Moser Manor Farms Rental Agreement and Farm Etiquette

Indemnification/Hold Harmless

By checking the box below, I am acknowledging that I am claiming responsibility for myself and any others I bring with me to Moser Manor Farms. This includes the conduct of all persons entering the facilities during the terms of this Agreement. Moser Manor Farms will not be held responsible for the loss, damage or theft of personal property of, or personal injury to, those persons. I agree that I shall indemnify, defend and hold harmless Moser Manor Farms and its employees, officers, servant’s, agents, and owners from and against any and all damage, loss, claims, suits, demands, actions, fines, damages, liabilities, costs and expenses (including, without limitation, reasonable attorneys’ fees) arising out of or in connection with damage to property or injury to persons or contraction of infectious disease or virus (including death) which arise out of my use of the facilities; including but not limited to any acts or omissions of me, its agents, contractors, employees, invitees, guests, servants or subcontractors. I shall provide Moser Manor Farms immediate notice of any injury or damage to persons or property in, to or around the facilities of which I am aware.

Food and Catering

All vendors and caterers are required to list Manager as an additionally insured on their insurance. Caterers will be allowed but must be approved by Manager at least 30 days prior to the Event. Caterers must adhere to ALL rules and Regulations outlined in this document or otherwise by Manager and provide services including Insurance, Clean Up, etc. A catering prep kitchen is available on-site for event use but there is no refrigeration. Plan accordingly.

Music & Alcohol

Music is allowed but must be in accordance with noise ordinance rules. Only one amplifier is permitted on the premises due to this ordinance.

No hard alcohol is permitted on the premises. ALCOHOL The serving of alcohol is permitted for private events, under the following conditions: a. Licensee must comply with all laws regarding sales, service, and consumption of wine and/or beer. If attendance at an event is by invitation only and there is no charge either for the sale of alcohol and/or beer or for admission to the event, an alcohol license may not be required. It is the responsibility of the Licensee to determine whether the event is exempt from the requirement for an alcohol and/or beer license. b. Any event where beer and/or wine are served, either through a cash bar or through the charge of admission to the event, appropriate beer and alcohol sale licenses are required. Licenses can be obtained either by Licensee through a “special event permit,” or by a caterer who holds a valid license for dispensing beer and/or wine. Licensee shall be solely responsible for determining what licensing requirements apply to its event, and for insuring that required licenses are in place before the event is conducted. Licensee is also responsible for providing a copy of the license to Manager being relied upon for sales of alcohol. Manager reserves the right to cancel any event if determined that required licenses and/or permits have not been obtained, or if there is any other violation of the laws regarding sales, service, and consumption of alcohol. c. Additional liquor liability insurance coverage must be acquired by Licensee when selling alcohol. d. No one under the age 21 shall serve or be served alcoholic beverages. Manager reserves the right to refuse the serving of alcohol at their discretion.

Smoking 

Absolutely no smoking of cigarettes or cigars or any product that has an open flame are permitted on the property given the highly flammable nature of hay and the proximity of the barn. Vape pens are permitted.

Open Flames

No open flames due to the highly flammable nature of hay and the proximity of the barn. If you wish for a fire pit to be setup for your event, this will be planned and located by the owners for fire prevention reasons. Only battery operated candles are permitted in the barn.

Animals

This is a working farm. Animals will not be accessed for your event unless otherwise predetermined by the owners. Do not feed the animals or touch the animals to avoid the transmission of illness to you or our animals.

Refund Policy for Rent the Farm

Payment in full is required to reserve a private event on our farm. 50% of your payment will be refunded for cancelation up to 60 days prior to your event. By checking the box below, you are agreeing to this policy.

Damage 

 To secure the date: » Signed copy of the rental Contract » One-half of the fee to reserve the event date/time » $1000 damage and cleaning deposit • Due no less than thirty (30) days prior to the scheduled event: » Remaining balance of the total fee A $35.00 service charge will be assessed for any returned checks. We require a refundable deposit of $1000 for event rentals to cover damages incurred by guests. Upon execution of signing the rental contract, and in conjunction with the down payment, the Licensee will deposit the sum of $1000 to the Owner, which is to be held as collateral security. In the event that the client adheres to the rules and regulations of this contract, the property is left in the condition that it was found, no damage is done and the client stays within their rental hours, the Manager will mail a $1000 check to the Licensee the week after their event. Moser Manor Farms is not responsible for clean up. All trash must be taken with the licensee after event is complete.

Setup and Cleanup

Your rental time includes setup and cleanup. Plan accordingly.

Trash Removal

Moser Manor Farms is not responsible for clean-up after your event. A fee will be taken from the $1000 deposit included in the Farm Rental Agreement if trash is not cleaned up by licensee and removed. This fee will be determined at the discretion of the Owner.

Walk Through

If you would like to rent Moser Manor Farms for a day, it is imperative that we schedule a walk through with you to help you plan the logistics of your event. We will be looking at set up placement, parking, kitchenette and restroom locations as well as the itinerary you have planned.

I have affirm that I have physically walked through the farm with the owners, Vanessa & Jeff, and have discussed the logistics of set up and parking for my event. Up to 1 hour.
