HANG GLIDING, PARAGLIDING, FLYING ULTRALIGHTS AND/OR LIGHT SPORT AIRCRAFT RELEASE OF LIABILITY, WAIVER OF LEGAL RIGHTS AND ASSUMPTION OF RISK.

 

   AGREEMENT AND RELEASE OF LIABILITY (Initial here_____) Inital Gliding Products and Activities Waiver Trike and glider flying is an extremely demanding sport requiring exceptional levels of attention, judgment, maturity and self-discipline. It is unlikely that you will be able to participate in it safely unless you make a conscious and continual commitment to your own safety. Powered Paragliding (PPG) and Hang Glider Trike flying is a dangerous sport and may result in injury and death even when practiced by a competent pilot using proper equipment. In consideration for being permitted to participate and purchase products for the sport of paragliding, paramotoring, powered paragliding (PPG), powered parachuting (PPC), hang gliding, and delta triking, ground instruction, solo and 2-place flight instruction, and related activities (herein after collectively referred to as "gliding activities") at all flying sites used by released parties, I, ____________________________, Click to Sign hereby agree as follows: 1. I hereby RELEASE AND DISCHARGE (Initial here_____) Inital  Florida Flight Sports, LLC, Richard E Davies, it's owners, agents, employees, instructors, pilots, monitors, assistants and the owners of the equipment and the land used for gliding activities (herein after collectively referred to as "Released Parties"), from any and all liability, claims, demands or causes of action that I may hereafter have for injuries and damages arising out of my participation in gliding activities, including but not limited to losses CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES (Initial here_____). 2. I further agree that I WILL NOT SUE OR MAKE A CLAIM against the Released Parties for damages or other losses sustained as a result of my use of gliding products and my participation in gliding activities (Initial here_______). Inital
3. I also agree to INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS from all claims, judgments and costs, including attorney's fees, incurred in connection with any action brought as a result of my use of gliding products and my participation in gliding activities (Initial here _______). Inital
4. I understand and acknowledge that gliding products and activities have inherent dangers that no amount of care, caution, instruction, or expertise can eliminate and EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN GLIDING ACTIVITIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASE PARTIES (Initial here ______). 5. I have been advised and recognize that the gliding products and my gliding activities are not covered by any personal accident or general liability insurance policy issued to the Released Parties (Initial here _______). Inital
6. I understand that the gliding products have not been designed, manufactured or tested to any federal or state government airworthiness standards or regulations. I am willing to assume personally all risks in the sport of glider flying, and all responsibility for any property damage, injury, or death which may result from my use of the gliding equipment (Initial here______).  Inital

I hereby expressly recognize that this agreement and Release of Liability is a contract pursuant to which I have released any and all claims against the Released Parties resulting from my use of gliding products and my participation in gliding activities including any and all claims caused by the negligence of the Released Parties (Initial here _______). 8. I agree to be financially responsible for any equipment damaged during my participation or training if the equipment is not owned by me (Initial here_____). Inital

9. Releasor expressly agrees that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of Minnesota and that, if any portion of the agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect (Initial here_____). 10. Releasor releases all officials and professional personnel from any claim whatsoever on account of first aid, treatment or service rendered releasor during participation in any of the above mentioned products and activities (Initial here_____). Inital
11. This release contains the entire agreement between parties to this agreement and the terms of this release are contractual and not a mere recital (Initial here_____). Inital
12. This release is meant to be enforced under the laws of Minnesota and to the fullest extent of Minnesota law. This release is not intended to, nor does it, release claims for damages, injuries or death resulting from conduct that constitutes greater than ordinary negligence. I HAVE READ THIS AGREEMENT AND RELEASE OF LIABILITY. I FULLY UNDERSTAND ITS CONTENTS AND MEANING, AND SIGN IT OF MY OWN FREE WILL.
