BOAT & JET SKI RENTAL AGREEMENT, RELEASE AND INDEMNIFICATION


Date: April 24, 2025     


For good and valuable consideration, the sufficiency of which is acknowledged by the undersigned parties, Lo Ryde Rentals, LLC (“Jet Ski Owner”) agrees to rent the Jet Ski listed above to Renter (identified above) for the time specified and subject to all terms and conditions set forth below.

 

1. The Renter, who has rented the jet ski will not hold Lo Ryde Rentals, LLC, or owners, liable for any injuries up to and including loss of limb or life, for themselves, their family, or any guests they bring on board the jet ski, the dock, or land connected to the dock.

2. Release and Waiver of Claims. Renter does hereby remise, release, and forever discharge jet ski Owner, jet ski Owner’s agents, servants, successors, heirs, executors, administrators and personal representatives, of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity, which Renter ever had, now has, or which Renter’s heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of this Agreement; out of the use (misuse, or abuse) of the jet ski; or in any way arising out of the rental relationship between Renter and jet ski Owner.

3. The Renter will be legally responsible for all medical bills for anyone injured while utilizing the rental, including loss of limb or life.

4. Renter(s) acknowledges and understands that Lo Ryde Rentals LLC, or Owner(s) cannot guarantee against mechanical failures of the rental Equipment. Renter(s) agrees to immediately notify Owner(s) of defective or non-working units. Owner(s) will make every reasonable effort to repair or replace defective units as quickly and efficiently as possible. Repair due to normal wear and tear on the Equipment will be made by the Owner(s). Should a repair person make a call to repair or replace a unit that is found to be in working order and the problem was due to Renter(s) oversight or neglect or misuse, Renter(s) agrees that the repair call costs may be deducted from the Renter(s) security deposit. Owner(s) can be contacted in the event of an emergency or to report defective equipment at (970)501-1502 or Info@LoRydeRentals.com.

5. Owner(s) certify that the jet-ski(s) are in good mechanical and physical condition. Renter(s) will inspect said Equipment and leases the same without any representations by Owners(s). If equipment has damage or problems Renters(s) must report damage on the provided form. Renters(s) will be held responsible for any damage to the jet ski that is not reported at the time of delivery.

6. I have been explained to and demonstrated how to run the jet ski, start the jet ski, locate and monitor fuel, how to refuel, how to monitor battery, how to park, and how to moore.

7. I have been shown the emergency devices: fire extinguisher, first aid kits, and life vests.

8. I understand that I am also fully financially responsible if I damage any jet skis, watercrafts, docks or other property while utilizing the Rental.

9. I understand and promise to adhere to state law regarding the use of life jackets. Any persons riding any jet skis or watercrafts must wear a life jacket at all times while on the jet ski. All persons must wear life jackets while swimming from the jet ski.

10. I understand that if I break any of the rules outlined in the manual, I will immediately forfeit the remainder of my stay on the jet ski and will not receive any refund. There are no refunds for any reason.

11. I understand that I am responsible for any damage to lake property, businesses, or watercraft that I damage while operating and renting the jet ski.

12. I understand that Vallecito Lake, Navajo Reservoir, Lake Nighthorse, Lo Ryde Rentals, LLC, owners and any employee will not be held liable for damage to my vehicle while in their care.

13. I understand that all rental units will come with a full tank of gas. All rentals of 4 hours or greater will be charged one full tank of gas at the time of delivery. The price paid will be equal to one full tank of unleaded gas at current pump prices.

14. The Damage Deposit: A damage deposit of $500.00 will be collected for each four-stroke watercraft rented. The deposit will be applied toward the cost of the repairs of any and all damages suffered to the watercraft. The security deposit shall not bear interest. Should any damages exceed the $500.00 damage deposit, Lo Ryde Rentals, LLC will provide an itemized repair bill, including lost rental time (Only applies to four strokes-lost rental time begins with the date of the itemized repair bill, and stops when the watercraft is once again available for rental). If the cost of damages exceeds the damage deposit, Renter agrees he/she is fully responsible for the remainder of the costs incurred to repair or replace the watercraft to the same condition as the time the rental agreement was started. Renter’s Credit Card will be kept on file until verification can be done that no damage has occurred and if damage has occurred Credit Card will be kept on file until a full itemized repair bill has been provided to Lo Ryde Rentals, LLC. Lo Ryde Rentals, LLC will bill Renter and if the bill is not paid within 30 days of the date of bill, Lo Ryde Rentals, LLC will charge the Credit Card on file. Furthermore, the User understands and agrees that he/ she who is known to Lo Ryde Rentals, LLC as the User, is the only person allowed to use the watercraft for the entire rental period. The User also understands that he/she is responsible for the retrieval and/or replacement of the watercraft, life jacket, or any safety items, if these items are in any way lost, stolen or misplaced during the rental period. User shall be responsible for damages at and beyond the $500 damage deposit. Renter will be notified immediately via email if any damages are found upon inspection and any costs charged to card on file.

PLEASE BE AWARE: Major problems that can arise are few but costly. For example, damage to the impeller can cost several hundred dollars for debris sucked into the jet ski while damage to the engine due to overheating because of debris being sucked in can cost several thousand dollars. See damage sheet for some potential costs.

 

15. In case of theft or loss, Renter(s) is responsible for the replacement value of the Equipment. In case of abuse or damage, Renter(s) will be charged for the repair or replacement of the Equipment.

16. Lo Ryde Rentals, LLC offers NO insurance coverage for equipment damages incurred during your rental period. Please check your homeowner, auto, or credit card policy to see if there is an endorsement available to you.

