gym conditions of use as outlined in the below sections 1.2 and 1.3

I further acknowledge that there are risks associated with the use of The Ordinary Climbers Climbing Gym facility and participation on its activities other than the climbing related, including, but not limited to the use of the training equipment and studio, alone or as part of a group.

 

I can confirm that to the best of my knowledge neither I, nor any person(s) I am signing on behalf of, suffer from any condition (medical or other) that could increase the risk that I, or they, will be involved in an accident which could result in injury to myself, them or others. I am, nor any person(s) I am signing in behalf of, are under the influence of alcohol or drugs when entering the centre.

 

1.2   Conditions of Use

Our Duty of Care – The rule and instruction described in Section 1.3 are designed to provide a duty of care that we, as operators, owe to you, our customers, by Law. As such they are non-negotiable. If you are not prepared to abide by them then you are not permitted to use The Ordinary Climbers Climbing Gym. If you are found or reported to be not following these rules, then you will be asked to leave. This is in no way intended to limit the enjoyment of the facility.

Your Duty of Care – As a participant at The Ordinary Climbers Climbing Gym you also have a duty of care. You have a responsibility towards other users and to adhere to our rules. Statements of “best practice” are posted throughout the centre and describe accepted methods of use and expected behaviour both towards the centre itself, team members and to other customers.

Unsupervised Climbing – Prior to engaging in any activity at The Ordinary Climbers Climbing Gym without supervision, we expect that you be competent in the proposed activity. By registering, you completely understand and accept the risks, you agree to abide by the “1.2 Conditions of Use” and the section detailing “1.3 The Rules”. Unsupervised Climbing is down to the participant, team members will provide whatever help and advice they are able but a formal instruction in the use of climbing facilities and use of equipment will ONLY be provided when participating in a course delivered by staff. Should you not be competent with any equipment then you should not attempt to use it, without the supervision of a person signed off to that effect. Any persons not registered as competent climber must not take part in any unsupervised climbing without supervision.

Supervised Climbing – An adult aged 18 or over who has registered to climb may supervise in accordance with the Safe Supervision guidelines and must take full responsibility for the safety of the climbers’ they are supervising. Each supervisor (whether climbing themselves or not) may supervise two 8 + year olds or one under 8. In the case where one child is under 8 and one is over 8, you may supervise them both. Some exceptions will be made where the children have more than 6 months regular climbing experience and at the centres’ discretion. 4-6 year olds must always have 1-1 supervision, with no exceptions. Groups of three or more supervised climbers of any age must only be supervised by an instructor holding the relevant qualification and insurance. When engaged in supervision, a supervisor may never leave the ground either on a rope or auto belay. Good supervision requires close and careful supervision and by agreeing to supervise others you must do this.

Under 18’s – All Under 18’s must be supervised by a register and competent adult until they are themselves registered and assessed by centre staff to engage in “unsupervised climbing”

Your Data  by participating at the Ordinary Climbers Climbing Centre/Gym you accept that we will be keeping your data indefinitely, however at any time you can ask for your data to be deleted. In the event of a First Aid form needing to be filled out we will be keeping this information for 3 years. We take protecting your data seriously all data that we gather is kept in accordance with Data Protection Act.

 

1.3 The Rules

General Safety – Each visit to The Ordinary Climbers Climbing Gym must be started with “check in” at the reception, regardless of the activity. It is expected that while within the Centre all persons must exercise common sense, self-preservation and socially acceptable behaviour. You are expected to report any issues that you may find with the walls, equipment or other users behaviour. This must be done immediately.

Never lose awareness of your surroundings, never walk or place items beneath a climber. Keep bags and personal items in the shelves, not on the mats, floors or walkways. Running is forbidden in the centre.

The evacuation plan and exits will be pointed out during an induction and are clearly displayed throughout the centre, in the event of an emergency follow team members instructions without delay.

Climbing General – The Ordinary Climbers Climbing Gym is an artificial climbing environment: the risks are no less severe than when climbing outdoors. There is an additional risk that holds can spin or break. Climbing beyond your capabilities is likely to result in a fall so you must make your own assessment of the risk whenever you climb. Do not sit, stand or boulder under people. Do not grab or climb over the top of the wall, this is clearly defined and demonstrated during induction. Do not grab, lean or in anyway intentionally touch the roofing or non-climbing structure. Water bottles or food are not allowed on the bouldering mats at any time. Do not wear jewellery, particularly rings, when climbing these can catch and cause injury.

Bouldering – The impact matting under the walls does not guarantee your safety. Any fall may result in an injury to the participant or others. We require you to descend by climbing down carefully. Avoid uncontrolled falls. Do not jump from the walls. Do not leave any objects under a climber and be sure to ensure the area you plan to climb above is clear of objects, i.e. mobile phones and brushes. No harness or helmets to be used on the bouldering mats.

Auto-Belay – The line of climbing must be followed and not deviated from. When possible the landing zone should be checked to be clear before descending. The decent should be controlled and always to the ground, no attempt should be made to grab the wall after a fall. No helmets should be worn whilst using the auto-belays, along with loose clothing and surplus climbing equipment as this may snag on the decent and therefore must be removed.

Roped Climbing – Identify the nature of the route, top rope and lead. Do not remove a preplaced top rope unless a member of the team has instructed you to do so. Use a climbing harness to attach yourself directly to the rope with an approved knot, a re-threaded figure of eight and stopper knot is a must.

When using the lead lines, you must supply a rated dynamic rope of suitable condition and clip every quick draw in the appropriate sequence. Both screw gated carabiners should be used for the decent.

Belaying – Use an UIAA approved belay device securely attached to the harness with a locking HMS carabiner. Novice belayers should be supervised from the ground with the supervisor backing up on the break rope.

Weighted bags may be used to provide support only, direct belaying from these is not permitted. The ATC or branded Gri-gri device is preferred in lead climbing situations if both parties are competent in its use.

The location of a belayer is important and should be as close to the base of the wall and under the anchor of first clip. The nuances of efficient belaying can be discussed and learnt on a course provided.

Training equipment – All training equipment is used at your own risk, as such this is only available for the use of over 18’s unless currently under supervision from a Team member.

 

1.4   Release of Liability

My participation, and that of any person(s) I am signing on behalf of is voluntary, and I or they, elect to participate despite the risks.

I hereby voluntarily release, forever discharge and agree to hold harmless The Ordinary Climbing Climbers Gym and its owning company The Ordinary Climbers Limited, its owners and employees, with respect to all losses, damages, claims or other liabilities, whether known or unknown, arising out of any property damage, personal injury or wrongful death in any way connected to my participation, and that of any person(s) I am signing on behalf or, its facilities or employees, with the exception of gross negligence or intentional misconduct.

I authorise The Ordinary Climbing Climbers Gym employees to provide or obtain medical care without liability, for me or any person(s) I am signing on behalf of, and if required, to arrange the transport to a medical facility if required.

I confirm that The Ordinary Climbing Climbers Gym may use any photograph or video of me or any person(s) I am signing on behalf of, taken inside their facilities or at any activity hosted by them, for promotional purposes related solely to the advertisement of their business.
