Boating Liability Form

In consideration of the paid rental fee for Evergreen Park & Recreation District (hereafter “EPRD”) and the right to use Evergreen Lake (hereafter the “premises”), I RELEASE AND FULLY DISCHARGE EPRD, Evergreen Metropolitan District, the City and County of Denver, its owners, officers, directors, agents, employees, and volunteers from any liability resulting from personal injury to myself and/or my child or damage to or loss of my or my child’s property while participating in programs and activities on the premises.

I accept full responsibility for any injuries or damages, which may result from participation in and around the premises, and I hereby HOLD HARMLESS, RELEASE AND COVENANT NOT TO SUE EPRD, Evergreen Metropolitan District, and the City and County of Denver for any injury sustained by me and/or my child, or caused by me and/or my child, including death, while participating in any event or activity, including but not limited to boating, paddle boarding, kayaking, or canoeing, while on the premises. I accept responsibility for all EPRD rental equipment (vessel, paddle, life jacket) for the duration of the rental period. In the event of loss or damage to EPRD equipment I will accept financial responsibility and reimburse EPRD to the value of $50 for lost/damaged paddle, $20 for lost/damaged life jacket, vessel damage/loss to be evaluated on a case by case basis. 

The purchaser or user of this paid rental fee agrees and understands that all water and lake recreation can be hazardous and that lake conditions vary constantly because of weather changes. Customers under no circumstances are allowed to go out of the EPRD lake boundaries marked by yellow buoys at any time. This paid fee is nontransferable and will not be replaced if lost or stolen. This waiver is valid for the 2023 boating season.
