ASSUMPTION OF RISK & INDEMNITY AGREEMENT (MINOR PARTICIPANT)

This Agreement is signed by me, the parent or legal guardian of a minor participant (the “Child”), in favor of Brika Investments LLC, its owners, officers, directors, employees, coaches, contractors, agents, insurers, affiliates, and program partners (collectively, the “Releasees”).

By agreeing to this Waiver, I acknowledge and agree to the following:

1. Definition of “Activity”

For purposes of this Agreement, “Activity” includes all sports, training, camps, clinics, tournaments, open gym, rentals, events, and any other activities or services provided, arranged, organized, conducted, sponsored, or authorized by the Releasees.

It also includes use of all areas of the facility and premises, including courts, equipment, restrooms, spectator areas, walkways, sidewalks, and parking lots, as well as travel to and from any Activity.

2. Assumption of Risk

I understand that participation in the Activity involves inherent risks, including but not limited to:

  • Physical injury (minor or serious),
  • Psychological injury,
  • Illness or exposure to bacteria and viruses (including but not limited to COVID-19),
  • Temporary or permanent disability, or death.

These risks may arise from my Child’s actions, the actions or inactions of others, the condition of the facility or equipment, or travel to and from the Activity.

I voluntarily allow my Child to participate in the Activity and fully assume all such risks, whether known or unknown.

3. Release of Liability

In consideration of my Child being allowed to participate in the Activity, I, on behalf of myself, my Child, and our heirs, executors, administrators, successors, and assigns, hereby release, waive, and discharge the Releasees from any and all claims, demands, actions, causes of action, damages, or liabilities of any kind arising out of or related to my Child’s participation in the Activity or presence on the premises, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

This Release includes, without limitation, claims for personal injury, illness, death, property damage, or economic and non-economic loss.

4. Indemnity

I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, demands, suits, damages, losses, liabilities, costs, and expenses (including court costs and reasonable attorneys’ fees) arising out of or related to:

  • My Child’s participation in the Activity;
  • My own presence or conduct on the premises; or
  • Any claim brought by or on behalf of my Child or any third party related to my Child’s participation in the Activity.

5. Medical Condition, Insurance & Emergency Authorization

I certify that my Child is in good health and is physically and mentally able to safely participate in the Activity. I understand that the Releasees do not provide health or medical insurance, and that I am solely responsible for all medical expenses relating to my Child.

If my Child is injured or becomes ill during the Activity and I cannot be reached, I authorize the Releasees and their staff to do the following:

  • Secure and consent to emergency medical care and treatment deemed necessary for my Child (including evaluation, treatment, hospitalization, surgery, medications, or other procedures);
  • Authorize transport of my Child by ambulance or other means to a hospital or medical facility; and
  • Share relevant information with medical providers as needed for my Child’s care.

I agree to be financially responsible for all costs related to such medical care, treatment, or transportation.

6. Property & Personal Belongings

I understand and agree that the Releasees are not responsible for any lost, stolen, or damaged personal property belonging to me, my Child, or any guest, whether occurring in the facility, parking lot, or any area on or around the premises.

7. Facility Rules, Behavior & Inspection

I agree that my Child and I will follow all rules, instructions, and policies of the facility and staff. I understand that the Releasees may remove any participant whose behavior is unsafe, disruptive, or disrespectful, without refund.

I agree to inspect the facility and equipment before my Child participates. If I notice any unsafe or hazardous condition, I will immediately notify staff and will not allow my Child to participate until the condition is addressed.

8. Media & Promotional Use

I understand that Activities may be recorded, photographed, or broadcast. I acknowledge that any photographs, video, or audio captured by or on behalf of the Releasees that include my Child may be used for promotional, advertising, social media, and training purposes, in any media now known or later developed, without compensation.

If I do not consent to such use, I will notify the organization in writing in accordance with its policies; otherwise, consent is deemed granted by agreeing to this Waiver.

9. Governing Law, Severability & Continuing Effect

I expressly agree that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and that it shall be governed by Florida law.

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

I agree that this Waiver and Release of Liability shall apply to this visit and all future visits and Activities involving my Child with the Releasees, regardless of the date it is signed electronically.

10. Acknowledgment & Consent

By signing or electronically agreeing to this Waiver, I confirm that:

  • I am the parent or legal guardian of the minor participant;
  • I have fully read and understand this Waiver and Release of Liability, Assumption of Risk & Indemnity Agreement;
  • I understand that I am giving up substantial legal rights for myself and my Child, including the right to sue;
  • I am signing freely and voluntarily, not under the influence of drugs or alcohol, and have full capacity and authority to enter into this Agreement; and
  • I intend my agreement and electronic signature to be a complete and unconditional release of all liability to the fullest extent permitted by law.
