DIRT SKILLS

In this agreement the term ‘mountain biking‘ shall include (but is not limited to): instructional skill sessions, group rides, seminars and other and services in any way connected or related to those activities. I acknowledge that once signed, the terms of this document will apply to all occasions that I undertake activities with DIRT SKILLS.

ACKNOWLEDGEMENT – SAFETY

I acknowledge that I have been advised to wear an approved helmet while bicycling. I am aware of the requirement to abide by any applicable traffic laws. I am aware that there is an instructor available to answer any questions I may have regarding correct use of the bicycle. I am familiar with the proper use of the bicycle, including all quick release mechanisms, brakes and gear shifters. I undertake to cease participation if I sense or observe any unusual hazards or unsafe conditions or if, at any time, I feel unfit, unable or unsafe to continue safely for any reason whatsoever. I understand that responsibility for my personal safety is solely mine, including physical and emotional preparation and fitness to participate in any activities.

ASSUMPTION OF RISKS

I am aware that mountain biking (The Activities) involves many risks, dangers and hazards and that injuries are a common and ordinary occurrence of the sport. These risks, dangers and hazards include, but are not limited to: mechanical failure, changing weather conditions, collision with natural or man-made objects including, but not limited to, exposed rock, earth, trees, stumps or branches on or adjacent to the riding terrain, collision or encounters with other cyclists, pedestrians, wildlife, vehicles, fences or posts, changes or variations in the mountain biking surface or sub-surface, streams, creeks or holes in the surface, cliffs, crevasses, road banks or cut banks, variation of steepness of terrain, difficulty or inability to control one's speed or direction, loss of balance, rapid or uncontrolled changes in acceleration on hills and inclines, becoming lost or separated from the instructor or other participants, failure to ride safely within one’s own ability or within designated areas, negligence of other participants or cyclists, and NEGLIGENCE ON THE PART OF DIRT SKILLS OR THEIR STAFF INCLUDING THE FAILURE ON THE PART OF DIRT SKILLS OR THEIR STAFF TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF MOUNTAIN BIKING. I am also aware the risks, dangers and hazards referred to above exist throughout areas used for mountain biking in all phases of the activity, and that many are unmarked. I am voluntarily participating in mountain biking activities. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS and the possibility of personal injury, death or property damage and loss resulting from any cause whatsoever and without limitation.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

I hereby sign this agreement on behalf of myself and my heirs.

  1. I agree as a precondition to my participation in all events organised by DIRT SKILLS that I will be strictly bound by the terms of this Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement .
  2. I acknowledge that ‘The Activities’ involve inherent risks and dangers that may cause serious injury and possible death to participants.
  3. I fully understand the risks and dangers associated with my participation in ‘The Activities’ and accept these entirely at my own risk.
  4. I hereby waive any and all claims which I may have against DIRT SKILLS, its directors, employees and representatives from all liability for injury, death, property damage or any other losses sustained by me as a result of my participation in ‘The Activities’, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care by DIRT SKILLS, its directors, employees and representatives
  5. This agreement and any rights, duties and obligations as between the parties to the agreement shall be governed by and interpreted solely in accordance with the laws of Australia (state of Queensland) and no other jurisdiction, and any litigation involving the parties to this agreement shall be brought solely within Australia (state of Queensland) and shall be within the exclusive jurisdiction of the Courts of Queensland.

I AM 18 YEARS OF AGE OR OLDER, AND I HAVE READ AND UNDERSTAND THIS AGREEMENT. I UNDERSTAND THAT THIS DOCUMENT CONTAINS AN UNDERTAKING NOT TO SUE DIRT SKILLS, ITS DIRECTORS, EMPLOYEES OR REPRESENTATIVES AND THAT IT CONSTITUTES A RELEASE OF LIABILITY AND AN INDEMNITY FOR ALL CLAIMS.

IF I AM THE PARENT OR GUARDIAN OF THE PARTICIPANT, I HAVE READ AND UNDERSTAND AND EXECUTE THE AGREEMENT ON BEHALF OF MY CHILD/WARD.
