Agreement and Release of Liability

   Under Florida Law, an equine activity sponsor of equine professional is not liable for an injury to, or death of a participant in equine activities resulting from the inherent risks of equine activities. Equine activity is any activity involving horses.

    I acknowledge that I have voluntarily agreed to be on the property where there are horses, bulls, cattle, and other animal activities. I am aware that horses, bulls, cattle, and other animal activities are hazardous activities. I am voluntarily participating in these activities with knowledge of the danger involved and assume any and all risks of injury, death, or property damage.

    In consideration of being permitted by Becky Hayes, or Jill Hayes Nelson, or their agents or volunteers (them), to participate in these activities and/ or to use their facilities or property, guests, licenses invitees, I agree that I and my heirs, legal representatives agents and assigns will not make a claim against, sue, attach the property of, or prosecute them for any injury, death, or property damage occurring to me or my family as a result of my participation in activities with them or on the property they control whether caused by negligence of them or otherwise in addition , I release and discharge them from all actions, claims, or demands that I and my heirs, distributes, guardians, legal representatives, or assigns now or in the future may have for any injury, death, or property damage resulting from my participation in any activities conducted by them and/or property they control.

    I agree for myself and my heirs, distributes, guardians, legal representatives and assigns that in event that any claim for personal injury, death, or property damage shall be prosecuted against them, I shall indemnity and save them harmless from any and all such claims or causes of action by whoever made and where presented.

    I have carefully read this release and fully understand its contents. I am aware that this is a release of liability and a contract between myself and them and signs it of my own free will.

    I assume full responsibility for and risk of bodily injury, death, or property damage to negligence of them or otherwise while in or on any area controlled by them, and/or while competing, officiating in, volunteering, working or for any purpose in any activity involving animals on their property.

    I agree that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida and that if any portion of the agreement is held invalid, it is agreed that the balance shall, not withstanding, continue in full legal force and effect.

    I shall also indemnity and hold harmless them, their agents, representatives, employees, assigns or successors: (1) against and from all claims, costs, losses, damages, judgments, expenses, attorney’s fees or any other liabilities arising from my use of property they control and any activity thereon or from any activity permitted or suffered by my or my employees, guests or invitees in or about said property; (2) against and from my failure to comply with any law, rule, regulation or order of any governmental authority. They shall not be liable to me or my family, agents, guests, invitees, employees or servants, for any damages or losses to personal property caused by any other person. I agree to indemnify and hold them harmless from and against all claims for damages to the property or persons arising from use of property controlled by them, or any activity, work or thing done, permitted or suffered by me in or about property controlled by them. They shall not be liable for personal injury or damage or loss of my personal property from theft, vandalism, fire, water, rainstorms, smoke, acts of God, acts of other persons, or any way connected to the negligence of them.