17. Renter (s) acknowledges that they have received the U.S. Coast Guard Boating Safety checklist.

18. RENTER ASSUMES THE RISK OF BODILY INJURY, DEATH, OR PERMANENT DAMAGE, whether due to the negligence of RENTERS, my negligence, or any other reason or factor, while upon the premises, while operating a PWC rented from or owned by Lo Ryde Rentals LLC., and/or while participating in any activities sponsored by Lo Ryde Rentals LLC. 


 

 

I agree and understand that:

A)     My participation in PWC or boating activities, as with any watersport, will test my physical and mental limits, involves very powerful machinery, and exposes me to dangers associated with the operation of PWC and/or boats. These dangers include, without limitations: collisions with other vessels, fixed objects, persons in the water, or objects in the water; exposure to the elements; mechanical breakdown; loss of control of the vessel; falling off the vessel; sinking of the vessel; drowning; and other dangers known or unknown. I understand these rules and assume the risk of harm presented by these damages. 


 

B)     My presence on the premises operated by Lo Ryde Rentals LLC and/or my participation in the PWC or boating activities organized by Lo Ryde Rentals LLC exposes me to the potential risks that include, without limitations: death or serious injury to myself and/or others; and damage to property owned by me, Lo Ryde Rentals LLC, and/or others. I understand these rules and assume the risk of harm presented by these damages.  



C)     PWC or boating activities may pose an additional danger to persons with pre-existing physical injuries or conditions, or other conditions, or to pregnant women. I am not aware of any physical or mental conditions that may affect my ability to participate in PWC or boating activities or that may be aggravated by the participation in such activities. Alternatively, I acknowledge that I have consulted with my physician who has advised me that I may participate in these activities without restrictions. I understand these rules and assume the risk of harm presented by these damages. 


 

D)     I will NOT participate in any PWC or boating activities sponsored by Lo Ryde Rentals LLC while my ability is impaired by alcohol, drugs, or otherwise. If found by discretion of Lo Ryde Rentals LLC staff and or Colorado Department of Natural Resources/Police to be impaired by said substances I further agree that my rental will be terminated and no refund will be provided. I understand these rules and assume the risk of harm presented by these damages.


 

E)      In the event of malfunction or breakdown of the craft, or if any defect occurs during the rental period, I shall immediately report any unusual problems to Lo Ryde Rentals LLC. Continued use of the craft in any of these circumstances shall be entirely at my risk and I shall then be under the obligation to assume any and all liabilities resulting from bodily injury, loss, or damage caused to all persons and property that may become involved into any accident. I understand these rules and assume the risk of harm presented by these damages. 


 

F) Lo Ryde Rentals LLC reserves the right to cancel any rental due to inclement weather or other unsafe circumstances. If a ride is cancelled due to bad weather Lo Ryde Rentals LLC reserves the right to either prorate a monetary return in place of time lost or may issue a voucher for a rental another time and or date. In the presence of lightning, we strongly recommend you remove yourself and the jet ski/equipment from the water as quickly and safely as possible.


 

G)     I will have the opportunity to inspect the PWC or other watercraft that I am renting from Lo Ryde Rentals LLC before I board the vessel. I will not participate in any PWC or boating activities until I inspect the vessel and I am satisfied with its condition. By participating, I acknowledge that I have conducted this inspection.


 

H)     I acknowledge that Lo Ryde Rentals LLC is not a manufacturer of the PWC/boat that I am renting and it does not make any representations, warranties of, or covenants, expressed or implied, with the respect to the condition, quality, durability, or suitability of the PWC/boat.


 

I)       I agree that I will not allow any other person to operate the vessel that I am renting from Lo Ryde Rentals LLC unless that person is a Lo Ryde Rentals LLC employee or agent or authorized additional rider that has signed an official agreement.



J)       I agree to return the vessel that I have rented from Lo Ryde Rentals LLC within the rental period that I negotiated. If I fail to return the vessel to Lo Ryde Rentals LLC for any reason other than mechanical malfunction that is not caused by misuse of the vessel, I agree to pay an additional sum equal to $500/day until returned to Owner(s). Failure to return equipment at agreed upon time could result in Criminal Charges.


 

K)     I understand that Lo Ryde Rentals LLC is not the only business offering PWC/boat rentals in La Plata County, Colorado and my decision to rent from them is “MY” choice.



L)      IT IS MY DUTY TO ASK LO RYDE RENTALS LLC TO FURTHER EXPLAIN ANY MATERIALS, RULES, REGULATIONS, OR INSTRUCTIONS THAT I DO NOT UNDERSTAND BEFORE I START MY RENTAL. I WILL NOT PARTICIPATE IN ANY PWC OR BOATING ACTIVITY IF I DO NOT UNDERSTAND ANY PART OF ANY MATERIALS, RULES, DETAILS, REGULATIONS, OR INSTRUCTIONS PROVIDED TO ME BY LO RYDE RENTALS LLC.



Indemnification. Renter hereby expressly agrees to indemnify and hold harmless Lo Ryde Rentals, LLC jet ski Owners, jet ski Owner’s agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands, or damages that arise out of Renter’s use, misuse or abuse of the jet ski.

 

Governing Law. This Agreement is governed, construed, and administered according to the laws of Colorado, as from time to time amended, and any applicable federal law. No effect is given to any choice-of-law or conflict-of-law provision or rule (whether of the State of Colorado or any other jurisdiction) that would cause the application of the law of any jurisdiction other than those of the State of Colorado.

 

Entire Agreement. This Agreement constitutes the sole and entire agreement of its parties with respect to the Agreement’s subject matter. This Agreement supersedes all prior and contemporaneous understandings, agreements, representations, and warranties with respect to the subject matter. As between or among the parties, oral statements or prior written material not specifically incorporated in this Agreement have no force or effect. The parties specifically acknowledge that, in entering into and executing this Agreement, each is relying solely upon the representations and agreements contained in this Agreement and no others.
