Dog Waiver & Release of Liability

MINERALS RESORT & SPA, INC  (Herein referred to as RESORT) AND I agree as follows:

In this Release Agreement the term RESORT shall include all activities, events and services provided, arranged, organized, conducted, sponsored or authorized by RESORT and shall include, but are not limited to: my presence and use of the premises of RESORT, whether in the parking lots, the access areas, shuttle bus/transportation and the use of the mountain for all activities in any way whatsoever.

In this Release Agreement the term Pet shall refer to dogs only.  All other animals are prohibited under this agreement from staying at the Resort.

I, the undersigned understand and EXPRESSLY AGREE that as a responsible pet owner, I agree to accept full responsibility for any and all damages and/or unusual degree of soiling caused by my pet during my stay at the hotel.  I understand that the costs for the repair of any damages or additional cleaning requirements (including labor) will be charged accordingly. This includes flea treatment of the guest room or suite as well as any damaged caused throughout the Resort.

I acknowledge that my pet, if left alone in the room, should be in its pet carrier/crate. I also acknowledge that if my pet is not crated or in a carrier and is alone during housekeeping service, I will not receive service for the day.

I acknowledge that I will keep my pet  on a leash or in a pet carrier at all times when outside of the guest room and on RESORT property.  I acknowledge that I will walk my pet to relieve it of bodily functions on the OUTER perimeter of the hotel property, away from the side of the building and flower beds. I am also responsible to clean up any refuse produced by my pet. 

I acknowledge that my pet had received and is current with all required shots & immunizations. I can produce those records if required at any time during my stay. I acknowledge that my pet’s current rabies tag must be worn at all times.

I acknowledge that barking, biting, and other harmful and nuisance behaviors will not be tolerated. If there is a problem, at management's sole discretion, I will be asked to kennel my pet or leave the hotel without reimbursement.  

I agree, to the fullest extent permitted by law, TO DEFEND, INDEMNIFY AND HOLD HARMLESS RESORT from any and all claims, suits, costs and expenses including attorneys’ fees for personal injury, death or property damage from and/or as a result of pet's stay, even if claims from injured third parties arising or allegedly arising out of or resulting from said pets conduct.  

In exchange for, and in consideration of, RESORT making facilities, activities and the premises available to me for, I CONTRACTUALLY AGREE that any and all disputes between myself and RESORT arising from my participation, and including any claims for personal injury and/or death, will be GOVERNED BY THE LAWS OF THE STATE OF NEW JERSEY and the EXCLUSIVE JURISDICTION thereof will be in the state courts of THE STATE OF NEW JERSEY and venue in the state court shall be in Sussex County.

It is possible that the Resort may take photographs and/or video of you while you participate in activities. By signing this waiver, you agree to allow the Resort to use these images and/or videos for promotional purposes on its website, in social media, print, digital and other advertising and that no compensation will be provided for use of these images and videos. 

I, the undersigned, HAVE READ AND UNDERSTAND the terms of the above and the FULL RELEASE FROM LIABILITY AND INDEMNITY AGREEMENT which is an essential part of it.  I am signing it freely and of my own accord, realizing IT IS BINDING upon myself, my heirs and assigns.

If any part of this agreement is deemed unenforceable, the remainder shall be an enforceable contract between the parties.

No more than one (1) pet is allowed per room.
The following pet fee will be charged at check out: $20 per night for a maximum of $40 per stay per room. Authorized Services Animals are not subject to this fee.
A cleaning fee of $75 per stay per room will be charged. Authorized service animals are not subject to this fee, but are subject to any fees associated with excessive damage or cleaning required due to service animal.
