I, (herein the “Participant”) agrees to indemnify and save harmless TDL Bouncin’ Co. LLC dba Yo Big Bounce! (herein the “Owner”), Mahoning County Agricultural Society, and its successors, assigns, agents, servants, employees, and affiliates, for any and all claims, causes of action and suits occurring or resulting from any damage, injury, or loss to any person or persons, including to the Participant himself/herself and his/her minor children, and their heirs and spouse from any loss, damage, cause of action, claim or suits, for damages including, but not limited to, bodily injury (including death), loss of property, goods, wares, or merchandise caused by, arising out of or in any way connected with the Participant’s and/or his/her minor children’s use of any bounce houses, slides, obstacle courses or any other exhibits (collectively referred to herein as “Bounce Units”) displayed by the Owner at a location of, ******7265 Columbiana-Canfield Rd, Canfield, Ohio 44406********, (herein the “Event”).

Participant and/or his/her minor children assumes all risk (including, without limitation, all risk or injury or death) inherent in the voluntary use the Bounce Units. This paragraph is further intended to have the Participant on behalf of himself/herself and his/her minor children, and their heirs and spouse indemnify and hold Owner harmless for any acts or omissions on the part of the Owner , their successors, assigns, agents, servants, or employees, which may or may not be alleged to cause any property damage, personal or bodily injury (including death), related losses or claims for such related losses, resulting from any activity with regard to occurrences during the erection and dismantling of the Bounce Units displayed at the Event.

Participant on behalf of himself/herself and his/her minor children, and their heirs and spouse shall indemnify and hold harmless Owner, it’s successors, assigns, agents, servants, and employees for any responsibility for any damage by fire, theft, storm, flood, civil disturbance, act of God, other events which may cause damage or loss to personal property of the Participant, his/her minor children and/or spouse or any other party who may in any way be injured thereby.

Participant on behalf of himself/herself and his/her minor children, and their heirs and spouse further releases and forever discharges from liability any claim that the Participant, his/her minor children, his/her heirs and spouses, may have for bodily injuries (including death) or property damage which the Participant , his/her minor children, his/her heirs and spouses, may suffer as a direct result of any negligence of the Owner, their agents, officers, members, employees, or affiliates.

Participant on behalf of himself/herself and his/her minor children, and their heirs and spouse further agree to reimburse any reasonable attorney fees and costs which may be incurred by Owner, or their agents, members, employees, or affiliates in defense of any such liability claim, demands, actions or right of action.

It is expressly agreed that the Owner, TDL Bouncin Co LLC, shall not be responsible for any property damage of any kind owned or possessed by the Participant at the Event or any bodily injury (including death) to, or the personal conduct, safety, and welfare of, the Participant and/or their minor children, or other users of the Bounce Units at the Event. The Participant on behalf of himself/herself and his/her minor children, and their heirs and spouse expressly release and agrees to indemnify Owner, and their respective agents, officers, and employees or affiliates from any and all claims, damage, losses or liability associated therewith. The Participant on behalf of himself/herself and his/her minor children, and their heirs and spouse expressly agree to defend, indemnify, and hold Owner harmless from any and all claims arising out of any accident, injury, damage or other loss or harm to or incurred or suffered by any person in connection with or incidental to the activities of the Participant himself/herself or his/her minor children, heirs, and spouse.

Participant on behalf of himself/herself and his/her minor children also acknowledges that the Owner may obtain images or videos of the Participants during their use of the Bounce Units for Owner’s use. Participant on behalf of himself/herself and his/her minor children hereby grants the Owner, it’s successors and assigns, along with their agents and affiliates permission to use such

images or videos for Owner’s advertising, promotional, and marketing materials without compensation of any kind.

Rules 

1. Must have adult supervision at all times.

2. No shoes, no loose jewelry, no glasses, and/or nothing that may be sharp or hard.

3. Use of socks are required when on all dry bounce units.

4. No flips, no wrestling, no climbing the net walls, or aggressive behavior while on the bounce unit.

5. With multiple person use, children of the same age and size (approximately) should use the units at the same time to avoid injury.

6. Users should not lay down or sit while others are bouncing to avoid injuries. 

7. No Food, drinks, gum, or candy is permitted in or on the bounce unit.

8. No Sand, glitter, or silly sting is permitted on or around the inflatable units.

9. If the bounce unit begins to lose air (deflates), exit immediately.

10. If weather begins to rain, or becomes windy in excess of 15mph, please exit immediately.

11. No one with any medical conditions, including pregnancy, shall enter the unit at any time.

12. When using the single lane ladder stairs, only one person is allowed at a time. You must wait until the ladder stairs and landing entry is clear before beginning the climb.

13. All children under the age of 6 shall not use the inflatable units unless they are accompanied by their parent or legal guardian.
