Ascubadiving, LLC– Equipment Service Release of Liability

RELEASE OF LIABILITY AND HOLD HARMLESS AGREEMENT

I, the undersigned, hereby acknowledge and agree to the following terms as a condition of having my scuba equipment serviced by Ascubadiving, LLC:

1. Assumption of Risk

I understand that scuba diving is an inherently risky activity, and that the proper functioning of scuba equipment is essential for safety. I acknowledge that equipment, even after professional servicing, may still fail due to factors beyond the service provider’s control, including but not limited to pre-existing damage, age, misuse, or manufacturer defects.

2. Limitation of Liability

I understand and agree that Ascubadiving, LLC, its owners, employees, and agents shall not be held liable or responsible for any injury, death, loss, or damage to persons or property arising from the use or malfunction of any scuba equipment that has been serviced.

3. Inspection and Testing

I acknowledge that it is my responsibility to inspect and test all equipment serviced before use, preferably under controlled conditions (e.g., shallow water or pool), and to seek professional assistance if I have concerns about its functionality.

4. No Warranty Beyond Service

I understand that while Ascubadiving, LLC uses certified technicians and follows manufacturer guidelines, no guarantee or warranty is expressed or implied beyond the specific service work performed.

5. Shipping and Handling Disclaimer(if applicable)

If I choose to ship my equipment to or from Ascubadiving, LLC, I accept all responsibility for any loss or damage that may occur in transit.

6. Indemnification

I agree to indemnify and hold harmless Ascubadiving, LLC from any claims, actions, liabilities, or expenses (including attorney’s fees) arising out of the use of equipment that has been serviced.
