This release and Waiver of Liability (the “Release”) executed on this day of December 17, 2024, by Volunteer (the ‘Volunteer”) in favor of Anchorage Ski Club, Inc., a nonprofit corporation dba Alpenglow at Arctic Valley, their directors, officers, employees, and agents (collectively, “ASC”). The Volunteer hereby freely, voluntarily and without duress executes this Release under the following terms: - VOLUNTEER ACTIVITIES. Volunteer does hereby certify that they are offering their services to ASC on a volunteer basis and that they understand they will receive no pay, benefits or other privileges of employment of any kind for their services. Volunteer certifies that they have not been promised and have no expectations that they will receive a paid position as a result of their volunteer work.
- RELEASE AND WAIVER. Volunteer does hereby release and discharge and hold harmless ASC and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Volunteer’s Activities with ASC. Volunteer understands that this Release discharges ASC from any liability or claim that the Volunteer may have against ASC with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Volunteer’s Activities with ASC, whether caused by the negligence of ASC or its officers, directors, employees, or agents or otherwise. Volunteer also understands that ASC does not assume any responsibility for or obligation to provide financial assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.
- MEDICAL TREATMENT. Volunteer does hereby release and forever discharge ASC from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer’s Activities with ASC.
- ASSUMPTION OF RISK. The Volunteer understands that Activities include work that may be hazardous to the Volunteer, including, but not limited to, working around ski lifts and other rotating equipment, operating light and heavy equipment such as snowmachines, groomers, plow trucks, etc., working in inclement weather, and transportation to and from worksites. Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases ASC from all liability for injury, illness, death, or property damage resulting from activities.
- INSURANCE. The Volunteer understands that, except as otherwise agreed to by ASC in writing, ASC does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each Volunteer is encouraged to obtain his or her own medical or health insurance coverage. Volunteer understands and acknowledges that as a volunteer, they are not entitled to any employment compensation, including pay, Workers Compensation coverage or any other benefits.
- PHOTOGRAPHIC RELEASE. Volunteer does hereby grant and convey unto ASC all right, title, and interest in any and all photographic images and video or audio recordings made by ASC during the Volunteer’s Activities with ASC, including but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
- RESPONSIBILITY. The Volunteer agrees that they are wholly responsible for their actions and their consequences. The Volunteer understands that they are responsible while on duty for representing ASC and Alpenglow at Arctic Valley and will conduct themselves in an appropriate manner while doing so.
- LIABILITY COVERAGE. Volunteers are covered by the ASC liability policy, subject to the terms and conditions of that policy. In the event a law suit is filed naming you due to an event that occurred while you were on duty at the area, you will be provided a defense subject to all the terms and conditions of the policy.
- OTHER. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Alaska, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Alaska. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provision of this Release, which shall continue to be enforceable.
