SOMD Sports Plex, LLC Waiver & Release of Liability

In consideration of my participation in SOMD SPORTS PLEX, LLC., I hereby forever release and covenant not-to-sue SOMD SPORTS PLEX, LLC., the Board of Trustees, and any of their employees, instructors, volunteers, agents, coaches, and all others who are involved, from any and all present and future claims resulting from ordinary negligence on the part of SOMD SPORTS PLEX, LLC., or others listed for property damage, personal injury, or wrongful death, arising as a result of my engaging in or receiving instruction in club sports activities or any activities incidental thereto, wherever, whenever, or however the same may occur. I hereby voluntarily waive any and all claims both voluntarily waive any and all claims both present and future, resulting from ordinary negligence, that may be made by me, my family, estate, heirs, or assigns, and I relinquish on behalf of myself, spouse, heirs, estate and assigns the right to recover for injury or death.

I am aware that club sports at SOMD SPORTS PLEX, LLC. are vigorous team activities that can involve severe cardiovascular stress and violent physical contact. I understand that participation in club sports can involve certain risks, including, but not limited to, death, serious neck and spinal injuries resulting in complete or partial paralysis, brain damage, and serious injury to virtually all bones, joints, muscles, and internal organs, and that equipment provided for my protection may be inadequate to prevent serious injury. In addition, I understand that participation in club sports involves activities incidental thereto, including, but not limited to, travel to and from the site of the activity, participation at sites that may be remote from available medical assistance, and the possible reckless conduct of other participants. I am voluntarily participating in this activity with knowledge of the danger involved and hereby agree to accept any and all risks of property damage, personal injury, or death. I further agree to indemnify and hold harmless SOMD SPORTS PLEX, LLC. and others listed for any and all claims arising as a result of my participation in club sports activities or any activities incidental thereto, wherever, whenever, or however the same may occur.


I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Maryland, and I agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect. I further agree that the venue for any legal proceedings shall be in the State of Maryland.

I affirm that I am of legal age and am freely signing this agreement. I have read this form and fully understand that, by signing this form, I am giving up legal rights and/or remedies which may be available to me for the ordinary negligence of SOMD SPORTS PLEX, LLC., or any of the parties listed above.

CAUTION: READ THIS DOCUMENT CAREFULLY BEFORE SIGNING!

VIDEO CONSENT AND RELEASE

Effective as of the date shown below, approval for past use and permission for present and future use is being granted to SOMD SPORTS PLEX, LLC. of 3677 Middle Ground Court, Chesapeake beach, Maryland, 20732, to use a picture or voice recording of the undersigned.

Permission is being given by the undersigned, or the undersigned is the parent or legal guardian of the participant (the "Recorded Party") and states that the undersigned has the full legal authority to sign this Consent and Release on behalf of the undersigned, the Recorded Party, and all parties related to the Recorded Party.


For a valuable consideration, receipt of which is hereby acknowledged, the undersigned hereby grants to SOMD SPORTS PLEX, LLC. its agents, employees, licensees, and successors in interest (collectively, the "Released Party") all ownership rights and the absolute and irrevocable right and permission to copyright, use and publish the recorded image and/or voice of the undersigned (the "Image and/or Voice") that has been (or is being) obtained pursuant to this Consent and Release.

The Image and/or Voice may be copyrighted, used and/or published individually or in conjunction with other photography, video works, and recordings, and in any medium (including without limitation, print publications, public broadcast, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication.

The undersigned represents and warrants that (i) no other party has been granted an exclusive license with respect to the Image and/or Voice, and (ii) no other party's authorization or consent is required with respect to the permission granted to the Released Party under this Consent and Release.

The undersigned waives any right that the undersigned, the Recorded Party, or any party related to the Recorded Party may have to inspect or approve the Released Party's copyright, use or publication of the Image and/or Voice, or the advertising copy or printed matter that may be used in connection with the copyright, use and/or publication of with the copyright, use and/or publication of the Image and/or Voice. The undersigned, on behalf of the undersigned, the Recorded Party, and any other parties related to the Recorded Party, releases the Released Party (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Image and/or Voice (collectively, "Claims"). This release includes without limitation any Claims related to blurring, distortion, alteration, optical illusion, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of the Image and/or Voice.

THE UNDERSIGNED WARRANTS THAT THE UNDERSIGNED HAS READ THIS CONSENT AND RELEASE PRIOR TO THE SIGNING OF THIS DOCUMENT, THAT THE UNDERSIGNED UNDERSTANDS IT, AND THAT THE UNDERSIGNED FREELY ENTERS INTO THIS CONSENT AND RELEASE.
